Payment of salary

My friend's business hasn't been operating since last one year as he has some legal issues to be sorted out so the office closed.He hasn't been able to pay 3 months salary to the employees as his bank accounts have been frozen. How dose he communicate to the employees his clear intent to pay when the bank accounts have been unfrozen and does he have to inform any regulatory authority about the same?

Relieving letter and experience certificate

Hi sir,

I am sankar . Currently working in chennai as a software quality assurance engineer. Yesterday(12.05.2014) i resigned my job .They said you need to complete your existing project commitments and then serve 2 months of notice period but i asked them to provide the HR policy document ,accidentally the terminate my services took my all the documents and push out me out of office.

Please help me to get the legal letter(relieving letter,experience certificate,pf close) from this organization and Background check.

To add employee in esic

Respected Sir,
I have to add 2(two) employees for ESIC contribution. We have filed regular monthly contribution till this month. but from last two years, we have not filed annual returns and six months return.
Now, I have to regularize it and add to said employees. What is procedure? is there any penalty?
Please guide.

Termination of services without due notice

A is employed by B on permanent basis after completion of trial. Appointment letter clearly states one month notice or one month salary in lieu of notice on either side. Within three months A was asked to leave the job by giving the previous month salary. Now A is due for one month notice pay, bonus amount deducted from his salary, provident fund deducted, professional tax (A is a senior citizen above 65 years of age). Now what is the remedies left to A to recover his dues. Is there any forum which could dispose of this case immediately? If not which is the court of jurisdiction? Will some one could advise?

I run a small manufacturing unit. I was made an offer in 2006 by the proprietor of a propritorship providing man power services that he can provide me 3 persons who are his employees to work on my premises, produce for me on my machines for a fixed monthly fee as quoted. The term is for 11 months. The offer was on plain paper. I verbally accepted and he sent his workmen. He has since made consective offers every eleven months, and that arrangement continues. He has increased his fee on every term, he is below the service tax slab hence not a registeted dealer. All payments are by cheques. Question now is: 1) Does such an 11 months arrangement require payment of duty, an therefore had to be executed on stamp paper before a notary? If yes what is the remidy, when so much time has lapsed? 2) What are the repercussions on me in respect of labour law? Kindly advise. Thankyou

AN EMPLOYEE X PWI DESIGNATION JOINED IN RAILWAY SERVICE IN YEAR 2000 IN GRADE 5000-8000 I JOINED SERVICE IN YEAR 1991 IN GRADE 1400-2300 DESIGNATION IOW gr-iii ,EMPLOYEE X PWI GOT PROMOTION BY VIRTUE OF RESTRUCTING TO GRADE 5500-9000 IN YEAR 2003 THE EMPLOYEE X PWI GOT MEDICAL DECATEGORIZED IN YEAR 17/04/2010 When seniority list was published he was shown senior to me in IOW category kindly advise the rule of seniority after medical decategorization in pwi category and after offered alternative employment in iow category he will be assigned seniority from dater of joining in year 2000 or assigned bottom seniority of year 2010

Trsnafer posting in case of pregency and family medical issues

I am currently employed with SBBJ as a Scale II officer in a samll town in Rajashthan. My Husband is emploed with a private firm that has presence in Delhi only.

I have made tranfer application since my marriage about 6 months back but there is no action on the same. This is a inter-zonal transfer situation.

My Mother in law is a cardiac patient and requires attention. I am currenlty pregenant and not in good health. In prevailing circumstaces it is increasingly getting difficult to stay far of from family.

Please advise whether the are any rules or court rulings that can help female employees seek tranfer to a branch near to family residence on medical/marriage grounds.
