Breach of employment contract - not fulfililng notice period

Hi,

We have a department manager who supposed to give 2 months notice but sent us email resignation one month ago for which we have recently responded asking to serve 2 M notice period as per appointment letter. But he is absconding saying that he asked for one month notice and him self taken it grated and joined some where. what all things can be done by employer ? what are employer rights ? his gratuity and EL s are due. without clearing no dues, and proper handover he has absconded and joined somewhere. please suggest.

Sexual harassment at workplace

Inquiry was not completed in 90 days according to Section 11 of POSH act, so can it extend beyond 90 days and under which law it is provided?

P.f not releasing by previous organisation

I worked with dish tv long back.I need to left the organisation all of sudden due to some personal reason now when I asked for p.f formalities to hr department they ask me to pay 3000 something amount in order to releasing my p.f .

Workman wages if his service is taken for two group company

Dear experts,

If a workman is on roll of a company and his services are also taken for work of other company of same group then according to labour laws whether he can seek minimum wages or justified overtime or suitable compensation for the work he performed for the other company.

under which section or act he should claim these wages for the work done for the second company if he has the documentary proof of taking work of other company by parent company . Whether he is eligible to file a complaint before labour commissiioner that he is being overused without paying anything for the work of second company

SC Caste certificate regarding

Sir/madam

My parents are from Andhra Pradesh and both my parents have caste certificates from Andhra Pradesh.
We are settled in karnataka now since past 15 years due to father's job.

I applied for certificate in Karnataka and got a certificate stating I am ordinary resident of karnataka from tehsildar, karnataka.

Now i came to know the def of ordinary resident which is as per the residence of forefathers before 1950. Now I know I am not ordinary resident of karnataka.

But My caste is sc in both ap and karnataka as per central list of govt of India. My caste is 'MALA'

I secured central govt job. And my certificate was sent for verification. I faced lot of difficulty while verification, it has been verified now. Since my job was central and i belong to same caste it was not impossible to convince the authorities.

Sir, I want to apply for another certificate in the karnataka stating that I am ordinary resident of Andhra in the migration format.

Since I am appearing for upsc I want to have certificate in correct format so that I would not face difficulty for the rest of my life.

If I have 2 certificates would it be a crime.

Can the government take action against me.

My caste is 'MALA'

Legal notice by employer for not serving notice period

Hi ,
I have received a legal notice by my employer for Not Serving Notice period , they have asked for 1 lakh Rupees and 15,000 as legal fees .
The details of my leaving are as follows -

Date of resignation - 25th Jan 2018 .
As per appointment letter I have to serve 1 month notice or pay 1 month basic pay , which in my case is 23,333 . I was still on probation .
My CTC was 8 lakhs , and inhand salary was about 62744 . I was not paid January Salary .

My actual reason for leaving was Mental Harassment by my Superior , Who verbally told me to resign and I did .

Please guide me how should I take this Matter .

Bond of 4 years

Hello sir,
I have signed a bond of 4 years with 3 lac bond money in a chemical plant and they asked me to submit a undated cheque of 3 lac rupees. I did the same because that time i was fresher and no one was giving job to freshers.
But as time passed now the managment is harassing me by abusing me and by making mentally pressure on me.
I have just completed 1 year and they are harassing me a lot.
And not giving me any increment in salary.
I joined at 10 k and they are still paying me 10k. When i asked them that if you have any problem with me then fire me, they said we wont.
If you want to leave then give us a resignation letter and we will submit your cheque in bank and withdraw 3 lac money.
Then you can leave.
But i cant pay them 3 lac money and they are harassing me a lot.
Please tell me what i do now?

Non payment of salaries and statutory dues

I am working with an organisation since May 2010 and presently have a lag of 12 months in salary along with statutory dues such as income tax and PF. PF has not been paid since June 2014. This all (lag in salary) started from 2014, and was bearable initially. This started getting worse in 2017 but the management kept in assuring that things will improve.
Let me know, how can I resolve this? Will it be a good idea to resolve this by being a part of the organisation and take legal course or leave the organisation and then take a legal course?
