Hi Expert,
I am bit confused about marriage certificate. In last November I got married
to a foreign citizen girl and now she is gone back to UK. We are trying to register
our marriage through corporation but they said they do not have authority
to register inter religious marriage, neither Bombay marriage act has.
I have heard about special marriage act would do, could you please provide
some information regarding the same. She is not in india right now and her
presence is required for registration? How long does it take to get the certificate?
I hope that certificate can be used for appyling visa.
Kindly explaing the process and prerequision if any.

1 have 1.7 years son ,i have filed child custody case .
My wife have file 498a/406/34
My wife wants mutual divorce
conditions are
1)She will withdraw 498a
2)I have to withdraw child custody case
3)She with give visitation right at any neutral place
4)I will never file child custody case in future
This will be written in divorce paper
My question is if i sign and got divorce , can i file
child custody case later after getting divorce ,will court
allow me for child custody case

Dear All,
I got married in Dec’2010 as per Hindu marriage act. It was arrange marriage and was held in WestBengal. At present I am in haryana.
After 14 months of marriage life , my wife get pregnent and at the 7 mounth pregnancy she went to her parent house.on june 2012 she give a healty baby(boy)birth. During this pregnancy her mother brain wash her and then she giving me so many condition for coming back.On several occation i tried to come back her but she reffused every time. he then started torturing me and my old mother and She threated for falls leagal action. she has no respect upon the elderly people of the family and she used to abuse me and my family members in filthy language without any reason.When i go with my member for coming back her then she not only abuse us and also try to do falls 498a case.Finally they cant filed 498a but She tortured me and my older mother from every corner mentally.
She dont want to leads a happy marital life with me but i always love her. then i send her a legal notice under section 9 (Restitution of conjugal rights) but she never appear in court or reply on same. It still under pending.Now she is filed sec 24 for maintenance(Rs8000+8000) her and child.
Please suggest me on below queries:
1. What will the ground that I appeal forcefully to comeback to me. 2. Can I refuse this maintenance although i had already paid all the medical expendature and also paid Rs 2000 in every month by money order.
3.What kind of evidence do I need to get back her soon?
4. Is there any law to visit my son.
5. I have a flat in my name where my parent only living. So is there any chance for my property dividation if my wife try to Divorce.
6. Can i transfer my Sec9 RCR to another court in my nearest place.

respected,
now i am dealing with hmp u/s.9. the girl appears in the court and she don't want reside with her husband. as wife is not willing to cohabit with her husband, he is also thinking about divorce.
whether a petition u/s.9 can be converted into s.13[b]? or whether i should file seperate petition u/s.13[b]? what things should be consider on behalf of wife? what things court always consioder while disposing it? what conditions can be imposed on behalf of husband? please reply. thanking you!

Hi,
This is regarding Section 9 and 24 of hindu marriage act. I went to court without lawyer and judge asked me as to why I don't want to live with my wife. I replied that as my wife has put so many wrong allegations on me i can't live with her. so judge replied that this is normal and false allegations are required to file a case, without that case cannot be filed. I was highly disappointed by this. Also judge asked me to come with lawyer on next hearing.
My Question is :
Do I have the right to fight my case my self, without lawyer, even if judge asked me to come with lawyer.
If yes, then please give respective law and section details

Hi..
The girl is not willing to marry this guy and its causing emotional havoc, as she is binded in this with her sister, cos if she does not marry that guy, her sister will also be thrown out of the house.
Please advise.

Sir, Is it that court will ask her to prove her 498a complaint as per FIR or if she does not prove what happens to her and the entire case will be dismissed and if she proves with any false evidences what happens to me.So, pls kindly give information in this regards. Thanking you sir.

Dear Friends,
wife of my freinds filed case for maitenance and notice issued to their native place but he is residing in other state.
Now court issued notice to his residential address as well as office adress.another side, court also issued notice to SP of the district where she has filed case.
My query is that, the husband is not residing in residential place because he is working whole days in office.in that case post office can return the notice without serving and office will not receive notice because he is always out of office in day time.
in such circumstances, what will be further procedure of the family court that without serving proper notice what will be next step from the part of the court. wife side is very greedy to extorty money framing all false allegations.
please advice how to enlarge the procedure of the court so that, in the mead time husband will also be granted bail.

Child custody visitation
MY wife walked out with my daughters aged 7 and 5 years old six months ago. She is staying with her parents now. They do not let me take my kids out and do not like me going there are meeting kids. Both family had talked about the situation and was given a 6 months time to see whether it will work out or not. Now they are okay as they dont need to boather about me and can do what ever they wish to. And they have not come back to discuss the situation after 6 months. I strongly believe that I have the right to spend time with them and can take them out at least on week ends. The kids also want to see me and be with me. Do I need to file a complaint for visitation rights, before she files for divorce? Or should I wait till she files a case for divorse? Please advise. Thank you.
