I am staying in Mumbai and have filed an application for Anticipatory Bail for 498a (which was false filed by my wife) in Jamshedpur court on 03rd Nov’12, Judge has given 4 dates for “Mediation” , Mediation was failed due to absence of girl (she has given silly reasons) but court has giving us dates (that we had earlier filed for HMA 9- conjugal rights), we are saying that we agree to get her back, our lawyer also states the same, but court has giving us dates only still have not given the AB, someone has told that Jamshedpur court has not giving bails in 498a or not passing any orders , they are only giving dates, again her lawyer said to court that she wants to go with her husband (for me) and needs some conversation, I agreed, she came and denies to come with me and trying to get next date for mediation, it’s all to harass me, on mediation centre, at the end of conversation her lawyer trying to get next date which is not possible to attend for me (after 10days), as I am staying in Mumbai and for bail only we have to travel from Mumbai to Jamshedpur frequently , in today’s mediation time in some talk her lawyer tried to slap me and getting physical with me, her family and neighbour’s is also trying to get physical with me, they are threatening to kill me and giving me abusive languages, mediation Judge is complaint verbally this all to CGM, now I just wanted to know that what should I do…??? Can I take any action to her lawyer or what should I do because still my AB is pending, they are harassing and trying that AB will not grant for me..
I have asked many times to u all and find appropriate suggestions from u, so I am requesting to you that please help me for this, my next date is 15th Jan’13.. please suggest me…

my divorce settlement is done by mediation cell and they have drafted a document saying both will not have any claims now or in future after this full & final settlement & will not have any claims on movable or immovable properties
& both will not interfere in each others personal or social life in future
no my question is
i asked if she can file any other case in future for claims or otherwise they say movable properties include money also and once it is done by mediation cell
both parties cannot appeal against it
is that correct ?
will it be binding on both of us and will i be safe in future and where she is restrained from filing any other case

they are closing the os case [which is running curently] mentioning that she will not press for charges BY SUBMITION OF MEMO [MAINTENANCE IN C MIS ]in lieu of the o s case settlement

Sir, my friend was working in a construction company in 2000 at the tiem of marriage, he was earning 38,000 rupees / month. after marriage he was treated with cruelty that he resigned his job in 2000 and since then he is jobless.
But he was paying maintenance 1500 ruppess per month from day one she deserted him
now after searching for job, he joined BL and is currently a final year student.
A duaghter is born in 2001, and respondent is having her own clinic and is travelling abroad for every 6 months in a year till 2006, when the court asked her to submit her passport
Kindly advice what could be the alimony payable? as she is wanting to delay the justice and hence after cross examiantion and before arguments she wants to case to be transferred to lok adalat. Please suggest and advice

Respected Sirs,
A good friend of mine who is appearing as party in person, has completed the cross examination as she has contridicted her won statements in the early petition and also her own statements in the proof affidavit. Also certain hospital documents, police station documents and High court documents were also contradicted by herself.
She has accepted that she never knew anything about the petititoner, his education or his job or his salary or nothing but agreed for marriage. Does this attract and be proved as she was forced into marriage?
She also accepted that she printed wrong names and also printed as doctor when she was not fully qualifed to be a doctor. Will her acceptance prove that she cheated the petitioner?
She also denied receiving certain documents as the same was acknowledged in her petition and part of the case was based on such letter received by her, can this be proved as her false evidence?
She claims to have gone to the police station for restitution of conjugal rights, when she received the lawyers notice. But she didnt submit the copy to prove her claim but in police station the petitioner was informed of dowry harassment for 50,000 rupees, petiitoner went to high court for anticipatory abil, can this be proved as false harassment?
She wrote a letter to the brother in law and father in law that she was happy and enjoying life with petitioner but in all her petitions she claimed that she was not happy and she was illtreated. But she agreed in court that the letter was writen to her and she was happy and enjoying life and no ill treatment was done, will this also go against her for her false allegatiomns?
She contradicted almost all the statements in her petition and answered negative with contridiction at cross examination, will these proof go against her?

My ex wife is givn application of section 25, for last alimony after getting divorce of 2year and 4months. she has not gvn any evidence during sec. 13(1)A,in family court and when she appealed to High court at that time she has not demanded for last alimony. High court also not decided last alimony. she is getting 30,000 monthly she has applied for maintainance also that was recjected by Family court. So I want to know what is the time limitation fot Last alimony.

I got married in year may,2010, The lady i got married is one of my distant relative my relation with her from day one was not good she use to irritate me all silly excuses, and one fine day i was so irritated that i raised my hands on her, and very next day i apologized to her not
only to her but also to her father and all of her family next day and still her farther came and took her, stating for apology which i did it many times.At the time of she leaving house i told her specifically that she is going at her own will, i am not going to call her back
after that many time my parents have gone to her house to call her but still she is not willing come, and she threatens me she will not divorce me and will not come to stay with me, with this social stigma i am unable to stay, now her parents are spreading rumor about me i am a drunkard i have another girl in my life and so on. After my repeated request and calling her she dosen't want to come home. In this time she has got her passport done, and her parents have kept her somewhat i don't know. we are not in talking terms since last one year.This time also her parents and she is behaving very rude with us.Several time me and my parents have tried calling her back t home still i dont have any idea she coming back.Recently in one of the family get together she denied knowing my mom. When i called her she dont pick up the call and her father say she will not take any decision regarding her life. Its them who is going to take decision about her life and she is preparing for some exams for Job etc. Even after this all has happened i think she is not interested to stay with me.
Please suggest what is to be done.

My wife give complaint in women cell. one time i try for get a copy of complaint by rti. bt he say inbestigation is not close. After i give complaint against wife & her persent. Now i wnt knw about stutas of complai nt in detail ( investigation on my complaint, on her complaint, her complaint copy ) . In which section i apply for detail of complaint. Plz give a format.

my friend submitted a mobile audio recording of his wife showing abusive language against him and his family in micro chip memory card in court.her wife denied in her cross examination that she ever talked to him on mobile and voice is not her
1 is there any voice testing lab in india and what is address of lab
2 can call detail from service provider showing that there is coversation between two on phone help this as she said they never talked on phone but she had admitted his and her mobile numbers are correct
3 any other way to prove coversation is true as she had denied in her cross exam

my ex wife divorced in 2008 in M C PETITION had obtained divorce exparte
then she filed for a original suit seeking return of some gold and silver articles given in marriage with passport and original marks sheets stating that i have retained it in my custody and i have not allowed her to take it with her when she left my home
which is still pending in court [however i have filed written statement denying the same ]
simultaneously she had filed for maintenance and court has ordered 10,000 per month and is pending for 3 years [75,000 paid to high court in a RPFC stay granted in jan 12 and now stands vacated on oct 12 ]
now they have come for a compromise
they have agreed for 7 lakhs
i am ready to pay
but they are insisting me not to use the word permanent alimony in the draft but instead put it as 3.5 lakhs arrears and 3.5 lakhs as full & final settlement
now
should i insist on term being used as "permanent alimony"
