respected members of the group,
good day.

my story is slight different.
m harassed husband but not from my wife but from my in-law and her relatives.

my story is as under in brief:

married in feb.'11
my wife left on 5th Dec.'2011, for no fault of ours. now more than one (1) year has been passed.

chances has she been a emotionally blackmailed by her parent because of certain ego issues with my parent. we did apologize for raising our voice to issues - being created by my in-laws - though we are not at fault but they are not in mood to accept it.

in this period, they circulate various type of rumors based on GOEBBELS TRUTH among members of our society to tarnish our image as well to prove the authenticity of the step they have taken.

this sunday [10-2-2013], they have come with a proposal for a mutual consent divorce. though they don't open their card yet, they do give slight ink link/idea to be ready for dire consequence if their demand/terms will not be fulfilled.

we are middle class family. in my family
1] grandpa [retired] of 84yrs , 2] my father [retired] - 61yrs,
3] my mother [housewife] - 55yrs, 4] myself [service] - 32yrs,
5] my younger brother [service] - 30yrs & 6] my youngest brother [student] - 26yrs.

me and my younger brother are only bread winner in family. my in-laws are very influential in society.

Like to know are there any legal REMEDY/SOLUTION :

1] to give pressure tactics on in-laws of my son to send back their daughrt to her
matrimonial home.

though me & my wife have no personal dispute among ourselves. but at the same time
chances are she might not be in a position to withstand continuous emotional
blackmailing further.

2] do have recording between me and my wife. like to know does it create any weight age
in rcr case ?

3] suppose they may file a suit/case under 498-a, 406, 34, crpc125 as well DV act - to
teach a lesson for not accepting their unrealistic terms/demands.

Elderly relatives told me that it is very difficult to file a case after the lapse of such a
prolonged period. so, like to know is this belief true ?

confuse what to do in this scenario ?

Will appreciate your suggestion /guidance.

p.s.: like to inform you some more details.

last dec'11, we went to my in-law home.
at that time my in-law told me they didn't mind if she wished to come. i clearly saw willingness in her eyes but unknown fear [best known to her] prevent her to come out and open to express her wish.

yes, she is jakki about what she decide but at the same time don't dare to disobey the wishes of her elders.
she told me once that she won't sign any paper unless i signed or say to sign.

may be this is one of the reason why my in-law want us to take initiative to file. for that they take every step to get instigate us.

don't know how to handle.

Legal heir certificate

Hi

Can anyone please help me to understand what is legal heir certificate? when/why is it needed? who issues it? does it relate to just immovable property or is mere certificate stating legal heirs details?

Adoption to my secound husband

my 1st husband has expired, and in between us have a son age about 6 years,and he is with my 1st in-laws last four months without any custody from court, now i want to give adoption to my secound husband without there consent
1)my 1st in-law had only son, how he lost.
2)can my son loose rights on there assets.

Harassment to my daughter

My daughter got inter caste marriage. Due to harassment, bad characters like gambling, drinking alcohol, cricket betting by son-in-law my daughter returned to my home. She is not interested to lead further life with him and interested to get divorce from him. But he is not accepting to give divorce to my daughter.

But I am not having any documental proof with me to prove his harassment, gambling, betting etc.

As a father what can I do to get divorce from my son-in-law?

Please advice me how to proceed legally.

My daughter's marriage took place on 18-08-2012 and she came back to my home on 14-12-2012.

We are not interested to get maintenance. We need only divorce.

1st in-laws ran away with my son

Four days back i went to see my son but they took him and ran away. Its been two days they are missing and their cellphones are switched off. When contacted their business place , the employees says that they are unaware of my son and in-laws. They forcibly kept my son for past 4 months and now it is unknown where they have gone.
Now what should I do and which action should i take.?

Divorce due to lazy wife

Sir,
i am employee of CRPF. My Marriage was on year 2010 without any dowry and whatever said by father-In-Law, they did not do and hided by father-In-Law that early marriage has been fixed with other and canceled before going to marriage in marriage hall(ie. after printing invitation) . Now I'm living with my family and 1 1/2 year child at Government quarters. I met lot of quarrel with angry argument,disagreement with my wife within the short span of my marriage life due to
1. laziness of my wife
2. not up keeping of house in neat & clean
3. watching TV up to 1000pm & woke up 0800am
4. not respecting & not ready to staying with my mom,dad.
5.Not washing baby urinate clothes on daily (max 6-10 clothes per day). Accumulating upto 5 -6 days. So gyms may be formed if not wash baby urinated clothes on daily basis.

I have to wake up daily 0500am for attending PT, so i have to sleep early. But my wife put TV in loud sound. Lot of times I told my nature of duty. But, she is never responding.
Hence one day I felt that myself is problem to my wife, so i tried to hang myself in quarters. But fortunately, my life has been saved by neighbors.
Now i am not speaking with my wife since last one month. Whatever she does, i simply closing my eye and not saying anything. Hence this situation if goes continuously , I thing Divorce may be better. So in this , may i get divorce ? . How to get divorce? Please give solution sir.

Divorce with mutual conscent

Me & my wife are looking to settle 498, DV cases and also filing divorce. Legal procedure to grant divorce takes at least six months. settlement amount has been finalised.

My query is, can my spouse can surprise by saying no at second hearing after six months.

In that case, what options I can have?

Please guide..

Is pauper application a part of suit?

D/Law Experts,
She moved a pauper application in the year 2002 for the exemption of court fee pertaining to a suit for the enhancement of alimony.Her pauper application was dismissed in the year 2008 and she had to pay court fee as per law.The case was decided in the year 2010 and the mntce money was increased from 4000/- to 8000/-.In the order the date of implementation was not clearly mentioned.She further made an appeal for further increase and with the demand of arrear wef 2002 ie from date of pauper application.No further increase was ordered by the appellate authority and the date of implementation was clarified as "from the date of suit".She moved an application in th court of CJM for execution by caculating her arrear from year 2002 ie from date of pauper application.The total amount calculated was about Rs. Eight Lac.The CJM ordered the deduction of Rs, 17,000/- per month from my salary to recover the aforesaid amount.Kindly clarify from which date the arrear amount should be calculated.Is pauper application considered as a part of suit?

Divorce after 2 yrs of separation

Hi,


People please guide me.

I have been separated since 2 years and the divorce case is also pending for almost 2 years.

My lawyer says that 1st the maintenance needs to be declared by the court before any decision can be made by the court on DIVORCE ?

Lawyer says that settling the issue by meeting the other party's demands is the quick thing of getting divorce.

ELSE there is wait for atleast another 2-3 years

Is this true ?

Kindly Help ...............
