I am sandeep and i am married since last four months. just after 15 days from marriage, my wife put a wrong complaint about me to her brother due to which her brother abuse me and my mother with out any reason. after that anyhow matter has been solved by our parents.. now she is getting wrong directions from her family as they want me to get separated from my family. she is very bad at house work.. and when my parents asked her to do with care or whenever they gave a proper advice , she burst in to anger and start fighting. I have made her understand so much but in vain.. she put whole my family matters to her family with wrong clauses added.
now Recently , she called her father by saying that we are going to kill her and please take me away. they came in a group and giving us threat for dowry case and take her away..but the truth is neither me nor my family even touched her physically. now she is saying that she dont want to live in my house and her family is putting wrong charges and threatning us with dowry case. they are asking for 10 lakhs rupees to avoid dowry charges...when we approached them to discuss the matter with peace they start abusing and violence giving a threat to kill me...now please advice me how i can save my family from this false case so that i can take divorce also and i also dont want to pay money..

My wife(Physiotherapist by profession, but i don't know where is she working) filed section 125,for her self and for my daughter, in Aug 2012. Court awarded maintenance of Rs 6000/- to my daughter as my salary is Rs 35000. But her maintenance was rejected, on the ground that she left me. Now once again she has filed for revision and filed false allegations against me, and also taken the help of sentimental support, as in her revision she has written "WHICH HINDU LADY WOULD LIKE TO LEAVE HER HUSBAND HOME", while she herself left me. also in her revision she given around 10 examples of law passed in the favor of lady. Also she now saying my salary is spend on taking liquor but in my life i have never taken alcohal. Also she mentioned that my 35000/- is in hand salary, while i have never said that my in hand salary is 35000/- i simply told that my salary is 35000.
Dear Sir, i wants to know that which cases were rejected for maintenance to wife on the ground that she herself left me. and from where i can get the details of those cases so that i can also show those cases to judge. Please guide me , help me. As my wife has filed for revision and its date is 23rd April and it is very important date of my life. I am under stress about the future happening !!

If the wife does not have a place of residence can she fight the case from her husband's place or is it possible that the husband can take actions against it?

Married under SMA in 2007 which was not known to parents but did not stay together until the religious ceremony took place in 2008, which was also registered later, by bride's father.
After marriage, husband's attitude became verbally and mentally tortuous and abusive and total cohabitation in the last 5.5 years of married life has only been around 1.5 years.
There have been long periods where wife has refused to maintain contact with husband because of his ways and attitude. He repents after a while and apologises profusely only to return to his abusive ways later.
1. Do we need to mention the second registration when filing for divorce under MCD?
2. Where should the petition be filed? Both have not stayed together for long at any place as husband is in a transferable employment and are no longer residing where they last cohabited together.
3. What happens if the husband refuses to sign the MCD? Can wife file for contested divorce or does her case weaken because she tried for MCD first?

Hi experts ,
Me and husband have been living separately for the past 3+ years due to incompatibility issues. he was extremely narcissistic and i decided to move out as it was harming me and my child. He wanted divorce and I agreed for mutual divorce and told him that i dont want any alimony / maintenance for me or my child , but i wanted get complete custody of the child . he agreed to this ( as he has anyways not made any attempts to meet my child during the separation period ) .
He has however gone ahead and filed a case for divorce due to desertion / cruelty.
I am not able to figure out the intention of this application when i have already agreed for mutual divorce.
What could be the intention ? Will it give him any additional advantage?
What i should i be doing next to protect myself and my child ? ( i have already contacted a lawyer and he advised me to goto the court on the hearing date ).
I am not interested in filing any unwanted cases against my husband as I want to end this in a dignified manner and want to keep it as straight as possible.

Hi All,
My Case is going on in the court more than 6 months.My Wife has filed DVC against me, then their was a Mediation happened for which I did not go deliberately as per my lawyer and also I do not need her.So Mediation has got failed few days back
Now, few days back I received another notice from Court regarding "restitution of conjugal rights". I have been some of te websites it says wife can stay with me. So,does it mean Court won`t listen to Me at All.She herself left House.
How can we prevent this? Can their is any law/judgement made on this type of case, if so please let me know.

I have applied for divorce on the basis of desertion and cruelty in the year of 2012 August in my native place(Tamil nadu) where we got married.
My wife is working in Bangalore with my 9 years old son. I am in Chennai.
She had filed 2 FIRs and complaint in a woman's police station Bangalore and she withdrew those 2 FIRs.
When we were living in Bangalore, She threw me and my mother(mother was temporarily staying to convenience us) out of the house by filing a case "threatening to her life" in the the year of 2010(my mother went to my home town) and i changed my job to Chennai.
I didn't have FIR copy for this case.
The court sent 3 notice to her house address Bangalore. She didn't accept is and notice returned back to court saying that no such address found.
Then we sent it to her office address in Bangalore. she received it.
Till now she hasn't filed counter petition in the court.
Also my lawyer is saying due to summer vacation the court has posted my HMOP giving her a last chance to file counter in July 2013.
It is going to take almost an year( I field in 2012 August and she is expected to file counter on in 2013 July) by that time my case actually starts.
Is my case on wright track ?. is my layer doing anything wrong ?
Meanwhile my wife contacted one of my relative saying that she is not ready for divorce.
We sent notice to my wife's office address. Is it enough to prove that my wife is working?.
If not how can i prove that she is working?
What else i should do to make it fast?
Here lawyer appeared in the court after my wife received the notice.
My lawyer is saying court will give them 3 chances to file the counter.
During the first 2 hearing/chances they didn't file counter.
But Due to summer vacation the third hearing is adjourned/postponed for three months. That means the court has given them 150 days to file counter.
is everything on wright path ?
or do i need to ask my lawyer to take some action?

Hma section 9 & crpc 125
Respected Experts,
I am a victim of 498A, DP 3/4 . my wife is at her home from last 1 year and i filled section 9 on 4 april 2012 and my wife and her parents file FIR against me and my parent on august 2012 now the case in noida court. she mention in her crpc 125 that i filed HMA section 9 but she is not attending section 9 court dates.
she also give a written paper in mediation court that she doesn't want to live with me.
she want 15000/- per month from me. please help me what should i do ?
