My cases are pending in court from 2011 of maintenance and divorce in 2012. My husband never attend the dates he appear on feb and filed the W/s that he has already taken exparty divorce without divorce papers after that he not appear till date I come to know that he has got second marriage and have a baby boy. Now the only option for me is to get the divorce from him but he is not filing the papers and not appear the date as it is too late for me I was already not aware about this exparty and when he wrote this in his W/s but not enclosed the paper I am waiting the time but got date every time after 2-3 months later now i got next date of Oct 2013. I m not sure he will appear on that date or not. I have filed my antrim papaers so that I can get expenses to restore the case of exparty divorce.
Suggest me what shoud I do in this 2 months so that on my next date of oct he can not avoid.

Can the wife file a suit under Section 18(2) of H.A.M.A when a prior divorce appeal is pending in High court which is governed by Hindu Marraiage act 1956. The wife is already getting maintenance pendentlite us/24
Can the H.A.M.A Case be filed by the wife in her native place far away from the place of marraige or from the last matriomonial house where husband & wife resided. Is there any limitation for Jurisdiction of such cases if the wife files such case far away from the last place resided in her husbands home.
Can two suits be heard seperately but simultaneously one under H.A.M.a section 18 2 & one hunder Hindu Marraiage act under Sec 24 / sec 25.

Respected Experts , My husband has filed Hma13 From x city where as my last residing with my husband was arround 12 months in y city . In x city we stayed on rent for about 18 months . As on date also my husband is residing at y city along with his mother. After knowing that my husband has filed HMA13 I filed my application in HC to transfer the case in my current residing city (I m living at my parents ) on the ground of no income source and recently I have given the birth to my second male child. Now my advocate inform me that from last 4 months notice is not served to my husband by HC with reason adress is not correct. I know that my husband and his family has given the wrong adress of x city to harrase me. Now my query is can I request to HC to dismiss the suit due wrong adress is used to make the juridiction of x city to file the suit of HMA 13?

My friend who is basically belongs to southern part of Tamilnadu working in a software company at Bangalore. Since his very first day of his marriage, his wife deprived him for sex. This matter was first brought to her mother then after to her father. But the girl agreed to her parent by not allowing her husband. When this is become an issue in their community (caste) circle, the girl family file a dowry case in the police station against my friend, his parents and his father’s brother and father’s brother’s daughter. My friend’s father arranging an advocate to bail-out his family. But the advocate negotiates to the girl’s family and arrived at an arbitrary amount of Rs.800000/- that supposed to give my friend’s family to come out of this situation and bailout the family. My friend’s family ready to pay the amount but it should be done through the court with proper accountability. Can anybody suggest the possibility of involvement of court in this matter apart from advocates and police.

Respected Experts/Members,
My petition u/s 13 1(a) & 13 1(b) has been honoured with the decree of divorce. subsequently my ex husband has challenged the same in High court and appeal is filed before the Registrar, High Court.
Please suggest me if I can ask for permanent alimony and/or compensation during proceeding of the appeal in High Court for the loss of service besides of many other non monetary losses because of extended litigation as well as disturbance and nuisance created by my husband at my workplace.
In that appeal, judgement of one case is cited wherein the wife has been granted permanent alimony even without asking for it.
It would be relevant to mention here that my petition u/s 125 has been dismissed in lower court for non prosecution.
Please suggest that would it be worth to restore the case u/s 125 or should I pursue for the permanent alimony during an appeal by my ex-husband.

Hello I am 27 years old software professional working in chandigarh. I am belonging from Saharanpur Uttar Pradesh. I got married on 20 June 2013 by a girl whose age is 20 years according to which her parents told me without dowry. On first night my wife said me on bed that her age is below 18 and her parents put pressure on her to do marriage and she is not ready for sex. My wife belong from village she is only 8 pass out. Her behavior against me is so bad after marriage. On 30 June 2013 me and my wife go to one village to attend the marriage of her cousin, there is some quarrel and dispute arises me and my wife , i leave the party and my wife & return back to my home alone. My wife directly return back to her parents home . My wife also take my 6 tolas jwellery and Rs 50000 cash to her parents home. After 2-3 days i go to my in laws home where all her family members and my wife behaved me very badly and strong armed me and said she did not go my home and did not return anything to me. I give an application of the above circumstances in my police station and police did not help me. I also had a copy of an application stamped by the police station. On 12 July 2013 i again go to my in laws home to return my wife and again all of them behaved me very badly and physically and mentally harassed me.On the same day my in laws call panchayat of there village and put pressure on me to give divorcee to signed on the 10 Rs stamp paper wilynily .I signed the paper under pressure. On the next day i make a suicidal attempt to finish my life and hopitilise for 2 days because all of the above scenario very much harassed me physically and mentally.
I am not able to understand what can i do to return my wife and my jewelry and cash . I love my wife very much but my wife does not understand my emotions ,feelings and love and she is not ready to leave her parents home.I am deeply desperate because all of the above scenario happens only in one month of my matrimonial life and all of the laws are in the favor of woman.Please please please help me...............................

what is the limit of alimony in etah district of u.p. and i had divorce, my wifes charges of impotency and misbehave for dowry were proved false by the kanpur court and on merit court gave me the divorce decree as the girl refused to come back.is she entitled for maintainence.

RESPECTED MEMBERS,
I AM AKHALAQUE AHMED FROM NAGPUR.I NEED YOUR ADVICE FOR THE BELOW MATTER.
MY WIFE SAID IN AFIDAVIT THAT SHE IS SIMPLE HOUSE WIFE AND WHOLLY DEPENDS ON THE MERCY OF HER PARENTS. HER QUALIFICATION IS MA(URDU LIT.) AND B.ED.THEREFORE ORDERED ME TO PAY A INTRIEM MAINTANCE IN 125 SECTION RS 2000 PER MONTH. SHE DID NOT PROOF MY SALARY.
AFTER ORDER I GOT TO KNOW THAT THAT MY WIFE WROKING IN A SCHOOL, I HAVE ENQUIRED ABOUT HER SERVICE IN THAT SCHOOL BUT SCHOOL IS NOT COOPERATING WITH ME ABOUT HER SERVICE..
SO PLEASE TELL ME HOW CAN I EXTRACT INFORMATION ABOUT MY WIFE SERVICE FROM THAT SCHOOL.
PLEASE GIVE ME YOUR WARM ADVICE SO THAT I CAN PROOF IN COURT THAT SHE IS EMPLOYED IN A SCHOOL.
