Personal Advice

Respected Experts,
An educated (engineering graduate) is suffering from major depression. Now he is unemployed. As per the law (HMA) he cannot marry, cannot get job (either govt. or private), and cannot do business (since it requires signing of contract). He is capable but sometimes due to illness, he fails to perform. As per the medical experts of NIMHANS Bangalore and AIIMS Delhi, his condition will improve if he gets married, and gets a job. Since support system is very essential, otherwise such people are prone to commit suicides. So, in this situation what can be done? Also the psychiatric medicines are very costly, which a general person cannot afford. Since such persons are generally be dependent on their guardian, so is high prices of medicines are fair? Should govt. act if we complain, or PIL is the remedy? Will he get govt. job as per his qualification, where to approach?
If some clarification remains how to clarify?

family court section 26

sir,
i am an nri,my wife filed a case 498a against my whole family because she cannt adjust with me.her father didnt even call my parents yat insted they filed 498a.my wife send letter to my company saying that i tortured here and she wants my salary as she is not having any incomeas she is a bsc nurse.now she filed a case in family court for getting her shreethan as i didnt even ask her shrethan,though her family gave her 26 soverens of gold that she took back and kept in her home within 4 days.now she is claming that she gave 3 lakhs cash to my parents and 50000cash to me in hand and 36 soverens of gold to me.i hired one lawyer,he is telling that normally judgements will be in favour of wife side only but we can fight.and also saying that they will not check out for proper evedence .in what way i should fight that as i am not in india.since here is financial cricisis,company will not give leave for atleast one year.i dont know what to do becuse the money they claim is fake .what should i do .

Muslim Divorce -- HELP please

Dear Sirs/Madams,


I am currently residing in Dubai and wife is in Kerala.

We both are muslims and got married in Kerala (Peringadi, Kannur District), under normal/common/no-special agreement conditions/law.

Going for a divorce, I need your help regarding several things as follows:

1. Please inform the complete step by step divorce procedure, included terms and conditions, that I have to do/prepare.

2. I found a news saying that 3 times talaaq does not automatically divorce the wife anymore. Is this true?

3. If the above point is not true, do I have to present a reason for the talaaq? What kind of reasons are acceptable by law?

4. Will I be able to conduct the divorce process without being in Kerala?

5. How will the amount of "compensation after divorce" be decided? based on what issues?

Below some facts that might help to describe my issue better:
- We have one kid.
- Last time together was last year, during my annual vacation from Dubai
- We have never really lived together, it has been always long distance, and we cannot communicate well, we fight, we don't communicate in any way for months, she demands perks and money I can't afford, she is simply a huge burden. And I never loved her.

- Wife is not willing for a joint petition for divorce.

Sir, mere dost ki shaadi 05/06/2006 ko kanpur(up)me hui thi. shaadi ke kuchh din se vivad chaalu ho gaya aaye din mayke chali jaana. jabki mere dost ke bade bhai aur bhaabhi alag rahate hai,mother kishi ke paas nahi rahati he father expired ho gaye hai, bahano ki shaadi ho gai hai koi matlab nahi rakhate hai,makan mother ka hai.wife 14/07/09 ke pahale se apane mayke kanpur me rahi. achanak 14/07/09 ko jbp aai aur bade bhai ke ghar ke kamare me ghus karke vivaad karne lagi aur tamasha karne lagi, dhamki dene lagi mera makan he bhabhi se vivaad karne lagi.ghar se chali gai aur rishtedaaro ke yaha rahi. maine dost ne 14/07/09 ko thane me aur parivaar paramarsh kendra jbp me complaint kar di, par vo parivaar kendra me jaane taiyaar nahi hui, 4-5 din tak tamasha karti rahi. bahut hi mushikil se 19/07/09 ko res.karwa kar rishedaaro ke madhayam se kanpur chali gai. mere dost ne yaha jbp me 22/07/09 ko divorce ka mukadama dayar kar diya, 23/07/09 ko notice gaya,27/07/09 regd notice refused kar di normal notice rakh lee. uske baad ultimatily family court ne 21/10/09 ko ex party divorce kar diya. Mere dost ne kanpur me rishedaaro ke madhaym se jaankaari li to pata chala hai ki kanpur ke thaane me 498a ke tahat 1/08/09 ko report kar di hai vivechana me hai. aapse nivedan hai ki aap uchit salah de aur agrim jamanat ke liye kya karana hoga. aap jaldi salah de ki aage koi pareshaani na ho.

DIVORCE OR SEPARATION

I am 45yrs separated by wife for last 5 yrs with children in her custody. Reasons best known to her. My query:- can i ask for divorce or legal separation. What is difference between divorce and separation and what are the related issues.If there is something like legal separation then can i remarry or not. Please advise.

Hindu Succession Act

Dear Sir,

A father ( r/o Haryana) inherited Agriculture Land from his father. He has 2 sons & 2 daughters. Please clarify the following--
a. Is a Will in favour of only one son (depriving the second son from his share), legally alright under Hindu Succession Act ?
b. Can the married dauthers or their descendants ( i.e. sons & daughters) also demand share in this inherited Agriculture land ?

Please quote the relevent sec of Hindu Succession Act where applicable.
Also kindly quote relevent judgements of High COurt / Supreme Court where applicable.

Proof of income and assets

If a mother claims for maintenance from her expatriate son declaring that she has no income,how can son prove that mother has assets and income?Everyone hides his or her own income.Can son pray for an inquiry or assessment by income tax authority to determine the actual and/or declared assets of his parents?If father states on email that he has certain amount of assets, can this email be considered by maintenance tribunal as sufficient proof of parents income?What criteria is adopted by maintenance tribunal to ascertain claims of insolvency by parents?Can the maintenance tribunal ask petitioner to prove his/her insolvency?
