Will and Partition

Sir,

If the will does not indicate proper thumb impression of the testor and only partial thumb impression is there with slightly invisibility on the edge and there is no thumb impression at the end of the Will comprising two pages, out of two witnesses one witness is not existing and other witness is interested party in the Will. Further if the legal heirs are left out completely out of the Will and will does not mention how the property is acquired ?

Can the will be held valid ?
Can it be a ground for suspicious circumstances ?

There are only two legal heirs viz. Son and daugter and Mother expired intestate and daughter holding the Will. Can the legal heirs claim the property on declaring null and void on above grounds.

Please advice on the above.

I have marriage on 2005, this was arranged marriage. My father-in-law is very rich man, and my wife is his only child. After marriage, he always forced me to do this to do that. I never opposed him. My father-in-law and my wife then started new demand. Demand is, I have to stay in my father-in-law’s hose. This was first time I opposed them. As a result, on 2007 my wife left my house. So many times I went to father-in-law’s house to return my wife, but she never come. I told them it is never possible to stay their house because of my parent. They both are aged, except me nobody is there in my house who will take care.
But she didn’t care my problem. Since 2.9 years, see never receive my phone, I can’t even contact with her. Her father told me she does want to meet with you and she will never marriage again and she does not divorce you.

Now please tell what to do?? I am 35 years old. If I go for divorce file, the how much time it will take?

Sir,

At present I have appealed to the High Court for partition against a forged and fabricated will. If the order is against me can I ask for revision of my petition or I shall have to approach Supreme Court. Is there any relief for such an order against me.

Please advise me.

hi please help me. i got divorce in december 7 th 2007 as exparte(my ex husband did not attend the court). then i legaly married a person on september 11th 2008. he is also a divorcee who got his divorce through ex parte(his wife didnot appear in the court) on july 29th 2008. now i came to know through some of my friends that my second marriage will not be valid because it is done within 90 days. please help me

Sir, I Got Ex-parte Order in Section 9 of HMA and I had Filed Execution Petition in the Same Court but My Husband Doesn't Obey the Court Order as he does not have Job nor does he has any Assets and he is even ready for Imprisonment what is the Remedy?

Marriage has been solomnized between hindu girl and catholic boy according to hindu customs & rituals. Therafter it is registred under Hindu Marriage Act. There is male issue out of said marriage. Now they wish to divorce each other. What remedy, which act, status of issue????
