domestic violence case...plz help

hi ...i want to share one of my personal experience....my sister got married last year in mumbai (with sufficient dowry) and now she is facing problems like dowry and violence....she had attempted sucide once...we have once approached police also but they settled the case but its again the same story....we have following charges against them:
(1) father in law has a bad eye and boy ahs admitted that.
(2) they are abusing about dowry like asking for more indirectly.
(3) bad words and getting physical every now and then.
now its tooo much and i cant leave my sister to die there(as she is also wanted to get divorced)...so kindly suggest me how to go about this case and what would be my strategy and tell me other loopholes of this case.... please guide me in this issue or give your details so that i can contact for consultancy.....please help

If the father had created the HUF firm along with his sons with the name of (M/S some one else name)does the son has the right to partition in the fathers HUF properties which he formed with some one else name and sign himself as a karta of that HUF

Ailmony amount

Hello experts,

Kindly share your thoughts on the following.

My friend is married and has a kid. After 1 year of marriage,his wife had an verbal argument with her in laws and neither visited her in laws place nor the husband's place after that.She was very adamant and was firm in her decision and didn't visited till date (almost 4 years after marriage). The mutual discussion to convice her also didn't help. Now his wife has moved to the local women's police station and lodged a complaint under the pretext that her husband is not accepting her. Few days back, my frieds parents received a notice from the local police station to appear before them. It appears that she is more interested in the ailmony amount. My friend has lost his job in the global meltdown time and still is searching for a job for the last 4 months.

Kindly let us know the possible ways out how to avoid this.

His wife is a post graduate and capable of working.

My friend's parents are very old and it is difficult on their part to go through the legal and court formalities and they are financially not sound. They don't want a divorce but the girl's parents are very much after the ailmony amount.

Kindly share your thoughts.

Maintenance Case

My client Petitioner filed a M.C in the 1982 against her husband and she has been getting maintenance from 1982 enhancement petitions filed allowed and going on.. But the Respondent will retire from the service who is a Govt. servant in Road & Buildings Department (Attender)in the month of September, 2010. Can the Petitioner attach the gratuity, Provident Fund and other benefits of Respondent? If yes, is there any case laws reguarding this case. Please kindly suggest me case laws and how should we attach the respondent benefits. The petitioner is very poor old woman.

Interim maintenance

My sister filed restitution of conjugal right petition. Her husband filed null and void petition.Now she needs to file maintenance petition.Husband is having income from rented house.But houses are in his parents name.Husband is also working.but we have no idea about his office address.What is the remedy for her to file a maintenance petition?

MY Wife went her mothers house and since last 1 yr she has refused to come as a result she has applied for dissolution of Muslim marriage act and she has mentioned all false allegations on me.

MY QUESTION IS WHETHER CAN THE CASE BE TRANSFERRED TO MUMBAI TO CONTEST AS THE ALLEGATIONS WHICH SHE FALSELY CLAIMED MUST BE CLARIFIED ONLY AT MUMBAI BECAUSE AS PER HER ALLEGATIONS THE WITNESSES WILL ONLY BE AVAILABLE IN MUMBAI ONLY IN FORM OF NEIGHBOURS

Attending the dates

Hi,

My wife has filed a divorce case in lucknow in dec 2009 and same time she filed crpc 125 maintainence i have already attended my first date of maintainence case on 8th feb after that a date was fixed on 18th march for divorce case i could not attend the same and again the date was given on 21st may 2010

My question is

1) Both the cases can be linked with each other and 1 date is issued as my maintanance next date is in august 2010.

2) How many initial dates can be skipped.
