i am a govt employee(teacher).my wife deserted me one year ago for a seperate family for the cause of she dont want to take care of my 68 year old father.i gone for conjugal rights notice.after that she put a 498a case against me and my father.
1)is there the departmental permission need to arrest me?under what code?
2)rcr notice not enough to did not arrest me?i am ready for trial.

In case there is a joint party between husband and wife and the wife doesnot appear in court inspite of summons does teh husband get ex-parte divorce decree? In that case what does the court decide about the joint property?

My friend got married two years back and she was forced to leave the house after 8 month of marriage, she had registered an NC wit the police station on the same day ( she wanted the relation to go on thats why she did not go for 498 A).Year later her husband had sent a notice and had applied for divorce. She then had approached the police station and had given a written application , the police officer is not ready to register an FIR. He has told her he wil send her written complaint it to the Goverment lawyer to seek approval. Can a FIR be registered after the case is filed in the court.

My client Petitioner filed a M.C in the 1982 against her husband and she has been getting maintenance from 1982 enhancement petitions filed allowed and going on.. But the Respondent will retire from the service who is a Govt. servant in Road & Buildings Department (Attender)in the month of September, 2010. Can the Petitioner attach the gratuity, Provident Fund and other benefits of Respondent? If yes, is there any case laws reguarding this case. Please kindly suggest me case laws and how should we attach the respondent benefits. The petitioner is very poor old woman.

Is there any order from Supreme court of India or other body wherein 498a cannot be attracted to be booked after 10 years of marriage?

My sister in law committed suicide along with her 8 moth old girl baby in her personal bathroom. Her family has FALSELY accused us of the dowry allegations and murder. Henceforth my parents and my brother are in police custody fot the past one month. We are clueless about her move and are in deep shock. Our lawyer has filed a bail suit. Please suggest what is the approximate time duration within which we can get a bail and also let me know how to fight back against the false allegations.

I need a legal advice , About two years back my wife along with our daughter left my house and went to her fathers house in Mumbai,And she has not come back after that ,
After 3 months they changed there house in Mumbai and did not inform me about their new address , They changed there mobile no's also , Now I am not aware about their whereabouts nor I have any contacts about them.
I have written three e-mails to them but they have not replied , Their relatives are also not giving me any information about their address
I want to get divorce from her ,What should i do , I don't know where should I sent her the notice and Summon
Pls advice on such issue

my grand mother is living with my uncle. from the past 2months she is not feeling well and she is not able to move. but my aunt is not at all seeing my grand mother and not evening giving proper food to her. near to her house there is our family friend and she told to my mother and her sisters that if we bring my grand mother to her house then she will look after her and give the proper medical attention regularly.
when we discussed this with my aunt she told that if we take our grand mother to our family friend house then she will keep a case under sec 498A. but there is no situation happened to file a case u/s 498A.
as result my grand mother is suffering as my aunt is not looking after her. even she is not giving proper food. and we are unable to keep her in our family friend's house also.
now please tell us what we have to do. what step we have to take.

Husband & Wife living separate since 2004 during which a child was born, in the year 2006 wife filed a 498A case against husband still pending, later they filed a case for maintenance u/s 125 Crpc, in which no SS was served on us,,, now in the year 2009 the wife filed a Crl Misc case under Sec-12 of DV Act, surprisingly she made the parents of her husband to this case. now i want know,,, whether the DV Act applicable to this case as the wife & husband living separate since 2004 and the Act came into force in the year 2005... and can your goodself help me by giving some latest citations favouring the Respondent husband..... I ll be greatful to them who helps me since its my first case in DV Act.... Thanking you....

My friends mother has registered a will giving her house and vacant piece of land to her and her sister and leaving out her son (maaried and living in USA) on the gronds that he has not beeing supporting the family in India. Two daughters are unmarried. The property was built by the mother's earnings.
Now the brother is forcing the mother to give him also a share of land or bldg. Is it better to get the property registered in the name of daughters as gift from mother to avoid any further complications later on? Can the will be challenged by the son?
