Hello Sir,
My wife has filed a false 498A case against me any my parents. I want to know which court has the rights to dismiss or dispose the case if the relevant evidences provided by me. Hearing is yet to be started in civil court.

In case there is no will ,legally who will be the Legal heir, the Wife, the children and can grandchildrens will be the part of it as well?

Respected sir,
I have filed a DP3 against my in-laws and the hon'ble MM sahib took into the cognizance and pass the direction to SHO to register the FIR. Now more than 8 months passed and investigation has been completed but challan has not been forwarded in court. From last weak onward IO is telling that he is buseay in preparing the arrest memo and but today she told that she will be filling the challan tommorow for APP's approval without arrest and she will take the permisssion for arrest lateron. I had a doubt that he has join the hands with their lawyer.
Kindly rquest adivce that in case he is filling the challan without arrest at this stage , it seems that it will weak my case, is it. Please suggest me what is to be done now.

Due to continuous DV by husband & mother in law, my sister (with 2 yr baby) came to our home after informing Local Police & panchayet at matrimonial place. 3 months have passed and she has not taken any legal action against them thinking about a last chance of improvement by discussion between both parties.In this period there was no contact from her matrimonial family. Now we are hearing rumor that the man has married again in his workplace.We dont have strong proof regarding that...Now should we wait for any compromise as decided earlier or initiate legal action? In case of bigamy what kind of proofs are needed by the court from our side regarding the 2nd marriage?

Sir,
I filed partition suit and court decreed order in my favour. I got 2/3rd share in the property. During the pendency of suit the respondents constructed 2 storyed RCC house on the 2/3rd share property. They have constructed house on my share of the property. At that time I obtained status quo order from the court "not to alter the nature of the suit schedule property" still they have constructed the house. The respondents have not filed any counter nor they explained to the court the reasons for construction. After this the suit came for final hearing. The house constructed on my share of property is unauthorised without any Municipal permission.
On partition of the land whether I have to forego my share because of respondent constructed the house? Is it not a contempt of court order. What are the options left to me to reclaim my share during the partition. Whether I can claim mesne profits and when I should file the mesne profit petition. After partition of the suit schedule property whether they will have right to sell the property without paying mesne profits to me.
Since I am decree holder now I am filing for the final decree for partition in the court
Kindly adivse me. I will be grateful for the advise.
