My father died 8 months back without a will.Iam residing in a flat in a co-op.society in Mumbai along with my mother,wife and my son since my father purchased the flat in his name in 1973.I have a married sister.As only my mother was nominated by my late father in the nomination form,the share certificate now stands in my mothers name.Now, my sister is demanding 50% share of the flat by adding her nomination as 50% and mine as 50%.My sister also suggested to me that I should now pay her 30 Lac(current market price of the flat is 60Lac)and for thaat she will give in writing that she will forego her future claim for the flat. The fixed deposits are in my mothers name with some having my sister as nominee.My sister says that either She should be given equal(1/2)share in nomination form or I should now give her 1/2 price of the flat.She is willing to give in writing that later on(After my mother)she will have no claim on the flat.I have got following questions.
1.As I along with my wife are staying in the flat for the last 35 years what legal rights have I as a son regarding the flat.
2.Can my mother give the total nomination to my sister or can she bequeathe the flat to her through the will?In that case where will I stand?How much Iam entitled legally?If the mother is giving her share to my sister,I stand to get less than my sister.Is it not travesty of justice?Is the Hindu Law an Ass?As my mother is against me and totally partial towards my sister,how will I get equal treatment?
3.regarding fixed deposits in banks,what rights I have over it?All the FDs are in my mothers name with mine and my sisters name as nominees in separate FDs.
4.what about the jewellery owned by my mother?
Please advise me urgently regarding the above problems.How I should go about it.Iam confused.

A friend of mine has been deserted by her husband and she has filed RCR & Domestic violence case. order for interim maintenance has been passed in both cases but her husband has not paid single paisa order was passed in 2008.How to get the orders executed?
Her advocates will be influenced by her opponent advocate for the same reason she had to change her lawyer for 4 times in three years now again she have to change as they are not helping her in anyways.so will it effect her case? so please advice me for the same.

Is there any order or rule under CPC by which ask for not to continue the proceeding till he pays the maintanance,after the order has been passed which enforces the husband to pay the maintenance

My sister has taken a flat before marriage ... in her name.
there was verbal confirmation from my sister that in case her marriage ..happens he will transfer this flat. in my name.
she has taken loan from bank against this house but I paid all the instatement on his behalf.
now she wants to transfer this flat in my name.
but his husband objecting it. & threating not to transfer in my name.
pl help how to proceed. against the same

I was married on 19th Jan 2008, from April 2009 we are living separate due to small family day to day issues. I tried to my level best to settle my family once again. But she is not ready to come back. Her father is saying as she is not ready to return, he wants us to start a divorce proceeding.
Please suggest in what way and how to proceed in this regard. I also wants that I should not pay anything to their family since all the marriage expenditure done by us. They just returned back half of that amount. She is also working and earning around 15K.
Please suggest how to go about this case and where to file this case.

Hi,
I need assistance in divorce case in mumbai. Can anyone help me.
I have already appointed a lawyer from mumbai but somehow i am not confident of that lawyer.
My husband lawyer is very smart and he has filed for RCR, even though he doesnt want me back neither i wanna go back.
He has started collecting evidence against me to prove that i am adultress.

I know other lawyers dont take case of other lawyers but if will be glad if anyone can provide me consultancy to get divorce from my husband and the child (6 years and 5 months)custody

hi,
i have got divorce and 6 yrs old child stays with me , the mother. He has got visiting rights but child does not want to meet or talk to him as he is of bad nature and behaviour. Child has seen all torture faced by me when staying together and hence not happy to meet him. Now i have got married and we both are staying with happily.
But my ex husband is trying to follow us by giving blank calls, sending messages and presurising me by saying that he will come to my new house to meet the child.
I and my child are very happy with our life and do not want his interference in our life. What should i do? I am really fed up now. Pls help.

My DOB is 29.03.1954.From the very day of my birth I was handed over to elder brother of my father and I was adopted.No documents were made.In all my educational certificate,Voter ID,DL,PAN card my adopted father's name has been mentioned.Both of my adopted father & adopted mther have died.Am I not entitled for his share of land in the joint property,Our is a Hindu family and I have done all hindu rituals for death of adopted father & mother.my original father is alive but his name has not been incorporated in any of my document.
