Dear sir,
I have sent a legal notice to my wife stating that to return back to the matrimonial home 0n 5-10-2010,before filing RCR, but still we have not received any reply, i requested my advocate to call my wife and ask for whether they are willing to come for compromise but they straight away said Divorce
Now i have filed RCR , whether they apply divorce or should they reply for my RCR and then they proceed for divorce,
please advice me what to do

At the outset, apologies for the detailed msg but would like to provide complete details before asking for suggestions.
We are an joint family (me, father, mother, brother, sister-in-law & my wife). There were some fire accidents at our home in Apr'10. Reason for the fire accident is unknown. Some of our household articles (mainly clothes, bed spreads) went on fire. The police and the fire department were informed and they werent able to identify the reason for the fire.
Since my wife was in a kind of shock, her parents came and took her to their place. We were planning to go to Tirupathi after a week and hence we requested them to bring her to Tirupathi and we were planning to bring her back to our house.
We werent able to go to Tirupathi, as planned, during that weekend and was pushed to the subsequent week. Hence went to her place and asked her to come with us. Since the Tirupathi plan was pushed by a week, they informed us that they would like keep their daughther for one more week and send her with us from Tirupathi and we were also fine.
We went to Tirupathi and things changed there. They started complaining that we asked for more sreedhan and was giving their daughter 2nd degeree treatment. We tried our best to make them understand is that there was never such intentions and its more imagination on their daughter's. They werent in a mood to agree which resulted in a quarell and they took back their daugther to their place. We came back to our house.
Few days later, her father sent a letter stating that marriage happened on such and such date...fire accidents happened..but no action was taken from our side..we ill-treated their daugher because the streedhan they gave was less..etc etc
We responded to each and every point mentionted in the letter denying the allegations & assumptions and providing the actual infomration.
Her father sent a letter apologising for any mistakes they might have committed and asked us to provide a date when they come to come to have a discussion and iron out any misunderstandings
We informed a date. They came on the date along with the person who help us get this alliance (he is their close relative and our distant relative). But within 5 mins of the discussions, they started shouting that their daughter wont be happy at our house anymore and started pulling her Mangal Sutra from her neck..it was almost removed. My uncle intervened and said that he will not allow such things to happen at our house and questioned them on the intentions of they coming to our house..they werent ready to listen to anything..shouted at the top of their voices and left the palce..
After this one of their relatives had a meeting with me and my wife alone. She didnt show any signs of rejoinig but started complaining about petty things (such as i forgot to buy her a fruit..i gifted a dog doll on her birthday with the intention that she should lick my legs and waive her tail all through her life etc)..and the meeting didnt yeild any positive results.
This relative, using his influence, gave an false oral complaint to the police that i had an illegal relationship, that too in a police station that is outside the jurisdiction of our house. Police came in search of me and since i wasnt there at my house, took my father for an enquiry. My uncle then got the services of an lawyer who went to the police station and asked for the complaint. The police werent able to provide. They approached senior offices and got my father out from the clutches of the ploice but all of us had to go through an huge amount of mental pressure for 6-7 hrs.
We filed an RCR and is now set for hearing on 04-Jan-2011
Recently they came to our house to take back all items provided during marriage. they were silent until the time all their items got loaded to the truck. once done they started shouting, abusing us in bad words, throwing stones and mud on our house etc. The entire neighbourhood watched this and are ready to testify, if required.
Our entire family is totally hurt because of these incidents and dont see any point in continuing this relationship. Can anyone pls sugest if i can file a divorce and if so under what grounds pls

Hi,
I have applied for divorce under cruelty & mental torture (& affairs with other ladies)..
My husband has appeared for the 1st hearing & did not appear for subsequent 3 hearings (meant for counselling)
Can I request for exparte divorce? Can I do it individually or only my advocate can do it? What are the procedures for getting exparte divorce?

Dear Experts,
Would be grateful to have your response.
Am going through a divorce case in the family court. For the last hearing by mistake I went to another room rather than principal family court and kept on sitting there in the wait that my name would come. My advocate came very late and then only I knew I was in the wrong room. By the time I went to the right place, we were told my name was called BUT i Was not there and since my advocate also was late he could not represent me either. My husband also did not turn up but his advocate was there.The court has given another date for hearing after a month.
Do you think it would have adverse impact on my case? I think we did not let the judge know that there was a confusion and I was there all the time but in the wrong room.
Please let me know as I am a bit tensed up over it.

Questions from Husbands side---
1) Is application /case, under DV Act, is filed through a Court or directly to concerned Police station/women cell by the estranged wife?
2) Victim husband and family got summon from the SHO,Police.
3) What is the proper channel by which DV act,is applied?
4) wife filed false case /misuse of DV act,to hide her illegal relationship with ex- colleague. ( Can victims family be harrased/ arrested by protection officer/SHO).
How the harassment prevented.
Everyone says that women cell always support girls even if she is wrong.
I urge the experts to give their opinion and How to save victim husband and family from this misuse of DV act by estranged wife.

Sir,
I am serving in Army as an officer and am about to retire with pension.
We are one brother & two sisters.
Our parents died long time back.
At that time we all were unmarried.
I was the first to get married.
My second sister was Schizophrenic a form of uncurable mental illness & thue no one was willing to marry my younger elder sister.
My youngest sister got married.
Now responsibility of looking my mentally challenged sister is of whom & why?
My mentally challenged sister is 80% handicapped & bed ridden.
My family includes my wife & two sons.
Army does not include Dependent unmarried sister a my family member & thus my mentally challenged sister in not elegible for medical facilities which my family members enjoy.
I am about to retire & my sister will grow old & her medical needs shall increase with passage of time & so will cost of treatment which I cannot afford & why should I bear that burden & why not the state.
What is the legal status of my sister, what benefits is she entitled from Govt.
What are the rights of Orphans.
Army medical authorities have denied medical treatment of my mentally challenged sister stating thst dependent sisters are not entitled medical facilities in armt.
I am willing to even adopt my 46 yr old mentally challenged sister as my daughter & is it possible
please help me.

I need advice that our opponent party husband of my client file divorce petition & now on evidence stage,they tender their affidavits,we cross them on next date,we have panchyatenama in which petitioner admitted his 2nd marriage,one another document in which his 2nd wife name appear.my query is when petitioner evidence are not closed,how can we exhibit these documents during cross to petitioner & other witnesses.plz reply me soon.it is very urgent.

I WANT TO KNOW ABOUT AMENDMENTS RECENTLY THOUGHT IN THE HINDU CODE
Hi,
My lawyer issued a legal notice 2 Weeks before my wife registering 498A. The issued notice returned back saying door lock.
Currently 498A was registered, charge sheet not filed. AB is in progress.
Does filing RCR now benefits me to fight against this 498A?
