Dear Experts,
Can a widow rightfully claim the residential property belongs to her In-Laws who are not permanent resident of the country. She had been occupying the residential property since the marriage to the deceased husband and paying the society maintenace since the last 10 years. What right she can claim for this residential property if In-Laws wants her to vacate ?
Please help !

Hi,
my wife she wants to take divorce from me while i dont want to give her due to some reason that i love her and my parents are also not ready for this. My brother in law he came on this sunday and told me that her sister is ready to take divorce from me. on this sunday they will give me a letter (stamp paper) written from her side for divorce but i dont want to accept any thing.
even i told to my brother in law that i want to talk with my wife but they are not giving the chance to talk me, even i many times threatened on my mobile for life but i have not given this matter to police station.
I told his brother ( brother in law) that till she not come in front of me i will not give her divorce. i must know the reason for divorce. even there are many valuables like jewellary etc. i have given to her, they have refused to give back all this. so how i will give her divorce? why should i loss it i am also from poor family.
Please let me know about these:-
1) should i have to recieved any of the letter from her/brother in law from their side. leaving the court notice.
2)
if i want to take the help of "Family court" and want to call my wife for counselling in court then how i can do. where i filled such case in the court. what is the all procedure and fees.
should i take help of any govt. advocate for this.
3)
should i file my case in police station about this.
4)how i can file my complaints in family court bandra my self /witouth help of advocate. etc.

I have been implicated in false case of 498A by my in-laws and the police. The police did not proper investigated the case.
Charge sheet have been filed in the court. When I approach to the public information officer and ask about the action plan taken while investigation by the IO in my case through RTI, They just did not provide me the information by saying that case is under investigation/trial and we can not provide infor fir the same under section 8 of RTI.
If charge sheet have been filed in the court then why the case is under investigation?
As the case is related to myself then do I have not right to defence myself in the court. any1 guide me as I know the Police did not proper investigated the case case is for evidence in December. Pls help

I would like to know when can the widow ask for the right to her share of property from the HUF property.
The problem her is that the widow had left her husbands home after his death as she was working in a nearby town and she was surviving on her earnings but since her in laws had some property and her share was being denied saying that she is not staying with them what abt her right to her husbands share?
how to provide her share so that she can get her right?

I have filed a 125 crpc case for maintenance on my husband and its hearing is dated in 2nd week of december, i have been deserted by my husband & inlaws,and they are ignoring me completely. I thought of filing PWDV case also but my lawyer suggested that filing a PWDV case can ruin my relations completely with my husband,altough they have illtreated and mentally tortured me alot,but i still have feelings for my husband,and want him to accept me or take my responsibility. So filing two cases can make them very very angry . So i want to ask :Iam afraid that my husband can file a divorce case now.
I don't want to go for restitution of conjugal rights,as my husband & inlaws are not ready to cooperate with me at all.
1- If my husband files a divorce case on me now, even on filing divorce from his side, can i file a PWDV case on him ????

My husband is a pervert and once I caught him watching porn. I was unhappy with my marriage from day one as it was done against my wishes and now after all this kind of mental torture from him and his family , i want to end this relationship and move with my ex boy friend.Can above mentioned reason be enough reason for mental torture and divorce. My husband wants to reconcile and lead a normal life..but I hate him as he has been very adamant and bully before.How to get a divorce without his agreement. How long will it take ?

We have a flat in bangalore which is in my and my husband\'s name.As of now it is loaned from LICH.My husband\'s mom(56 years old widow) nad younger brother (26 years-nt employed) are residing there with my husband\'s full support.As all of them were torturing me mentally I was forced to leave there in last Feb when I was 5 months pregnant.Now I have a baby girl who is 5 months old.I can mangae to live there if my husband is alone there,but if my in -laws are there,they will make my husband to be against me and he will not bother to even talk to me and if he talks tht will be for abuse.And morover they will seclude me and I will not have any freedom in tht house.I am also a software professional as my hus.Is there any ground where I can file a petition for getting my husband who takes care of me and my child and I can\'t be there if my in -laws are there.Is it possible.Do my in -laws hav any right on that apartment?.Can my husband say that he wants to stay with his family and not with me and kid.I want my hus back,but he wants to be with his family in our apartment.I want him without my in -laws.What should I do.Please advise me. Iam deserted by my husband & inlaws, They have harassed me alot, but still i have feelings for my husband and want to patch up and i have tried alot, reconciliation but my inlaws and husband didn't cooperate. So now i have filed a case for maintenance against my husband, under section 125 crpc.
But now my husband called me and threatened me that he will not give me a single penny, because he have seen my smiling and happy pictures on orkut & facebook. He says that even after being deserted if you are happy and clicking photographs that means you are happy so court won't grant you maintenance,you won't get any relief from court.
my question is it true ????

My Brother working in Saudi Arabia and he got married on 11/05/2007, and after three months he left to Saudi Arabia leaving her wife with two spinster sisters and after he left the girl also left to her mother place and till now she had not come back. and now she is asking for Rs. 25000/- maintenance and she file case in the Family Court and judgement also passed court asked for 4000/- p.m. maintenance. Now please advice what to do
