Advise what I can do about HUF property issue

I was seperated from my HUF with my brother keeping some property and my father and mother have most.

At that time properties were seperated on simple stamp paper with signs of all of major family members. ( I just have copy of the same.

Almost 15 yrs have been passed since then. In the mean time I have tried to get my share of the Undivided family property through family friends from my Brother and father without any success. They are not willing to give me my share.

some of the agricultural lands is inherited bymy father. Other realestate are partly created by selling inherited property by my father and partly by my fathers earning. My brother never worked fruitfully to earn any considerable amount.

Can I have chance to get my share through legal means. At what court level I should start?

After my seperation from family I have earned wealth and built realestate. Can my brother claim share on my earned property (after partial seperation) if I go after him and my father/mother for my share of their inherited propeprty?

In gujarat which family laws apply to HUF for proprty issue?

Wifes Share in huf

Sir,

My father had made a will. Subsequently he died in 1983. Our house stands in the name of my fathers HUF. In his will he left his property in names of us 4 brothers. He has not mentioned any share in my mothers name. My question is that does my mother have any claim in the property?

HUF

Dear sir,

my case is as follows
My father died in the yr 1983, with 4 sons, and a wife

he created an huf , after his death what is the legal standing of his wife and four sons in the huf property?

to be precise he has given his personal 1/6th share in the huf to his four sons

now does my mother have any right in the property since he in his will has not given or metioned about the Huf property

Property Share

I understand from Mr Venkatasamy that only ancestral property can be shared by grand-childrens. In this case is the first Daughter eligible for 10% more share?

Thanks,

Shekar

Maintenance

Dear sir,
On the decree passed in a petition for maintenance execution was filed.

1.Can a GPA holder appear for JDR?
2.Can a compromise petition be file in an execution proceeding JDR accepting for a lesser amount than granted in a decree?
3. If the terms of compromise is not followed can the DHR still recall the original order after execution of Compromise petition?

Property Share

My Father-in-law has 3 properties (a vacant site & 2 houses). He has 3 daughters and a son. I'm the first son-in-law in their family. Recently my F'in-law told us that he wants to sell the vacant site and share the amount it with all his children. My question is,

1. Whether the first daughter will get 10% more share (as told by F'in-law)?
2. Are the daughters eligible for an equal share among all the 3 properties?

Thanks,

Shekar

Need Help!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Hi Experts,

I have a friend who is in big trouble and sincerely seeks your help:

I am a muslim inhabitant and married for 18 years and i have two children. we've lived in doha - qatar for 14 years and separated since last 4 years, im staying in Mumbai in a rented flat with my daughter and paying Rs.10000/- as rent. I have no financial support from my husband and as my daughter decided to stay with me he refused to bear her expenses too. The reason i came back to india is since we married my husband has always accused me of having affairs with other men and used to abuse me and also physically assault me.

He has a flat in Andheri JB Nagar in partnership with his brother, a flat in mira road in his name and also has another flat which is under construction in his name. He also has plans to buy Commercial Place in Vasai for which he will be coming to India soon.
With the efforts of my two sisters, my jiju and my two children (my son lives in Doha -Qatar with his father), we tried a patch up and i had taken a time limit of a year however I visited Doha within 2 months and as my husband wanted me to resign the job as according to him he said he is capable of bearing our expenses however after coming back from Doha he is been accusing me again and giving negative feed back to my younger jiju. and since the time I have come from Doha he has not sent me a penny and according to him he wants me to settle in Doha again and get back to the same routine of mentally torturing me as i have no family n friends their. Though my in-laws are living their in Doha but they too don’t even bother to resolve any of our problems.

Please guide me through with ur valuable opinion so that i can take care of my daughters n my future. if there is anyway where i can get atleast a flat so that i done have to stay in a rented flat and educate my daughter further, also if i can get a divorce so that we can be tension free from the mental torture he puts thru day in n day out.

I am a lady with limited resources, I work for a BPO with night shifts which is already very taxing and to add to it this mental torture is really taking toll on my health.

Please advice:

What all options do I have in Indian and Muslim Law?
What should I do in order to secure my and children futures as I am totally insecure?
