can a divorce petition filed by husband be dissmissed on the grounds that the same has been filed without withdrawing the RCR case filed by him (which is still pending)in the same ?

Dear Members,
In a divorce case both the parties agreed for mutual divorce. They having 2 minor childeres (Female), the husband agreed to put FD in child name.
I need your advice how to move next step? Also pl. give me some Divorce settlement Agreement formats...

I was married on Jan 2009 after few months my wife creating problem because of her ego and she is not trust anyone and very shaaki type of girl. We have a lot of misunderstanding and a lot of day to day issues.

30 years ago my mothers younger sister starts living with my father without giving divorce to her husband. 11Years before father expired and after 3 years mother. Now second wife of my father has made an paper with an advocate that i am his first son and and after me her 3 sons and now she is demanding for 5 shares of property 1share of my and rest 4share for her and her sons and she has also changed her actual name from pavitree to parvati now suggest me what to do.

Hello Experts,
I have a unique problem. My father’s actual name is: - Beer Sain Malik.
In my all documents starting from class 10th Certificates, This is spelt as Vir Sen Malik.
On my father's passport his name is mentioned as Beersain Malik. On my passport, father’s name is mentioned as Vir Sen Malik. Now I want to sponsor my father for a visa to Canada. I don't have any document by which I can prove that he is my father (because of the different name). My father can not change his name as on my brother’s document his correct name is mentioned.
Please suggest how I should go about it. Is there a procedure where a person can declare that he is known by 2 names? Can his 2nd name be amended in his passport?
Please suggest.

this is about my marriage which lasted just one night.this has happened 1 & 1/2 year back.my inlaws had cheated on me.this incident had appeared in several newspapers too.in mumbai mirror it was the headline news.my so called husband was bald and as his original teeth was not at all in shape he had put false teeth to hide them.the very night he asked me for 5 lakhs,above that the jewellery given to me by them was all fake.i had filed a complain against them for divorce and the money which we had spend on this marriage.
i have not recieved my charge sheet yet. i want to file this matter at family court(bandra).will i get justice or will it be a waste of time.till now i had not taken action because 2 people had com to me for settlement but till now i have not received any money.please help me! i want justice as soon as possible

is there any ruling by any court stating that adoption deed is not mandatory for adoption and adoption can be done oraly?

My wife gave a false 498a case against me, my parents, sister and my brotherinlaw about a couple of months back. My sis and broinlaw are NRI who happened to be in india during that time for vacation left within few days after the complaint was given.Me and my parents alone got AB. between my wife with help of police recovered all her sreedhan items. FIR are is yet to be filed. I dont want to live with such a kinda girl so just sent her a divorce notice under 13 1a as guided by my lawyer. Now wife family treatening to proceed with the false case and file FIR to disturb us. I need advice on the following:
1. If police file FIR will they insist my sis and broinlaw to return to india. They dont even have AB. Is it mandatory for them to come back to india
2. Me and my parents have AB, still will the police be able to arrest us
2. We are yet to get arrested when I sent the divorce papers.But expecting FIR to be lodged soon before hearing. Does this add favour to my divorce case. Is first mover for divorce favourable/unfavourable?
3. Or Is there any favourable points for her to counter file in divorce as arrest has not happened. As I read in some forum mere arrest doesnot amount to cruelty for divorce. or can she claim more compensation

i was married to a girl last year without knowing to any of our parents. that was a registered one. we lived seperate . there was a prob between us. we are broke up now. i wish to tell our family about the marriage , so that they could resolve our prob. but my wife is threatening that she may commit suicide if i tell anyone abt our marriage. she is not ready to live with me either. i dont know what to do? if she or any one of her family members commits such suicide, i think i will be in trouble. what are the legal steps to take for my safety?

Shared Household
A couple has resided for seven years in parents flat ( not as a tenant) in Mumbai. Now parents want to move into this falt to live and the son(husband) has hired another flat and moved out, while the daughter in law ( wife) has not. The lower court has pronounced this falt as " Shared Household". Parents never lived in that flat and they want to live now. The mother in law has lived for two months after the son has moved out.
What can be done? Delhi court judgement is attached.
