boy is muslim by religion and girl is hindu by religion. both have married under the special marriage act. they now want divorce by mutual consent. under which act both should apply for divorse by mutual consent???

Is it possible for parents to sue their son twice for maintenance? First time tribunal declared a monthly maintenance of $125per month payable to mother although father is still alive and quite rich( assets more than one crore and fat pension) less than two years back. Although this is much more than the maximum permissible amount of Rs.5000, parents are not satisfied and have sued again. Is this case legally valid and what should be done to vigorously contest this harassment? Please reply. Thanks.

hi i am working here in dubai first time when i go to my vication that time i come to know that my wife make a relation with anothe man.So i ask her tell me truth but she did not tell any thing so i came back here and apply the cell phone call detail for her mobile than when call detail come in my ID than enery thing is come to my knoledge i ask her about their modnight and very very long duration calls.than she agreed that she called some one.so i go their and put divorce petition against her.6 months also pass her lawyer not submitt his answer in court.She is living in my home and asking that nobody get out me this home and told my brothers once i came india she cought me any false case and he dont able to go back in dubai..is this is true she able to do like this and i do when i go to court hearing and how i save my self.

Could u pls. elaborate the below mentioned point in detail, which u replied yesterday regarding my query on the subject.
I think you want to know whether the family of sister of husband can also be arrested in such cases.
Hon'ble Supreme Court has clarified in various similar type of cases that no benefit goes of any person except husband and his parents so no other person should be harassed under the garb of this section. Generally during investigation the married sister or her family, if otherwise found innocent are exonerated from charges and they are not arrested.
Is it favourable for Sister's own family who filed the case or Sister's-in-laws family as per the guidelines of Hon'ble Supreme Court?

I married a person 11 months ago in arya samaj mandir , but since then we haven't been together for many reason . now due to many reasons thr are always arguments between us which makes both of us feel uncomfortable with this relationship . we both have agreed to get an divorce . please suggest how to go about it

My wife put 498A and 406 etc in Sep 2010 and the charges are yet to put in this case. In this case she claimed that her family had given Rs.10 lacs after 20-25 days of marriage to the family members ( No specific name was there to whom they given, they had put false case on me my parents and brothers & sisters) as dowry demanded.
While writing the statements of my wife and her parents after fling of FIR at mahila police statement she told that her husband was not there while they had given 10 lacs to my parents and I was out of town.
Now after one year she filed DV case against me in which she claimed that money was given to me and my parents together after 20-25 days of marriage.
My query is that statements recorded at mahila police station will help me in fighting my DV case and any other suggestion in this type of situation.

If wife gives receipt of dowry articles, streedhan etc at mahila police station after filing of 498A, 406 etc. In the receipt she wrote in her own language that she had receipt dowry items, jewellery items, streedhan, clothes etc as per the list enclosed and in the list items of streedhan was not mentioned but she wrote the same in receipt at mahila thana.
Now one year after she filed DV case and in which she claimed u/s 19(8) that husband family has given my dowry items but still my streedhan are with them and she falsely put the list of more then 50 tolas of gold articles.
My queries are ---
1.) Can this thing is fit for filing perjury against wife as there is contradiction in receipt and what she claimed in DV and both the cases are still pending in lower courts
2.)How will it help me in fighting my DV case
3.)Any other suggestion / course of action for this.

If Lower Court decides the case against the husband and give 6 months punishment for Jail.
I want to know whether husband has to surrender himself to the police to put him behind bars or if he challenge the order of the lower court in higher court, then he is not required to go to jail till the decision of higher court or first he has to take stay.

Legality of illegitimate child
i and my wife have remarried after divorce in our respective lifes as our parents got us married to other people by force and black mail thereafter we married in presence of our friends in a relative's house and have a son 2007 but the twist is my wife divorced immediately after her marriage 2002 and i had to wait for 4 years 2007 during this period my wife had a girl child 2004 with me secretly and thereafter we got married in 2007. now both of us are govt servants and we want to legalise the birth of our child 2004 how to go about this. my office is putting lot of objections and are now questioning the legality of our marraige and asking us to establish our marraige though they have granted paternity leave and maternity leave to us please advise.
