In the RCR petition filed by my wife, she has not demanded for a separate accommodation to join me but now in the first day of court hearing, she has demanded for a separate accommodation to join me.
Are such contradictory statements acceptable in court. Can I point out this issue in the court?

Dear Sirs,
I filed a divorce suit against my wife in October 2011. I have good grounds on mental cruelty being inflicted upon me. She is earning well also. She is enjoying right of residence too. But in order to harass , she is filing DV case against me after nearly 3months of the divorce case, without strict proof of physical,financial(economical)cruelty.She is getting affidavits from two or three close relations of hers that I used to beat her and that they have seen this. How can I get her DV case dismissed??? Any other advise is welcome. Any judgments of similar cases will be of great help.Notice in the DV case has not yet come. But will come soon.

Sir,
At time of my MCD 1st motion i agreed to give what ever my wife wants from me but after six month for second motion of MCD my wife wants extra money otherwise she said she will not give divorce while i have gave all as per my 1st motion . now once again she she trying to do blackmail to me. Should i file for second motion as she agreed with me without giving extra money and if i do not give her money my second motion would be granted or not ?

My wife (from Faridabad) has abandoned me and gone to her parents with our 2 yrs old son. I live in Delhi.
1. How to save myself from 498a and 123.
2.Should I file a false criminal case against her viz. stealing my jewellery etc?
3.Can I take anticipatory bail?
4. Anything else I need to do because we are approaching her for settlement but it may not come about. We may be haraased-so what steps to take for prevention.

Respected seniors,wife filed crpc 125 in a family court.23 adjournments taken in a one year due to harass the husband who comes from long distance.case in the stage of petitioner cross.petitioner is absent from last four adjournments.her advocate also absent from last two adjournments.please provide me some relevant case laws to struck down the case.thanks and regards

My wife has filed a false domestic violence case against me and parents and my younger sister.My wife left my home on 1st November 2010 to attend her brother's marriage and did not return after that. I received the notice from court on 1st November 2011(I received this notice just one month prior to my younger sister's wedding who is also one of the respondent).My lawyer had filed a case dismissal application saying that there is no report from protection officer. The appeal was rejected by Hon. court but at the same time the court ordered for submission of the domestic incident report.Till date no report has been received.My questions are:
1. Can the court pass interim maintenace orders without the report from the protetion officer?
2. If the answer to fist question is yes, can I appleal against the maintenance order in the session court?

Can after divorce a mother can seek maintenance for her child though she has signed MOU and received 1 lac as amount for child maintenance before divorce?

If in a divorce mou,husband relinquishes visitation willingly , can this issue be opened at the time of hearing of divorce proceedings though that spouse has signed in mou that non compliance of terms will amount to prosecution.
