DEAR LD MEMBERS,
if a 498a falsly implicated husband facing various false criminal cases wants to write a will for his wealth then How to safegurd the rights of small children keeping the 498a gang away from this property including bank savings and other office savings of an Govt employee. I will be thankful if some format is devised and posted by experts for this group.

my query is that one of my clients husband has died last year and later on they come to know that the ancestral share of the property is sold by him long back. her children s are minor. whether they can ask for partition, or any other solution is there

sir plz provide me judgments whose marriage is declared as null and void u/s 11 of hma on the grounds spouse's earlier marriage is in subsisting before second marriage. i filed my case u/s 11 of hma of my own. i mean i want to argu the case of my own. one person is guiding me.

I am aneesh..I had been in love with a girl and married in office under spl act 1954.we didi not live together.
Now My wife has filed op for annulling my marriage.
We had taken a photo before marriage and i blackmailed with that to marry me so only she married(Pettion)
we took photo but i didi not black mail.My advocate says that if the girl says and that will be final.

RESPECTABLE EXPERTS,I am facing a false dv case.my concil has submitted my WS and at objections point out following - (1)LIMITATION of time ,considering pt. 24 in inderjeet grewal case in s.court. (2)it is COUNTERBLAST CASE,as filed after 6 months after my RCR. (3)FALSIFICATION AND FABRICATING THE FACTS,(-a]-my wife mentioned that my married sister lived in sharehousehold while she lives in another town 60 km away. [b]she doesnot work but i have evidence of her working. [c] FALSE ALLEGATION for dowarydemand and cruelity,I have proofs to denie. [d}she told my income 5 times more then actual (e)her own refusal to join me in rcr and at protection officer's office(certified copy of both are available). (f)her WS in rcr (filed by me) is proved false !!, during my side evidence and cross. [g]she mentioned in dv ,that i tried to search my son AT SCHOOL to kill but her classteacher will tell the truth. [h]she mentioned that my parents also beat her for dowary but my parents are living seprate from us from last 7 years.ration card is also seprate. [i]and many others. NOW I WANTS TO ASK THAT IS IT POSSIBLE TO QUASH HER DV CASE? IF YES THEN WHERE?AT LOWER COURT ITSELF OR AT SESSION OR AT HIGHCOURT?IF IT IS POSSIBLE TO USE SEC 340 APPLICATION IN LOWER COURT AND AT WHAT STAGE OF CASE.NEXT DATE IS FIXED FOR INTRIM.THANKS

This is my cousin’s case.
Boy’s Family :- Mother, 1 married brother lived in Dubai (but not in too much contact). 2 sister(1 married & 1 at Mumbai for education),
Boys nature :- Mixed nature, but with lot patience (that’s why he bared her for last 8 months). Never make quarrels with anyone before this. Doing Private mechanical company job
Girls Family :- Mother & father, 1 married sister, 1 unmarried brother.
Girls Nature :- Mouth-fouled, Arrogant. Don’t like to work in home, She is Whimsical, Don’t have control on her mind that when & how to talk/laugh in front of public. Make weird faces while pulling her hair. But unfortunately Boy don’t have evidences about it.
She refused to have sexual relation with boy in last 8 months. It not mean totally not. Boy had sex few (5-6)times but without emotional love in between that.
All relatives knows about her nature. But they hide about her nature from boy.
They made a fraud with us by hiding her real nature. Now they argued that why should we tell this my daughter is arrogant. It s your mistake that you have not inquired …
Girl left my home with her mother & brother before 8 months back
Now competed 1.3 yr to marriage. For separation 8 more months needed to complete 1 year.
Boys have few recorded audio proofs. Only 2 - 3 sentences he can use against her
1. Her fathers and Brothers threatening calls to me and my mother, But in that is also mixed conversations ( how boy is nice & how my mother is bad + Warnings to boy and family+ Law are from Girls side+ Boy will be ruin if they take any action against + Boy spoiled daughter’s life. In this conversation. Boy replied them that we are simple people & will bear as per situation. In all this boy take precaution to keep quite thought they tried to excite him a lot. He was totally aware that they just talk sweet with him now because they wish to enter her daughter in his house.
2. When her relatives come to boys house and agreed that girl is little bit Mouth-fouled (Mu-fat), But you have to re-consider as it’s a small issue. Girl is never do work in home as she was never forced by her father. But she will get habitual.
3. Once girl admitted with boy that At college days she had normal affair. But she was not proceed. (Boy don’t have any evidence for this … not have any big concern anyway)
Boy’s was in tremulous situation since last 8 months. He told me about that sometimes he speak himself ( without any presence). Shouting on others for small-small reason, can hardly sleep near about 4 hours.
Recent the incident happened at Poona that Bus driver killed 10 people near in Poona. In news mentioned that the driver was under some treatment for mental dieses “schizophrenia” with the symptoms. My friend was fainted. As he was self-experiencing the same symptoms since last 8 months. But however his job hampered a lot due to all these situations.
I don’t know whether I can put all situation in front of you. But I tried this for my cousin. I tried to convinced him that everything will good. He is very good in nature. Good understood guy. He know what he is going for is not good but he still wish to divorce her at his age 34. Just to avoid further bad consequences . I’m not wrongly appreciate my cousin. But he is really good than compare to girl.
Good in all these BAD things is there is not Legal case within this 8 months(not from any side). Boys trying for Mutual Divorced but they denied. Because they know now who will accept their weird ‘Mou-fut’ daughter.
On any situation Boys don’t wish this frequent girl in his life.
I need few suggestions:
If they not agreed for Mutual divorce , Can boy have enough evidence or ground to ask divorce. that girls family hide her nature before marriage ?
My most important query is can Boy start for medical treatment for these “schizophrenia” diseases? But his lawyer inform him that if he goes any mental treatment other party can use this as weapon against you ?
As other party is going to file case some 498 section against boys family. What steps he need to take precaution? antisepetary bail will help me? As lawyer suggest him that no need for this bail., as his family is well reputed in society (not well rich). Police will not arrest you. As now a day’s police make inquiry in neighbors, peoples before arrest in family cases. Is it true ?
Can Boy cut the audio in parts and rejoin the bad sentences her parents and relatives talked about him during threatening call ?
As a cousin more than his best friend I wish him to come out safely from this situation asasp.

during my birth ,as my name was not kept,my parents enrolled my name in ration card as Rahul 23 yrs back.Till today my name in ration card is still Rahul.all my certificate are named after my original name Priyank.plz suggest me what is the procedure for changing name in ration card.

Wife filed for divorce and husband for rcr, and after three years, during the evidence stage the court again ordered mediation. In the mediation center wife pressed for mutual divorce and husband agreed for the same. If they file for mutual divorce withdrawing the current divorce & rcr petitions and later wife withdraws consent for mutual divorce and sit idle, what are the options left for husband?
Can husband reopen her divorce petition? At present,the divorce case is going against her and husband thinks that filing mutual divorce is her game to just close the present divorce petition.
Can husband reopen his rcr petition?
If yes, can it be reopened from the leftover stage?

Daughter mentally disturb, wants cure right
My daughter has married in 2009 but after marriage she is mentally disturb and behaves like she does not know any body in family members. She started blaming each family member including me and her mother. It seems she has not any feeling about her family members.
Again after some time she has left her husband due to her some personal reason. We have taken her to a psychiatrist. In Electroencephalography (EEG), Dr has told us that she is mentally disturb and due to this she will always think negative. The Dr has told us that it require 1 month medical attention to recover.
We have tried to take her to Doctor for cure but she started hollering and called up the police. Then police has told us that we cannot do anything against her willing because she is mature. Then she has given the written statement to police that she doesn't want to leave with me (father) or husband.
Now she is leaving some where in Delhi that we don't know where. she often calling us and starts crying or saying that she is not well. We have asked to come at home but she is not ready for that.
Its now 1 year and as a father, it is not possible to see her in trouble and staying along. Also we want to give her complete medical treatment. We have the medical certificate about her mental problem and we want to take the help of law to get her in home for cure.
Please suggest, how can I take her to home for her complete medical treatment and better security.
