Hello Sir
My wife has been staying with her parents since November 2010 . We got married in June 2005 and had a son in Aug 2006. I statyed seperately for 1 year (2009-10) in a rented house as per her demand to live separtely away from my parents. She left that rented house in Nov 2010 for her brothers wedding and never came back. Even after several efforts by myself family and frnds she denies to come back. She is also not ready to give divorce. Nov should i wait for 2 years to file for Desertion or should i file Petition for divorce now. My wife and her family is mentally harasing me since she does not want to marry again.

Dear all,
can police serve me notice personaly or they can send notice by post. notice is for asking written statement against complain filled by wife related with 498A.please give your valuable advice.
if i not give statement to police then what action they can take against me n my famaily. i want to give statement in court if police send complain in court.

Dear All,
I am akhalaque Ahmed, from last 7 month my wife is living with their parents and give false complaint agianst me n my family for domestic violence (498A).From last 7 months complaint is pending in police station no offence is registred yet.but from some ASI of police dept. keep calling to me n my family members to give written statement about the complaint report by your wife.
my question is these kind of action is justify under legal terms. please advice me for the same

Married 5 year back as per Muslim rituals (both being Muslim,arranged marriage),
Have baby boy of 1.6 years,
Husband abruptly stopped communication from lost 6 months; neither came to c me as I was at my parental home.
Now he is saying I have divorced you, as he say he has send divorce through Registered post to my parental address to me & my father, as we were out of station so could not receive the same.
Also he is saying I have published in daily newspaper, but we did not have any information about it.
The allegation which my husband’s is putting is that I am not mental fit that too he is saying after 5 years of marriage & 2 years of engagement.
After my marriage my in laws ill-treated me, & I also even went to a Phsystriate after marriage because of ill treatment by my in-laws, he said u don’t have anything.
Now my husband is giving some baseless allegation which has never happened.
I want to save my family, kindly advise me what to do as I am a housewife with 1.6 year old baby.
My husband has not paid even a penny to me & our baby from lost one year even though he is earning more than 70 K a month.
What is the credibility of this Divorcé, what should I do to save my family & myself from divorce, please advise me kindly.

Hi...sir,i have one elder brother and one Younger Bro & one Elder Sister. my father expired in 4days Ago,age of 52yrs, He was worked in BSNL dept, He has 8yrs service yet,But suddenly this incident done,All PF,Gratuity Belongs to My Mother as Nominee.. then It is Necessery to get Legalhair certificate for My Family Or NOT? How would I apply ?
plz clarify my Query and suggest How will i do for Further step to get all Benfits for My Mother.

My mediation was going on in women cell with my wife but on second date my wife refused for further mediation and had submitted the application for registering case against me under Section 498A & 406.....
Now I wanna ask you one thing does the IO(Investigating Officer) in women cell has got power to make light report against me so that I can easily quash the allegations in the court under the aforesaid sections if I offered good amount to IO for this????????????? If yes then what should be the the language of report should I told IO to make for against me???????????????

Dear sirs,
i have filled case under section 18 HmP . my advocate had deposited fees as court stamp Rs. 12000. now we come to know it was not required. Is it true? if yes then how i can get it back?. Further this advocate had done other so many serious mistkaes which i can be prove. To whom i cna compalin ? How i or other people can take action against this type of advocates? please advice.

Is it possible for the wife to prove that marriage was not consummated to get annulment even if husband is not impotent?
I just want to know what are the options before the wife to get annulment on non consummation of marriage if husband is not impotent but he abstained from sex.
What would be the decision of court if wife is ready for virginity test and husband is ready for potency test, and quite naturally both test results turns out positive? They lived together only one month and husband claims that they had sex a few times and now its the wife who is not showing interest in sex...
What is the possibility of taking the virginity test result as a reliable proof of non consummation of marriage even if husband's potency test is positive?
I want the experts views on how the court is supposed to handle such a case on merit.

respected lawyers i am from kerala.
I was a seminarian(student of priesthood)
i met a girl and we loved for seven years and registered our marriage registrar office on april2011.she was at her home only because i had some problems to take her to my home because of relegion but unfortunately her parents came to know and she had filed to nulify that marriage.she was in true love but she has been changed by her parents.i talked and tried to chnage her but no use.i lost my hope in her.she allegation is i forced her to love and also to marry me.
I have all the evidences to disprove her allegations.
she forced me to love and had told me that if i go to seminary she would suicide i have the love letter to show this.
I lost my prestige life and career and even parents for her.
could any one say can i do any thing against her legally.can i complain to the police or elsewhere for cheating and spoiling my life.

RCR petition is an evidence that the husband and wife are living separately.
Can a wife withdraw her RCR petition, without intimating the husband and thereafter file a false 498, falsely stating that she was staying with her husband.
