Divorce


Dear experts,

(1) I (husband) filed divorce on cruelty and desertion grounds on my wife u/s 13(1)(ia)(ib).

(2) Wife in the counter made a counter claim for divorce on cruelty 13(1)(ia) due to impotency of husband (petitioner).

(3) Wife filed an interim petition to send me to the medical board to check me for impotency and the court ordered me to take up the test.

(4) In the tests done by medical board, the result came in my favour (i.e they said no evidence to suggest impotency)

(5) In this scenario, I request the member's expert guidance to help me find out the judgements, citations to be quoted in my arguments in the above mentioned scenario under cruelty and desertion

Nominee for financial assets

I want to Know after marriage who should be nominee( Wife/ parents) for the financial assets of the individual? I understand that this depends on family to family and nothing concrete can be said about this but are there any legal bindings to this issue?

Matromonial matter / divorce

Dear Sir / Madam..

Hi, i 30 yrs old woman from delhi, working in a reputed company.

i have lots of query regarding matrimonial issues..pls find my brief details..

1.got married last year in march
2. we only 3 people living in the house , me, husband & mother in law.
3. one brother in low living separately with his wife not with us.
4.after 2-3 months issues starts between me and my husband or money matter, ego issues, rude behavior towards my family..etc..all are illogical issues.
5.suddenly i lost my Mother in aug 11..at that time also my husband has not give me any kind of emotional support..
6. from aug onwards i m not living with my husband..i had gone there for 12 days in oct month for settle all the issues..but those 12 days are honorably days of my life..

7. he started abusing me for money, for physical needs, for household work,illogical blames, wrong allegations ...between this period he has purchased a gun so that he can take full control on me...my life was miserable over there..

8.after that he started problems for my job also..and forcing me for the divorce..situation was not under control..at last i hav left the house on 12th october 11.

.9 till the day he has not taken any step to settle down the issues..

Pl suggest me what can i do ..i have written very brief story..i was harassed by him at all levels (emotionally, mentally, physically)..at that time my sleeping hrs was reduced to 2-3 hrs only..i was like a labor over there..who has no respect, no identity..

me and my family is not much financially strong and not much educated for legal matters.

Pls advise the best option i can take against him & save my future life.

Widows rights in her in-laws family

Dear Sir
i would like to ask to help me out for a suitation which out of my reach.
My sister a widow of an Army servicemen deceased in 2011.
Know her mother-in-law is harassing her to give share of the compensation,pension,Insurance amount recieved from the Indain army and also threating to go to court to file a case against her.
My sister's mother -in-law also a widow of an ex-servicemen, she obtains pension from government, has good amount of wealth and property on her name, as well as she had 3 sons, one expired, 2 are remaining and working, living jointly.
My question is does she has any right on her deceased sons property with out a will. and what rights does the WIFE of the deceased has on her husband family property.

Divorcee validity.

sir, i have taken divorcee with my wife on Rs. 100 Stamp paper with present of two witness and signed by Nottary. It is clearly stated in that document that all maintenance for her life time is given and she has no right for further claim of it. I have receipt with her sign clearly stating that, all the articles called 'Stri dhan' is given to her.

Although she filed 125 against me stated that the sign on the paper was taken from her by force. & She is totally ignorant about the paper on which she was signing.

First she filed 125 on her hometown. but after 7 months she withdraw the case with a right to reopen at any other court. The reason given by her was that she is changing her living place.

Just after 15 days she re open the case in my hometown, Family Court. Because in this court Maintenance is much more than others.

My question is: Is she eligible for maintenance? and Is Divorcee is valid?
We both are of Brahmin communities and im government official.

Maintenance


We have separated since last 10 months. She do not wish to come to my home but my MIL pushed her to send her back to me
But we both wish divorce.

I've 30000 salary from that 15000 is auto deducted for home loan. from rest I pay 7000 to my parents for monthly expenses.and from rest 8000 I used to pay my petrol and other expenses.

My father is retired and mother is house wife and both are totally dependent on me.

Can you tell me the maintenance should I have to pay to my wife in future ?
What if I may jobless in future ?

She is in small company and earning 8500 pm.
still I have to pay her maintenance?

Share of family members

It is clear that during my lifetime none of my parents/brothers/sisters have any share in my property. However does the same argument holds good even after my death ?

Fake case (need help)

I have very serious matter in my life. We are Christian. I am staying with my mother. She totally depends on me. I am a working guy, not married. My father is alcoholic and separated (not legally) from my mother 18 years back due to fighting, bad company, alchohol, not giving house hold item etc. We are three children, one elder brother and sister both got married. My mother sacrifices whole life from the last 37 years. She is not educated but she done every small work (like press, door to door marketing, stiching, etc) to survive. She alone educates all three children. She alone does marriages of two children. Now after 18 years my father (age 64) sends us court notice for his maintenance. my father had 160 sq.f of land in delhi, half of which he sell out in year 1992. after that he run away. We are living in delhi, the said property is named on my father. I meet many times with my father but he doesn’t want to change. He drinks whole day. My brother is living on first floor, he is also alcoholic, he is not working from last 4 years, and he only drinks day and night. On last court date, my brother give statement that he wants to live with his father, he only wants whole property that’s why he compromising with my father. My sister is with us, but she can't do anything. Does my mother have any part in this property? My mother is very tense, after 37 years she got nothing. My mother and I want peace. Our advocate doing nothing, he wants us to compromise with father. we need nothing but only justice, i want to fight for my mother who sacrifise this much for us. Please tell me what to do???

Need immediate assistance

Dear Professionals,

I really thank each one of you to advicing me the legal aspects on my need. I'm here once again seeking your professional guidiance. I got devorced with on last 3rd Feb'12 at Shriath (Islamic) Court. Its my ex wife she initiated the Divorce (Khula) proceedings. Now I'm getting re-marry within my relatives.Should I take any legal step, so that my ex wife would not create any issue at marriage.

Adoption

If a girl has been brought up by persons who didnot adopt her legally , in official terms can she say that she is the only daughter of the adoptive parents (Guardians)? She though in her legal documents mentions the name of her biologial parents
