What does the below mean?

A decree of restitution of conjugal rights, in India, can be executed by attachment of the property of the respondent.

What if the 498a, dv, etc. turns out to be false?

The most common instrument for a woman is to file 498a, DV, etc. However, what if these cases turn out to be false in the court? What actions can be taken against such a woman/her family?

Position of child after divorce

Hi,

In case of Divorce, who will hold the position of my daughter of 1 year old.

My case, my in-laws want to take their daughter i mean my wife with them of no reason, if i go for divorce who will get the position of my baby.

the source of income for my in-laws is nothing butmoney is sent by their son staying abroad is still unmarried otherthan that no income. but still they want to take my wife with them and also my daughter.

i want my daughter if in case they ask for divorce.

please help

True copies

sir i obtained some of the documents from police department under rti act. i filed in the court . they were marked under subject to objection. now judgement pronouced in that judgement it is clear that court though marked but not taken into account. in the judgement it is given that other side objected on the grounds that
1) true copies are not certified copies
2) the contents of those documents have to prove

But sir in recent past i saw in google search that according to evidence act true copies are nothing but certified copies. then why in judgement it is like that. in appeal will those documents will be taken into account. those are very imp documents to decide my case. The other side just said subject to objection but did not took any step to call concern officer to prove the record. moreover the other side the respondent did not entered the witness box. case decreed in my side only. but the thing is they are taken into account more weight will come to my case sir. plz suggest any citation that true copies are admissible inthe court.

Family

good evening sir
sir when a person files a case (family issue in my case) along with some evidences, the other side is saying that they are created and fabricated. i filed marriage photos. the respondent simply saying that those photos are created but she did not venture to enter into witness box. now my doubts are
1) one is saying that when i filed photos it is my duty to prove by calling photographer
2) one is saying heavy burden lies on the person who denyes any thing that is rebutt by entering into witness box.

in my judgement, court has given judgment by saying that the respondet did not ventured by entered into witness box or not taken any step to send notice to photographer. my case is in appeal now. who is correct whether i should prove by calling photographer or the respondents responsibility to enter into witness box by taking necessary action.

Witness- dowry/harrasment?

I complained in Women police statsion and got the FIR filed on my in-laws and Husband on dowry/ harrasment. I went through higher official since my earlier petition was rejected by police station. So police officials are angry on me and not explaining things clearly to me. They asked me to bring the witnes.
For what witness they are expecting, they didnt tell clearly. They told to ask lawyer. My lawyer also dont know.
Please let me know what witness should i bring to them?
(I filed on dowry , harrasment. For dowry amount transfer I have bank account)

Family matter

sir we have a joint business. My father worked really hard for several years but now because of my grand father he had to incur heavy loses and now he is not giving us money for food and medicine though he is capable enough to do so. we dont even have money fr education as well. he is nt evn caring for his wife and was involved in a bit of domestic violence as well. sir, wat can we do to stop dis? what sort f claim can we file against my grandfathr?

How to file alimony case?

hello Sir/Maam,i am not living with my husband since he has lot of ill habits like drinking and harassing ,cheating ppl,
borrowing money from ppl and not returning back, womanizer,earning in ill legal ways ect. due to which me and my daughters had face lots of trouble by concern people ,i am separated from him since 5 years,and he is not paying any single paisa as a maintenance of kids or myself,i am bearing all expenses of my daughters with the help of my parents(i am not earning),
since his earning are not in legal manners, i can not show his bank account or C.A./taxation filings to the court neither i cant proove his earning because he is not doing any job ,but the way he is living is very lavish and the minimum cost of his living standard might go up to
1 to 1.5 lac per month (since i was his wife i know his earning is around 1 lac per month)
he is determined not to give us any thing in compensation and maintenance.

in the situation given above how do i go about compensation and filing a suit for alimony?
how much amount can i get as compensation and maintenance?
can i claim for the last 5years compensation and alimony ?
what is the procedures for last 5 years amount to recover?

Maintenance case under 125 crpc- appeal- transfer-reg

Sir,
The opposite party (wife) filed case under 125 CrpC in JM court in a taluk of another district where my self and that party currently not residing. But the case is in progress. If the case is finished, I can go for appeal in the district court(if judgement not satisfied me).
Hence, I need clarifications that, shall I can transfer that appeal petition filed by me in another district (Where the judgement given in the JM of taluk court of the district) to my residing district by high court or not.Please give suggestions sir,
