An unmarried muslim women has 3 brothers out of which one died leaving behind a wife.she also has 2 sisters out of which one died. The died sister left behind 2 sons n a daughter.out of dat one son hAs 2sons n one daughter wid wife...the daughter of the died sister has one son and one daughter. Wht will the share of property each one would get

Is the live-in relationship can be maintained as leal relation without taking divorce from first wife? First wife is not ready to live and nor gave divorce ?

i am married for 8 yrs . Having no wedlock . we staying together under one roof in my quarter . But we are not living like husband and wife for the last 1.8 years . can we apply for mutual divorce , though we are living in the same flat ?
and also tell whether the 6 months waiting time is applicable for us , even though we are living together for 1.8 months ??
Kindly show me the true picture urgently ..

I want an advise that my wife has given false information to the court and seek an exparte order i.e. maintenance.
I can prove it that she had made a false case.
I say that she has left my company without any valid reason and also filed number of domestic violence cases against me. I say that in fact I was also been detained in judicial custody due to the impact drawn by her. I want to say that she is one way or other way trying to abuse me and indulged in making my life worst living.
I want to know that what case should I put to my wife that she had cheat me in maintenance, harassment. And also I want to know what punishment court will give to her.

Below are my details:
Marriage : Dec 2008 (Nasik)
Matrimonial home : Mumbai
Staying separately : May 2009
Issue Baby Boy : end 2009
Wife's relatives taking back Stridhan : June 2010 (written and signed on Rs. 100 stamp paper)
Sent Money order by myself : 3 times Apr, May and June 2011. Refused by wife with no reasons.
Despite several attempts, wife doesn't come up nor is she ready to give divorce.
Both Parents not keeping well but wife wants to stay separately.
I filed for Restitution of Conjugal rights : March 2012 in Mumbai
2 hearings so far and wife does not turn up.
Wife files for 125 CrPC in Nasik in Aug 2012 in Nasik (Malegaon).
Queries:
1) Can wife file for 125? I have received only Summons from Nashik, Malegaon Court via local police station and not the details of the case / accusations.
2) Is Malegaon in Nashik?
3) Do I have to pay for monthly alimoney?
4) Can i transfer the Nashik case to Mumbai? Can this not be clubbed with my RCR case in Mumbai?
5) Do i need to remain present for the hearings?
6) How much time it takes for ex-Parte in my case of Restitution that i filed in Mumbai?
7) Can Court consider my application of ill parents and expedite judgement for RCR?
I would really appreciate your kind and expert advise on my matter.
I am also looking out for a Lawyer in Nashik who can help me solve transfering the case in Nashik.

A a Hindu male dies leaving his widow,Father, mother, daughter and son. mother , widow, daughter and son share the property equally(each got 1/4 th share of properties of A). After some days A's mother died. Now A's only brother B claimed a 1/2 share of the 1/4th share of the mother. is his claim valid?
(on partition A's mother got 2 acres, now B claiming 1 acre land.)

Sir, I am a victim of false 498a/406/34 case.My wife has filed but she
reside in his parents house fo last one year.As withness her two
elder sister has signed.
1)Distance between me(my house) and my wife house is about 25 km
2)1st withness resides 20 km from my house and 8km from my wife's
parents house
3)2st withness resides 17 km from my house and 20 km from my wife's
parents house
I have enough probe that my wife is out of our house from last one year
(paper documents)
I do not know are they eligible for withness or not , is there
any probition in law to take step against false withness ?
Can i chase them how they have seen me to torture
my wife ?
Can i take step while 498a case running ?
