In dealing a case before the criminal court I am facing difficulty to convince the Hon'ble Judge that Gifts made to the bride by groom's relatives at the time of marriage or immeduiately before or after it are NOT items to be included in ther definition of STRIDHAN.Could anyone please highlight the law on this most important qn asked the juidge here time & again ?

Wife living with her prents and don't allow child even to meet with Grand parents and other family members. Husband goes to live with her to her parents home whenever he comes on leave from Job for 3-4 days.
How he can get this right without braking marriage?

whether daughter has right to claim over father's(who is deceased) inherited property(father has not written any will).After death of father, Mother by her own wish orally did partition of same property and transferred it to all her sons in year 1951. Now after death of mother can daughter claim over equal right in same property to her brothers?

Husband wife relationships have been strained and wife is at her parents home for past 1 month.Father in law all of a sudden telephonically speaks to husband's superior officer and makes amputations against the husband due to which husband reputation in workplace is badly affected.
Since it is a marital dispute and office superiors nowhere are concerned in such matter, Isn't speaking to office superiors on such issue and making allegations(which are as such false) defaming the husband or not? Can husband file a defamation case against father in law? If yes, whether witness of superior officer will be required or not?

Dear experts, i had earlier asked regarding admissibility of mobile phone recordings stored in SD card/voice recorder recordings if irrelevant recordings(saved in separate files) have been deleted.
I am unable to understand how can the below citation quoted by Ld Mr Sethi affect admissibility of my evidence
c) Every possibility of tempering with or erasure of a part of a tape recorded statement must be ruled out otherwise it may render the said statement out of context and, therefore, inadmissible.
What i gather from above citation is that one should not tamper with a particular audio recording file nor delete a portion of it.
How can a audio recording which is not tampered with can become inadmissible if other separate audio files in the same Sd card/voice recorder are deleted...The recording files which were deleted were of earlier date and were not in any manner concerned with that particular recording.Ld members Pl clarify...
AAA(lady) married with BBB putting him under intoxication and undue influence and got marriage certificate from araya samaja also. While her husband is still alive and there is no divorce between them.
After doing such all, she has grabbed all his money and retirement dues. When BBB's son knew this he took his father with him.
AAA filed 125. BBB appeared and didn't filed written objection only filed compromise that "HAMARA SAMJHAUTA HO GAYA HAI. HAM MAMLE KA IS ADHAR PAR NISTARAN CHAHATE HAIN". He also recorded his statement that "HAMARA SAMJHAUTA HO GAYA HAI. HAM MAMLE KA IS ADHAR PAR NISTARAN CHAHATE HAIN MAIN PRARTHINI KA BHARAN POSAN KARTA RAHOONGA". Court fixed the maintenance amount.At that time BBB was under impression of crook lady.
Now BBB is with his son and ill. AAA has filed for the recovery of 12 month's maintenance amount.
How BBB can cope with this situation.?
BBB didn't filed written objection-whether it amounts admition of marriage. Even in his oral evidence there is nothing that AAA is is wife.
What is the remedy now when he can't file appeal. How can he obtain stay on recovery.?

Dear Experts if the RCR has gone ex parte in my favour, what is the time limit for filing divorce. The decree was passed by the court in Feb and the copy of the decree was sent to the respondent in April. Can I file for divorce in Feb or April.

wife has changed her address after two hearings passed but neither she replied to notice nor she attended the court on hearing. whether court will re-start proceedings or we have to file an application to change wife's address?
divorce case has been filed by a husband against his wife in july 30,2012. husband got no notice from his wife's side.

In an ongoing marital dispute case, husband makes recording of cellphone conversation through his mobile phone which is stored in the SD card of the phone and also records some statements of wife at home with a digital voice recorder which has an inbuilt memory.
As SD card of mobile/internal memory of voice recorder also contains some irrelevant recording(separate from the relevant recording made by husband), the irrelevant recording is deleted from the SD card/internal memory of voice recorder by the husband. Does it affect the authenticity of other recordings in any manner as all separate recordings in a SD card etc are saved as separate files.
Kitna maintenance
Mere pati sai mujhe kitna maintenance mil sakta hai.
Mai shadi sai pahle naukari karti thi par aab nahi karti.
Mera 10 saal ka baita bhi hai magar wo mere pati key pass hai.
Mere pati accountant hai magar mujhe unki salary pata nahi hai. mujhe kitna maintenance mil sakta hai?
