I have filed apllication u/s 125 of Cr.p.c and d same was allowed n husband was directed 2 pay Rs.3000 as montly maintenance since 2011, n I m leaveing with my parents only, as the husband failed to pay the outsnading maintenance for 2years I moved an application for recovery of Rs.72000/-, however my husband continuously remained absconded since d date of Order from d earlier place of residence, so summons returned unserved, so distress warrant wasbeen issued, again pproclamation was made, however, till today he remained absoconded. So hw should I recover this amount, my husbands parents are also refusing to maintain me n they hold several properties on their name, n there exists no property stands in d name of my husband. So its a question of my survival ship, what should I do more, m helpless today, I want 2 penalised him anyhow, however court is directing me to trace out him and his address, I tried severely but could not traced out him. Help me in this regard

Dear Sir , We husband and wife. living separately for last one year and my elder 3 year son is with my husband. How I can take the child visitation right. I have filed 125 and my husband HMA13 and then 498a by me . Pls reply.

Dear Sir,
My Brother got married 15 years before with my sister in law 1998. Now, they have two grown up kids age 13 & 14.
But my brother was not informed about my sister in law's first marriage divorce and they have hided the issue.
Now, my brother would like to put the case. Is it valid to put the case after 15 years ? What will be causes to my brother and my sister in law? what will be future of the kids? what are the consequences that girl family will face? Please advise us.

First maaried as per Muslim law.Wife didn't returned to matrimonial house for more than 2 years, husband got remarried without giving divorce to first wife.
First wife filed DV case asking for maintenance.
Question here is whether 2nd wedding to be disclosed by husband at this stage.what
Effect will it have to reduce maintenance if any. Other pros cons of same.Thank you.

My divorce case is running in family court and I need to submit evidences. Over the 3 years me and my husband exchanged emails. My emails were always cool , calm whereas his emails were full of false blames, abusive. Now he bring new story of desertion by me where contradiction is mentioned in his abusive emails.
My query is : I am submitting my emails. Sould I submit his abusive emails also just to prove his new allegatio of deserton ? or His abusive emails I shoud not submit as evidence?.
I have kid and want to save married life.
Please advice.

My husband forcefully get divorce on mutual consent from me by giving mental pressure on me. He deliberately send me to my parents home. he usually gave suicidal threats to his parents. that is why i agreed to come back to my parents home for some time, I don't know what was the reason.After sending me , he and his parents sold out house property without telling us and they carried away all my stuff and jewellery. I did not carry my jewellery at the time of leaving home because I never thought about divorce. Now by giving pressure he got divorce. As after that kind of cheating I don't want to remarry. Can I get any kind of share from my ex husband's property. Is there any law please suggest.

My son married in2007. Family court granted Divorce exparte on Mental cruelty grounds( not appeared for long).
1. After marriage she brought, house hold articles like refrigerator, Bed,TV, utensils etc.
2. No Gold/ Silver items available.
There is no mention reg. how to return them.
8 months passed. There is no request from their end.
We want to get rid off them because we are not using and it is space in our small house.
We are not in touch with them for the past more than 5years.
Kindly guide how long we should wait and keep it.
What is the correct way of getting rid of above mentioned materials.

If newly wedded wife refuse to have physical relation with husband when her husband want to have physical relation(Wife is not suffering from any medical problem). Is it mental and physical harassment for husband. If yes under which act plz let me know.
