Hello Experts,
I have a very serious issue regarding my elder brother's marriage.
My brother got married in March 2014 after-mid month. First time when we met their family, they gave us the wrong DOB of the girl as 1983 year (actually its 1979). My brother age is 1980. So she is elder than my brother. This we get to know after the marriage i.e. after 25 days of marriage, not even a month completed.
Since marriage day, she stayed with our family for only 12 days; remaining days she stayed at her own house with family as part of culture.
So, the problem is:
1. They have cheated us about the Date of Birth.
2. She doesn't know/show any responsibility towards family, husband or household activities.
3. She doesn't move closely with family members nor with my brother.
4. She is very dominant in all ways.
5. A small thing i would like to share, she never touch my brother legs when my brother gets pain. She says i won't touch your legs.
From the above issues, we doesn't want to continue with her. Our family is not happy with her and her behavior.
We need your help urgently.

Hello Friends,
My estranged husband, NRI - residing and working in USA, abondoned wife and kid 5 years ago ( brought working wife from USA and kid from USA), has filed a divorce case u/s 13 HMA (on the basis of desertion and cruelty - both physical and mental). In family court all the evidences are complete. Court gave arguments date and asked my husband to appear. Please do let me know the procedure for final arguments.
My Query:

i) As I appeared in court for 2-3 dates in a row every 20 days taking leaves from my office and this time not able to get leave due to too much leaves from office. How Can I say in court that I am unable to attend court. I am in South and court is in North.
ii) I asked the court to give date atleast after 45 days but my husband lawyers took advantage of situtation and keep date on 20th day.
In the entire case I have not file any case in section 24 ( as I am working but earning very less comapre to my husband) , no sole child custody ( husband is not intersted in child - visit 3 times city but never tried to meet child), no child maintenance. Please let me know what should I do.

Hello All,
Trail is over in DV case,now is it possible to ask for additional evidence at the stage of session appeal?? If yes then how and under which section? Evidence is regarding to summon employer to examine for the actual income of applicant. Please reply.

In my case of 125 , I m allowed to get 6000 for me and my one year old child. Where as my husband has filed Hma 13. He also facing 498a and has gone jail for 8 days. Now he has given the application in session court for revision of 125 agaist the interim order pass by court in 125 suit. In his petution he apart to the regular objection of interim order he is saying that he requested me no of times to live with him and arranged Khangi Panchayat in which I refused flately to live with him ( which is purely false ) and he is still ready to take me back without excuses. Now my query is the one side he is filing divorce case and other side he is asking to ready to take me back. Is this may be trick only or he may realy wishing to take me back or he is just want to escape from giving the maintenance by giving this type of statement ? Can the court force me to live with him untill unless I should be sure that he is feeling real guilty of throwing me from my matrimonial home in advance stage of pregnancy ? In case if I will say I do not want to live with him then will the Court stop the maintenance ?

Dear Experts,
My client Mahesh married with Sruti in 2012.
after that he came to know that this is second marriage of Sruti. And Divorce has not been taken from ex husband Dhirayu.
now she filed maintenance application against Mahesh. and refused to live with Mahesh further.
Is Shruti entitle to get maintenance from Mahesh?
Neither Marriage has been registered. But we have marriage CD & Snaps of her previous marriage.
Another thing is that Sruti was not age of 18 at her first marriage.
We have filed application U/s 9 of Hindu Marriage Act. In that petition she has not file reply yet.

Sir, I need information that our case for maintenance is pending before the JMIC( 125 Crpc) and where interim maintenance is awrded for children..the father( my cousin) has not been aliowed to meet the children..In that case can we file the application for visiting rights in the same court i.e JMIC?? UNDER WHICH ACTS/ SECTIONS THE VISITING RIGHTS APPLICATION CAN BE FILED??

My grandfather had 5 children, 3 males and 2 females. The females are the eldest amongst the children. The property is a HUF one. Grandfather had created a WILL before his death stating that he had sold the property to the ladies and both the ladies i.e. sisters had forfeighted the rights in the WILL which is also REGISTERED. Now, after the death of grandfather the females are not ready to sign on the property documents so that the male members can go ahead with the partition stating that they have equal rights after the SC amendment. The ladies were married before 1979. Grandfather's WILL was registered in 2001.
Queries below.
My grandfather wanted to give some property to the ladies (sisters), so he had created a WILL indicating as though he had sold this property to them. The ladies have also forfeighted the rights. But the male members have not yet signed the registered sale deed given to ladies. Is this valid sale deed for ladies?..as there is no signature from male members...
After the demise of the gransfather, the male members want to go ahead with the partition as per their dad's wish, but the ladies are not ready to sign the documents. Do the male members need ladies signature as they have already forfeighted the rights in the registered WILL?

Hello, I need experts help. I got married in Oct 2011. As per my father is law's advice I started paying INR12000 for committee for future saving. i stayed till June 12 with wife and we both stayed in Delhi. My wife born a baby boy in Oct12 and we patched up again. I took my wife to my hometown in Oct12 and things were okey however when she recovered, she again start making issues and on Nov12, her parents took her away along with them, a SAMGHATANAMA was signed in police station that she is going to her parents house with her desire and took all GOLD jewellery along with her.
She filed a case for domestic violence & maintenance U/s 124 of CrPC.
My wife agreed for settlement in Augest13 that we will stay stay away from home and will take care of baby and outside court settlement was done in Dec13.
I could not go home due to court settlement during this period however I had to urgently go home in April due to sudden death and my wife with her parents, took away all goods and everything and now my parents are receiving calls from Punjab police to come from Himachal.
* My laws are always blackmailing me because I got a fraud passport with my picture and with my elder brother name. I got the passport issued 7 years ago. I know it was a fraud but I am left with no options than probably.............
My wife and her parents are after my life at the moment and I am not sure if I would be alive till the time some expert replies to this. They looted me badly 1- Approx 90,000.00 for committee, 2nd they have take my all goods i.e Hitachi ac 5 start- furniture, cloths, etc etc. i am not worried about goods or punishment but i am worried because my father retired from Army 3 years ago and ever since he is retired- he has been going through this mess and I feel that if something happens to his. The entire family will die.
It was an arrange marriage but unfortunately didn't work. I am from Himachal and law are from Punjab.

Property transferred to sister, by father
Dear Sir, I was out of the City Delhi, for my Job requirement and now living in Ghaziabad near to my father since 8 years. I have paid a small portion to my Mom and dad for living, my sister was handling them properly. Since last year my Mom expires then after all the required task have told my father to come with me to live happily, Since my sun required their guidelines to become a gentleman in his future and become successful. When it comes to sharing the property and Mom's assets, i got to know that everything is in name of my elder sister. was amazed and asked from my father for this and he told me that i am responsible for all this w/o and proper justification. know i need to know about my rights and my sons right in this case. pls help me out. My father having a mental problem and now on advice with a neuro as well as psychiatric doctor in IHBAS Delhi. I like to fight for better future of my Sun.
