Dear Sir/Madam,
I am qualified Company Secretary & LLB, I got married last year, but due to IN-laws torture and fights withing 20 days after marriage, my father brought me along with him after 3months of marriage. when i got engaged to that person his salary was 25,000 Rs. & after 3 to 4 Months of engagement his salary got increased to 50,000 Rs. and now it must be with 20% hike as he joined in 2012 May, 7th.
He takes classes at Ahmedabad, Swastik. to avoid TDS from Class Cheques he has got from classes and Credited in My account & my father transferred in his father's account. he has partnership firm too, in which he earns 15k to 20k Monthly. He accepted to LIC agents that he comes in the bracket of 30%. & he said to his uncle that he earns 1 lac per month, why would he be interested in my salary, but he has asked thrice to give my salary to him.
They had expected Cars & two Wheelers from my father in wedding. but as they dint even show any affection towards me in wedding & before wedding for festivals customs, I dint take two wheeler with me. so they started fighting within 20 days & finally my husband put condition that if i follow only what he & his parents say, then only he wants to continue our wedding, which i disagreed to. After that he bought car for which he is saying that he bought for me.
I left with my father & then tried to convince him that our relation is of emotions & feelings, kindly take back ur condition, we need to give time to each other in June, October and Feb, 14 I went to meet him. for patch up. I do have proofs of all the things.
Now his parents & they are saying he earns only 21K. & in this his boss has interferred by providing him false salary slip. Moreover they havent given my jewellery till now. which we tried to ask them thrice. Now i want stridhan, Alimoney & want to file case on his boss Mr. Mayur Parikh working with Corporate Strategic Allianz Limited at Ahmedabad. to assist him to prepare forged Documents & present the Same. & my father in law told my father that he has cash for car but my husband isnt agreeing to buy from cash so he is taking loans. Unfortunately i dont have proofs of his earnings. once he showed me cheque of 45,000 after deductions of TDS from his salary.
I want to file forgery case first.

SIR, I AM FIGHTING 125 CrPC CASE IN PERSON.CAN YOU PL KINDLY TELL ME ABOUT THE THE PROCEEDING AS AFTER THE CASE I HAVE FILED MY REPLY AND MY WIFE HAS FILED COUNTER REPLY AND LATER SUBMIT HER AFFIDAVIT.NOW
1. WHEN I CAN DO THE CROSS , AND WHAT ARE THE TYPE OF CROSS.
2. I HAVE SOME DOCUMNTRY PROOF THAT SHE HAS DESERTED ME, AND I WANT TO SUBMIT THAT IN THE COURT , SO BEFORE CROSS I HAVE TO SUBMIT OR AFTER CROSS.IF I WILL SUBMIT BEFORE CROSS. THEN SHE MAY CHANGED HER STATEMENT.
3. THEY HAVE ALSO NOT SUBMITTED THE LIST OF WITNESS CAN ASK THEM TO SUBMIT AND THAT IS BEFORE CROSS AND AFTER CROSS.
4. THEY HAVE SUBMITTED SOME MEDICAL PAPER OF PRIVATE DOCTOR, CAN I REQUEST COURT TO CALL AND CROSS THAT PHYSICIAN.
5. I AM SURE THAT IS SERVING IN A SCHOOL BUT VERBALLY DENYING, CAN I ALSO MAKE A REQUEST COURT TO CALL THE SCHOOL ALONG WITH THE RECORD, ONLY ONE SCHOOL .
6. WHAT ARE THE CrPC AND EVIDENCE ACT CAN BE USED IN 125 CASE CONNECTED TO WITNESSES AND EVIDENCE,KINDLY LET ME KNOW .

I have been physically and mentally tortured by my husband and his parents since last three years after my marriage and it became brutal when I was nine months pregnant, after delivery I have come to my parental house with my child (son), I am here since last Feb 2014. I have not registered any complain against my husband to the Police,not filed 498 or any other cases only I have made a general dairy quoted everything to the local police station of my parental house.I thought as I have left my husband he would realise his mistake ,he would change himself but there is no change in him,he has not taken any care to me and our baby, he has not given me a single rupee for our maintenance. On 9th of this month I sent a registered letter to my husband to come here and take me and our baby back and requested him to rectify himself other wise our relation will not be lingered further. He gave me reply, denied everything ,said he never bitten me,raised falls alligation against my parents and he will not come here to take me and our baby son, if I want to go he may arrange for air ticket to go to Bangalore as my husband stay there. My question is this " Should I go there with my baby alone? or can I claim alimony? I am sure my husband will torture upon me again,he has taken all my jewellery in his own custody, how can I get it back if I do not go back ? Financial condition of my parents is not good.Please guide me properly I need your legal help urgently as my husband doesn't bother my & our baby sons conditions.

please let me know how to face the following problem,
i have chatted with my friend (girl) in a face book a month back and the conversion is made one month back and the conversation is as follows,
hi, after a long time, yes, i love u, i know, ifu, ok,
this is what we have chatted to geather only for fun,
but his husband to whom she has already sent the legal notice for divorce, hacked her face book account and entered into account and copied our conversation,
and now he is threating me that he is going to put a case on me on the ground that i am disturbing his marriage life,
i dont know what to do,
please advice me in this regard, what i have to take necessary steps, and i already complained to her regarding this and she is saying that when problem comes she will help me regarding that,
is her help will be helpful to me to face the situation,
please advice me!

My wife filed 498A and many other criminal cases against me and my family members after 9 years of peaceful marriage. We were a nuclear family & never stayed with our parents. We never had any issue which warranted any family intervention. The sequence of events was as follows
1.In may 2012 i found her talking to some office collegue at 8 am before she left for office. The next day again the same guy called at the same time. On asking she replied that he wanted her to go to office on his bike. I called him and asked him not to disturb her. One week later i saw an incoming call on her mobile from the same person. No other activity regarding this person came to my knowledge later.
2. In june 2012 she closed the bank locker & kept all jewelry with her.
3. In july 2012 she convinced my to give her money to put in fd's since her bank was offering better interest rates.
4. In april 2013 more money moves from my account to her account & again get converted into fd's. Total amount reached 15 lakhs.
5. In may 2013 she wanted to get through a cosmetic operation because she had a lipoma on her right neck. she said after the operation her neck will look beautiful.
6. left me in aug 2013 when she recovered & left me with all jewlry & money. spent 1 hr on phone and called her bank 8 times to change her address & other details and took complete control of her account on the day she left. This account had all my money.
7. filed dowry case in sep 2013 and other cases of threatening, wrongful confinement and what not. A seperate case for 406.
8. i filed sec 9 but she refused court summon.
My in laws did not take any call from me. my wife has changed her no. and have never spoken to me since she left. needless to say that i have not spoken to my child.
They are not revealing anything but through common friends i came to know that FIL only talk about maar peet and sending me to jail. They put different false allegations in front of different people. No consistency in their allegations.
I met her cousin brother in Kolkata who is a CA. I asked him about the true problem and he replied - ego problem. Later he said 'she hates you.Why don't you give her divorce'. They filed criminal cases of such magnitude for such reasons. One of my relative who is falsely implicated hardly met us in last several years.
I am deeply concerned and sad about their attitude and lack of communication for last 9 months.
She gave us cheques against her dues which is kept with me.
I want the experts to guide me whether i should file cheque bounce cases on my wife & include her family in order to bring her on talking table. I just wanted to defend myself but they are going too far and filing baseless cases and are defaming me by spreading lies about me. She has taken loan from me in her account(15 lakhs) and I have cheque from her. Please guide me whether this case can bring them to the talking table at least. I know it is better to defend but they are being misguided into filing multiple cases and I had strong suicidal tendencies because of the trauma of losing my wife & daughter and seeing my old parents suffer. It is very difficult to resist filing counter cases & try to solve the matter.
Kindly give your valuable inputs.

A will deed executed by a person in 2002 and got registered . every body knows the same in the family. now ,one of the family members filed a case stating that will is not known to me and not binding on me.is it tenable experts.please clarify.

Dear Experts,
I am father of bride.My daughter was engaged with groom one month back in presence of all our relatives.It was done with interest of bride,groon and our both families.I spent two lacks for engagement party and given 2 lacks to groom's family for marriage expenses with my interet as per marriage discussions in presence of relatives.
But now i have dropped the marriage before one week of marriage due to some of my own family issues.
I said the same to groom's family.They are very upset as they already informed and distributed wedding cards to all their relatives.
Now i want to ask them to return my engagement expenses,engagement ring and two lacks money.If they will refuse the same, can i file any case against them for my money?Pl suggest.

Hello All,
Regarding DV ACT:
1.I have taken the certified copy of the Domestice violence complaint.
2.she has prayed for 18,19,20 & 22
3.As a aliomony she has claimed Rs.10000000.00(1 crore)+2400000(24 laksh).
4.Myself and my parents we don't have any property and am having only one two wheeler in my name and my salary and my parents are depented on me.
5.In c.r.pc 125 she has claimed Rs.2500000.00 and 35000/month.
6.She is a B.E and M.S(U.S.A) graduate,she is having own house and accused of Cyber crime case .
7.After filing 498A ,Divorce and maintance case ie after 11 months she has filed Domestic Violence case.
8.And recently they have filed case against me ,my brother in Law and my uncle in Cyber crime to the same Inspector who was arrested her ,Inspector he start to threaten me and I have approached High court for Anticipatory Bail for all three ,when the court enquired the police is said the complaint given by my father in law is clsoed same we have got as a order.
9.here my query is:
- is the law is saying that husband need to give Lumsom amount in maintance and DV act?
- As per my understanding law is saying husband has to pay maintance every month only am I correct?
- considering all the above factors please tell how I can defend my self?Every where they are using their money power even when the 498A matter is in the court police is calling me for enquiry and harrashing me ?what should I do in this situation?

Divorce due to mental illness
Dear Members, wanted to know if the husband develops mental illness like schizophrenia after 2 years of marriage. What happens if the wife puts up a divorce case on those grounds. Is there any provision of law that after 1 year has passed if person develops mental illness divorce is not granted.
Wanted to know whether will the divorce be given easily in this case or is there a way to defend the marriage legally.
