Dvc - trial

HI All,

Background of the case: 498A and DVC cases have been filed on me, mom, father, brother. R-1,2,3,4 respectively

498A trial has started and cross questioning of witness is going on.

DVC - My brother has applied for Quash in high court and got a stay order until further orders as complainants have not responded to high court. Currently DVC is getting adjourned for last one year because of the high court stay order. Now the complainant asked hon'ble session court judge to keep my brother seperately and continue with trial for rest others.

Now my questions are :
1. Can court allow trial for R- 1,2,3 and R-4 seperately?

2. If allowed , It will be waste of time for both court and Responsdents for seperate trials as R-1,2,3 should again attend trail of R-4 ?

Thanks in advance,

False signature on divorce paper

SIR,I WAS DIVORCED AND GOT REMARRIED WITH THE DIVORCE LADY IN 2012. SOON AFTER THE MARRIAGE THE STARTED DEMANDING THE MONEY TO RESOLVE THERE CASE AGAINST THEM. THEN I CAME TO KNOW THAT HER SISTER-IN-LAW HAS ALREADY FILED THE CASE OF DOWRY AND DOMESTIC VIOLENCE ON MY WIFE, MOTHER-IN-LAW, FATHER-IN LAW AND BROTHER IN LAW AND ALL OF THEM WERE ON BAIL. THEY HIDED ALL OF THIS. WHEN I DENIED TO GIVE ANY MONEY THEN THEY FILED FALSE CASES OF DOWRY AMD DV AS WELL AS 125 FOR MAINTENENCE.
RECENTLY I HAVE COME TO KNOW THAT MY WIFE;S DIVORCE TOOK PLACE ON FALSE SIGNATURE AS SHE HAS NOT SIGNED ON HER DIVORCE PAPER, IN PLACE OF HER, HER MOTHER HAS SIGNED AND THEY GOT EX-PARTY DIVORCE. CAN I PROVE THAT SHE TOOK THE DIVORCE FRADULANTLY AND DONE FRAUD WITH THE COURT. AND HOW I CAN DO THIS.KINDLY LET ME KNOW.
1. sir what happened if hand writing expert says that it is not her signature but she says that it is her signature.
2. actually she never come to court her mother has made her signature, because that signature is matching with her mother handwriting.

Is nullity mandetory for a marriage

Hi
My cousin(Girl) had a arrange Marriage to a person who was already Married and having a 1yr daughter that time in JAN 2008.
In 2010 we filed an FIR with case of fraud with the relevant documents of first Marriage.
In 2013 APR, We filed another case for Divorce/NULLITY where the person has given his statement that he was all ready Married at the time of second marriage and yet judge is giving dates.
Now we have the copy of that statement certified by the court.
Pls advice if NULLITY is technically required for the fresh marriage. Or if there is any kind of permission required from the court for performing girl's marriage as we would not like to go into any legal hassles.

And pls also explain why nullity is important to be taken from court. Does it compensate in financial terms as well.

Regards

Informatory petition

Good Day sir,
I wish to say that my wife(married since 4 years) is currently staying with me but we had a huge fight since she was feeding me something ( may be some "Prasad" or something else) which I noticed and also i recorded her mobile call talking to her mom where mom is advising her how to mix that substance into water/milk/food. Recently after coming from her "Mayka" she
had some fight on this issue and then she was leaving the house in the evening time which we did not allow and I called her father that he must take his daughter to his home as this kind of drama will not be
entertained. Then the next morning her dad called me and told me that do not harrass my daughter and she has left behind 3 letters on 3 dates and falsely narrated that we have been harrassing her.Later next day her father came and we discussed all these things and I mentioned all these
happenings and I said If she had feeded me that so called "Prasad" or in my term "slow poison" by making me aware, then this situation had not come only. All these phone calls and discussions are recorded by me.For ur information we have a kid - 1.3 years old.

My query -
1> Is it possible to make a informatory petition in the court of CJM ?

2> Will it safeguard me in case if she makes a false case against me e.g.
domestic violence or in the worst case of suicide(very very less likely!!!!)? I can vouch that there is no domestic violence attampted against her till now and will not even in future.
3> Will these recorded phone calls and discussions be of any help for me in case of any bad legal situation?

please advise.

Like to move to appeal against lower family court set aside order in high court.

Respected Experts,

This question might found to be a repeated one, but please i urge you all to reply me.

I got married on october 15th 2010, my wife left with in 15days of marriage without reason.

I filed Nullity of marriage under section 12 (1) (a) as per HMA in 2011 feb. In reverse she filed counter in 2012. But in her counter she stated nothing neither Restitution nor Divorce., she simply said all my petition statements are false in her counter.

My wife stopped attending court, i urged judge to give exparte in favour of me, judge has accepted and gave it.
In return she filed setaside and judge gave ORDERS in her favour that accepting her setaside petition where the reason in her statement is she got absent due to bus which she was travelling got struck in traffic jam, I wonder here why judge didnt asked her why she got absent prior before to ex parte order 4 times in a row,

My actual question is I would like to challenge in High Court against lower family court SETASIDE ORDERS. Please help me, BY WHICH SECTION and clauses I can file a challenge against lower court orders.

PLEASE HELP ME by which section and clause i can challenge in highcourt against lower family court setaside orders.

I know that some of you experts say its waste of time in challenging it, but please help me out by which section i can file the case in high court against lower family court
Orders.

Awaiting for favourable reply.

Thanking you
