Hi. I have been married for the past 2.5 years. I now have a 1.5 years old boy baby. And I am planning for a divorce now because of my wife's behavior. If I go for divorce, my baby will be with me or with my wife? Also, do I need to give any money to her as settlement? If so, how much?

sir my wife live separate since 10 june 2013 till now
we married in 24 june 2012. on 4/2/2013 i and my wife was left my parents home in between she is pregnant for 4 months my father debarred me from his all property in march 2013, after her parents knows this that my father is debarred me from his property she left me on 10 /june 2013 with his father and relatives and also in presence of police from my rental home. after that she filed first complaint in women commission on 14 june 2013, and second she filed another complaint in caw cell on december 2014 ,after that fir been registered because any settlement not ,she also file dv case 498a 406 34 and 125 crpc
i was also filed a case rcr in july 2013 ,
in dv case she awarded maintenance rs.4000 and 2000 for her boy child, in my case rcr she was attended any date except her parent and her lawyer on april 2015 i decide to file divorce because she can not ready to join me .
sir my question is she spoil her life because of her parents but i want marriage again because i am still living separate from my family at rental accommodation her parents tell me that she cannot give me divorce in any way and whole life she is live with her parents so
my question is that there is any other way atleast one way for i marry again
if i m hindu there is no law for second marriage if i change my religion in other caste like muslim or chirtian etc.

Does mutual or verbal separation requires any agreement or legal proceedings ?

Dear Sir,
My husband file a divorce case last 3 year but still is pending in court.
In Mumbai city i file against husband & family DV case...this case still pending in court.( Hearing is going on )
I got information against my husband relative - My husband searching Girl for second marriage without divorce.
also they inform to relative - If any policy arrest them they have ready to maintenance both the wife & take a bail from court.
My question is -1. It's possible to do without first divorce second marriage.
- 2. Indian law allow to Husband maintenance both the wife together ( I am Hindu ) Without my permission.
- 3.Can i take any Action now against my husband - Before the Second Marriage.Can i inform to Police or anyone.
Please advice me.

Sir,
My wife filed dv case on me and my mom. She is getting maintenance from 125 and with dv she has prayed for maintenance ND return of stridhan. Only told mental cruelty and for dowry she alleged. No date and time mentioned. And she is working Whr as in affidavit she said she is not working. I hav to give reply of that petition. What prelims. Objectionals I should file. Plz help me.

MY WIFE IS THREATENING ME FOR LODGING A CASE OF DOWRY/ DOMESTIC VIOLENCE. IN 2014 I HAD LODGED A FIR AGAINST HER AS SHE HAD BEATEN MY MOTHER AND MAN HANDLED ME AS WELL, FURTHER I MENTIONED THAT SHE CAN FILE FALSE COMPLAINT FOR DOWRY OR DOMESTIC VIOLENCE.
HOWEVER POLICE HAD NOT ACTED. NOW WHAT SHOULD I DO IN THIS SITUATION, SHOULD I GO TO POLICE TO PRE INFORM THEM OR SHOULD I TAKE LEGAL ADVICE OR IS THERE ANY HELPLINE FOR VICTIMIZED HUSBANDS.

Protection against wife's wrongdoing on transfer to usa
I have got a job offer in USA for an IT firm.
I got married 2 years ago in 2014. The relations between me and my wife are not good. She constantly fights,abuses, me. Always keeps on giving threat of committing suicide or implicating me and my family in false 498A case.
I want to be legally sure and protected before moving to USA for both me and myself.
WHat are my options? How can I protect us from this false usage legally?
