my wife file a case on me of 498 on that time when i was on bed according to doctor
in oct 15 police arrest me and take me court in ambulance. then court grant me bail. after that my all family members break all relation with me and i lives in a orphan house in my city .
she files case in her district and i lives in other district. from oct 15 to todayjuly 16 i have no idea of my case because nobody is engage with me from oct.
and i am unabe to stand proper due to spinal injury.
and today i came to know that court has release a arrest warrent for me. but nobody had come to arrest me.
kindly suggest me what should i do
because i nobody is with me.
even i am helpless.

Hello,
Need a Suggestion on the maintenance case filled by my Father. He has asked for a Monthly maintenance stating he has no income. But we have identified two bank accounts, one in HSBC and other in kotak mahindra. But we don’t have the account number or any other details. What is the procedure to get the bank details of the two banks. He is not living with us. He has been having a extra material affair and moved out. Of late he has shifted the house and we are not aware of his new location. But to the Court he is stating he continues to live with us and is not having any affair and wants maintenance. 2) Is there a way to track his mobile network and produce to the court that his number is not in our Home location at night and he is living in other location. What is the procurement to get the details of the location from the Phone Network?
Please Advice if there is any other possibility too

आप सभी प्रबुद्ध जनों से मैं जानना चाहती हूँ कि रिजेक्शन ऑफ़ केस के क्या मतलब है?
उपरोक्त शब्दावली मेरे एक केस से संबंधित है जिसका विवरण निम्न है.-
महाशय, मेरे भाई की शादी 2013 में हुई पर दुर्भाग्यवश लड़की ने एक-दो दिन बाद ही बड़े ही शर्मनाक आरोप (नपुंसकता) लगा कर नैहर भाग गयी तथा माइके के जिला अदालत में प्रताड़ना का मुकदमा दर्ज करा दिया तथा विवाह में शामिल सभी सम्बन्धियों को आरोपी बना दिया, जिसकी जानकारी हमलोगों को लगभग एक साल बाद हुई जब घर पर पुलिस पहुँची | इस बीच हमलोगों ने उसे मनाने की लाख कोशिश की कि वह ससुराल लौट आये | खैर जिसका मुख्य मकसद महिला अधिकार कानून का दुरूपयोग कर पैसे वसूलना हो वह कब लौटने वाली थी ? खैर हमलोगों ने बड़ी ही मुश्किल से जमानत हासिल की | इस टेंसन भरे माहौल के कारण मेरे पिताजी को लकवा मार गया तथा एक भाई का निधन हो गया | ये शादी हमारे परिवार के लिए एक दुर्भाग्यपूर्ण घटना साबित हुआ | ये मुश्किल वे ही लोग समझ सकते हैं जिन्होंने इन कुख्यात कानूनों का सामना किया हो | इन अप्रासंगिक कानूनों कि चपेट में न जाने कितने ही परिवार नष्ट-भ्रष्ट हो गए | ये कानून न आदमी देखता है और न औरत, न बुजर्ग और न दिब्यांग और न ही profession (पेशा) और न ही निर्दोष | खैर तीन साल कि लम्बी लड़ाई के बाद जज महोदय का फैसला आया कि लड़की यदि आपके भाई के साथ नहीं रहना चाहती है तो उसे शादी में हुए खर्च का भुगतान करें तभी वह तलाक देकर आपको मुक्त करेगी | यह सत्य है कि दहेज़ रहित शादी होने के बाबजूद हमने जज महोदय के आदेश का सम्मान करते हुए हमने तीन लाख पचास हज़ार रूपये जमीन-जायदाद गिरवी रख कर तथा DD बनाकर कोर्ट में जमा करा दिया | इस बीच हमने दो बार जज महोदय के आदेशानुसार उक्त DD को renew भी करवाया | फिर भी आज तीन साल होने को हैं पर कोई स्पष्ट नतीजा नहीं निकला है | थक-हार कर हमने जब सर्वोच्च न्यायालय तथा उच्च न्यायालय तथा PMO कार्यालय से अपनी दुःख भरी आपबीति सुनायी तथा जल्द फैसले का अनुरोध किया तब जाकर अचानक से लड़की द्वारा दायर केस (दो में से एक केस जो तलाक का था तथा जो कि फैमिली कोर्ट में चल रहा था ) कोर्ट द्वारा "रिजेक्ट करार" दिया गया |
अब यह शब्दांश मेरी समझ में नहीं आ रहा है कि ये "रिजेक्शन ऑफ़ केस" क्या है ? तथा उक्त केस के सन्दर्भ में इसके क्या मायने है ? जबकि मेरे द्वारा नियुक्त वकील महोदय कह रहे है कि अभी आपका केस खत्म नहीं हुआ है ; दो-दो केस अभी भी चल रहा है | उनका कहना है कि सिर्फ फैमिली कोर्ट का केस खारिज़ हुआ है, क्रिमिनल केस अभी भी चल रहा है जबकि फैमिली कोर्ट के नव नियुक्त जज महोदय का कहना है कि चूँकि केस चालू हुए अठारह माह से अधिक गुजर गया है और इस केस में मैं कोई फैसला नहीं दे सकता इसलिए "फ्रेश चार्ज फ्रेम" करना होगा | मेरी समझ में नहीं आ रहा है कि कौन सही बोल रहा है और कौन केस को उलझा रहा है? एक जज साहब ने जब पूर्व में फैसला सुना ही दिया है तब फिर से "फ्रेश चार्ज फ्रेम" क्या चीज है तथा इसकी क्या उपयोगिता है ? क्या लोगों को तंग-परेसान करना ही लोगों का काम रह गया है, मैं समझ नहीं पा रही हूँ |
हमें तो इन मुकदमों में पारदर्शिता कि घोर कमी दिखाई देती है और लगता है हमारे देश में कानून का राज न होकर भ्रष्टाचार का राज बन गया है | आम आदमी एक अदद न्याय के लिए बर्षों तक कोर्ट के चक्कर काट-काट कर थक चुका है फिर भी उसे न्याय हासिल नहीं हो पा रहा है | आम टैक्स पेयर के पैसे पर जिनके बल पर आज सारी वैधानिक संस्थाएं चल रही है; वही टैक्सपेयर भीखारी तथा गुलामी जैसी जिन्दगी जीने को मजबूर हैं ; लगता है अंग्रेजो का राज्य अभी ख़त्म होना बाकी रह गया है | लोकतंत्र का राजा रंक तथा रंक ; राजा कि भूमिका ले लिया है | आप लोग प्रबुद्ध जन हैं तथा हमसे ज्यादा इस तथ्य को महसूस कर पा रहे होंगें | हमें लगता है हर प्रबुद्ध भारतीय को इस तरह कि कार्यशैली से शर्मिंदगी महसूस होती होगी पर क्या करे सारे विवस हैं खैर देर-सबेर आने वाले दिनों में यही प्रबुद्ध भारतीय बदलाव के जनक बनेगें, हमें ऐसी उम्मीद है | एक गाँधीजी ने अंग्रेजों को खदेड़ दिया था तो आपलोग 3.5 लाख गाँधीजी हैं क्या आप अंग्रेजीयत को नहीं खदेड़ पाएंगे ? हमें उम्मीद है आप लोग अवश्य बदलाव के जनक बनेंगे |

Iam a 52 years retired army person . iam married a girl sine 1984 September 9th . living with her up to 2001. She is a state government employee. Our marriage is not in registered. But my entered her name in my service record . two children's me. One son and one daughter. Son is 30 years he married .daughter is 36 years and she is married . we are seperated in 2001. After five years iam remarried and this married is registered . now my old wife is complaint through Kerala women's commission for my property. What can I do please help me.

My one neighbour 50 yrs. widow is suffering from domestic violence by her in law since long. Her husband died leaving 03 daughters, 15 yrs ago. Under that circumstance to have family support for sake of her three daughters she started living with her in laws and under compulsion she also handed over whatever movable and immovable property she had to her younger brother in law. Who sold her property subsequently. Now her all daughters have been married and her younger brother in law also got married. Now problems is that her younger brother in law do not want her stay with them. she is being thrown out from house by her in law to live with married daughters now. Day and night they are quareling. She do not want to live with married daughters and reluctant to tell the fact to them for the sake of her dignity. Most often I have given shelter to her. She is making mind for legal fight. Is there any legal remedies available for her.

My husband after a big fight left the house at his own will two months back, after which he got an email written from the landlord to vacate the rented house in one month and forwraded me the same. I did not pay heed to it and continued staying there with my 2 year old son.some days back my husband along with a police constable came home and threatened me to vacate the house without any court order. The police constable said the landlord had sent the police to ask me to leave.
I have filed a complaint under 498a but no action has been taken yet.
I am also getting calls from some landlords lawyer who says if i wish to continue staying in the property i must pay rent and renew agreement on my name else they will take legal action. I do not have the money to pay rent as for last 3 months my husband has not given a single penny even towards sons expenses and am managing all expenses from my salary.
Questions:
1. can my husband be asked to pay rent for the house through any legal process, the rent agreement is in his name which expires in august?
2. The landlord has 10 months rent as deposit and hence can he keep deducting rent from that deposit amount after expiry of lease period also?
3. If the landlord files an eviction suit, on who would that be: me or my husband? and who will be asked to clear all rent dues to the landlord?
4. The landlord initially helped my husband in his motive to remove me from the house by sending false emails that he needs the property, sending police to scare me etc. Can i take any legal action on landlord and my husband?

My husband slapped me twice and tries to hurt me physically. I was staying with my husband. Last month he beat me and sent to my mother's home. I don't have any proof of his physical attack. Can I take legal step. But if I go against him can I stay with him. As iam traditional person I don't want to leave him. My parents will be worried. Similarly my inlaws are brain washing him to hurt me everytime and his mother is abused my mother over phone. I just want to warn them by sending legal notice. So that they will not be able to hurt me in future. I want to live with my husband I don't want divorce.

i am fighting a case u/s 498a in sessions court rohtak.my present consel is pressurising me to have a compromise and he is threatening me to get my present sureties(jamanatis) withdrawn if i dont compromise with the other party.if the present sureties are withdrawn then what options i have to present as sureties to get my bail regularised.

Request for advice- Divorce and Maintenance Cases
Hello Everyone,
My husband is avoiding the divorce summons and not attending the court. I have applied for divorce in Oct-2015 and the first hearing has started from February 17, 2016. As per the last update, the summons were not delivered as there is no person found with that name and house address. This is completely false, I believe that they are managing by offering bribe because it is their own house where they reside. In the last hearing our lawyer had requested Judge for steps and not sure on whether he will approve for paper advertisement or hand over the summons in the next hearing.
Maintenance: Respected court has granted the maintenance in June-2015 but until now I was not paid anything. I have tried sending letter and email to his Company HR requesting to provide my husband's salary details/ payslips but did not get any reply from his Company.
Recently I came to know that the Supreme Court had passed an order not to keep any family case pending for more than 12 months and to finalize the case. Please let me know if this rule has come to existence in Andhra Pradesh.
I request you to review and suggest on how we can trace if he has shifted the house and changed his current Company.
Highly appreciate if someone can suggest me on above cases!
