Divorce on mental cruelty

Recently I have filed divorce on mental cruelty ground. I have a son of 12 yrs old. Will it help if my son agrees that what I am saying against her is true infront of the judge? Will it help if my son wants to stay in my custody? How can I bring back my car registered in my name from her?

Domestic violence act

Hello..

As I am a fresh Law graduate and into practice since last 2 months. I am the counsel from the girl side.

Girl filed a case under Domestic violence Act before the court and is in pending condition. The reason behind this is that the Husband of this girl had filed the divorce petition before the court to make the marriage NULL & VOID. The reason husband has mentioned in his petition that the girl is mentally ill, but NO PROOFs yet.

Now the domestic violence filed by the girl is on hold as the court says that once that divorce petition must be decided then only this domestic violence case can proceed.

query..
Is there some kind of rule regarding the above mentioned condition.

What sort of relief can be granted to girl/wife

File suit against the cheating parties

I have been married for 9 years with two kids . It was a love marriage but since 7 months my husband had an affair with a manipuri female n has now left me and my kids and living with his parents. He soon will start living together with her.I want to know my rights to get financial assistance for raising my two kids and what action can i take to make them pay for what they did to me emotionally and physically.

Divorce on grounds of cruelty and fraud

Dr. Dev and dr. Vinay were married in 2007. They have 1 kid together. Before marriage vinay's father wrote a letter to dev's father telling him that due to some health issues vinay suffered mental illness but was fine after her treatment in apollo mental hospital and that this could be enquired about from the hospital itself. Dev's parenta enquired about the same from dr. Sanjeev from the hospital and their marriage was fixed. In 2009 dev and vinay went to a wedding in delhi where dev met mr. Akshay, a psychiatrist who enquired about vinays behaviour bh saying that he wanted to diagnose her and also write a progressive report. He also wanted some sittings with her. On asking she refused. Dev went back to his hometown and after some days vinay went to her parents home. Dev didnt contact her. Vinay tried to contact him but that was of no use. Vinay alleged that dev was trying to trap her by saying tgat she is mentally unsound. In 2010 dev filed a petetion for divorce on grounds of mental cruelty and fraud. I need arguements from vinay's side. Thanks.
need to frame issues as well as arguements from vinay's side. Of what i have thought is:
1. Whether the plea of the petetioner againts the respondent of mental cruelty is maintainable?
2 . Whether the plea of the petetioner against the respondent on grounds of fraud maintable?
3. Whether the petetion for granting of divorce liable to be set aside?
4. Whether the petetioner did wrong towards the respondent and actually tried to frame her?

Additional information: that i forgot to mention was that when they got separated after attending the marriage vinays father recieved a letter from a relative stating tgat i am very happy that all the relatives are laughing at u and ur daughter. I know ur son in law very well.

Husband got second marriage without divorcing me the first wife

Hi Sir/Madam,
My Husband got married in feb 2016 without divorcing me. My father filled a FIR aginst him in my home town and I filled case against him But police doesn't take any action against it. What can I do in this situation? Please Help.

Custody of 1 and a half year old child

Sir I have an estranged relation with my husband he abuses me and my parents Our marriage was solemized as per Hindu rites I left his home and I am living with my parents and I have a 1.5 year old son who is living with me
Sir I wish to get his custody
Some people were suggesting me that you cannot get custody without filing for divorce or judicial separation as there can be no separate suit for custody
Sir under which Act should I go for custody Hindu marriage act Hindu minority and guardianship act
I do not wish to give him divorce kindly help

Section 151 of cpc order 1 rule 1

I have married on 01/06/2014. on 03/06/2014 my wife said that we was married forcefully by his parents he love with a other caste man. as per his willing on 07/06/2014 we "notorised" a tlaknama and also filled a 13B mutual concern in family court which was rejected on the basis that it is not completed one year sepration period. her parents and brother sister beaten her in my house. finally on 07/06/2014 she went with her uncle. as per lawyer advice i have not done anything till one year than my parent with some relative went her house for mutual consent divorce. her father threateing us for false case and abusing us. after lawyer concent on 15/06/2015 i have filled divorce case but till date 07/07/2016 she not filled answer of petition and taking time again and again.than she filled a case for 125 with interim maintanance. i have replied for interim maintanance. than she filed sec 24 application against divorce. and also her lawyer filed section 151 of cpc rule 1 order 1 to make her lover a pakshkar in case and reject the divorce petition. in above circumstances what will effects of sec 151 of cpc on divorce case. on 07/06/2014 when i filled first time 13B and customary divorce she accepted with her lover name relation with him and wants to divorce on this ground. there is her sign and thumb impression on both. pl clear effect of sec 151 of cpc on above case. will court reject my divorce petition on basis of sec 151 of cpc

About interim maintenance

sir i am petitioner in section 9 i filed a case against my wife in july 2013 ,after she left me in june 2013 after that she filed 1st complaint in women commission , i joined there also but she was not come in the court instead her father and lawyer.after theat she filed another complaint in caw cell ialso joined there ,after that she file complaint in pwdv act karkardooma court in this court ms principle judge mm court decided interim maintenance 4000 for her and 2000 for her child also i accepted in between her lawyer also file section 24 application in the family court in my case of section 9's reply with that .
so now family court judge also pass an further interim maintenance order as rs 6000 for her her and 2000 for her child
so now my question is when i filed section 9 case against my wife there is not single evidences filed by me and my wife also ,in april 2015 i withdraw my section 9 case in family court because she was not interested to join me then i file divorce case sir my further question is if mm court already passed an interim maintenance order to kya family court bhi section 24 me order pass kar sakta hai ki nahi jabki me already section 9 withdraw kar chuka hu kyunki section 24 bhi to meri wife ne mere sec 9 ke case k sath hi to lagai thi to kya section 24 ki application bhi pending rahegi jabki mene section 9 pehle hi withdraw kar lia argument se pehle hi.

sir meri pareshani ye hai ki me 6000 k hisab se ab tak 168000 pay kar chuka hu meri wife ko ab meri wife ne 8000 ke hisab se execution file ki hai family court me ab waha judge madam ka kehna h ki ya to 6000 k hisab se jo apne pehle pay kia wo to de dia ki nahi mujhe nahi pata me us order ko nahi manti jaha jana h jao kahi se bhi lao jan 2015 rs 8000 ke hisab sare payment clear karo 10 october tak pay karo nahi jail jao.sir pl help me what can i do now pls help me
as soon as possible sir with sufficient judgement for my help.

About interim manitenance

once the interim maintenance was decided by the metropolitan magistrate in pwdv act is the further maintenance order was passed in sec 24 by the family court also.

i was paid already 162000 as interim maintenance to my wife from 2013 till now but now family court also pass an interim maintenance in sec24 is this maintainable or not because i am not able to pay more to my wife and her child because i already pay 4000 for my wife & 2000 for my child, now family court judge pass an further order 6000 for her ,AND 2000 for her child , i am not able to pay more because family

pls send me the judgement also .
as soon as possible sir pls help me.
