Dear All
I am a 4th Sem. LLB student from Odisha. Unfortunately I am going through a mental agony due to my family dispute. I married on 05/12/2004 & we have 2 kids aged about 9 years & 5 years (both are leaving with me now). I need your suggestion on the following matter.
1) I had filed RCR on 22/08/16 U/S-9 in the Family Court & my wife received the same her on 15/09/16.
2) Now she has filed a counter case under DV act U/S-18, 19, 20, 21, 22 on dt.31/10/16 which was served to me on 04/11/16. Where she has made party to my Parents, unmarried sister(1) & married sister(1) along with an another unmarried girl, whom she suspects to be affairs with me. She has demanded alimony & maintenance along with the custody of both children. The allegation mentioned in the DV Act, by my wife are totally false.
3) What should I do to get rid off this case. Now I including my parents dont want my wife to come back to our home.
Any query on this regard, pls ask me.

Do the son of second wife son be eligible for a compassionate appointment.his father was a state govt employee with two wives he passed away in 2014.can a second wives son get appointment if all the legal heirs have no objection.

Respected sir, If the wife files false 498a against husband & his family so whether the party has to take bail only once or multiple times and how much period is given in bail and does the bail amount varies with income.

As suject suggests itself, my mother want to stay away from my father.
My father is a rail way police constable.
Their marriage was done in 1984. She got job in 1989 as a primary teacher in Z.P.
We are 3 brothers one is of 30 years old. Mine is 26 n younger is 24.
My father plays cards n casino type games hence loose money many times, when peoples come to us for asking money my mother pays them from taking loan from bank. My father beats her usually.
This above scenario is going on since last 25 -30 years... now we can't bear it anymore pls help us pls pls sir. As we are feeling very helpless

In very brief
I have been ordered by family court to pay interim maintance in both crpc 125 & sec 9 HMA .
₹ 5000 wife + 4000 baby boy
My income is 12-13 k p.m.
My lawyer said this is interim not fix so need. To appeal In . HC ,
My wife lawyer had to give evidence in next hearing for fix this or higher , after that fix maintance we has to appeal in high court .
They also said interim maintenance is fixed by judge with evidence like some online page of my father sole proprietor firm in which I had zero role . secondaly that page is not having any detail info . only written my name and I am Md of that .
Is this is good evidence for interim
Please give some advice

I am transferred to a diff city hence staying away from my wife (who is also working) for last 1.5 yrs but have been sending money each month though she has a handsome salary too. There are compatibility issues between us and she keeps on threatning to file Sec498a if she is not given money, also threatens to commit suicide. I am under tremendous mental torture and want separation. She is staying in my own house which i inherited from my parents and i am staying in pg in a different city. Our 7 yrs of marriage will complete in next 2 months. What are my options?

I am fighting a child custody case. It is expected that the judge will call my son and ask with whom he wants to stay . My son is at present staying with his mother. Naturally he will say that he wants to stay with his mother. He is 5 years 8 months old.
There is concept called “ Parental Alienation Syndrome”. Can anybody give me some good citations where the father has used this syndrome to his advantage to get the custody of the child
