In DVC case petitioner filed MP under petition filed under 20(6) rws 128 section of Code of criminal, as I had not paid her interim maintenance since last 5 years as there was a stay in HC now petitioner has filed this MP to recover the amount, I had already filed interim maintenance modification petition which got dismissed on the grounds that during the evidence stage judge cannot consider evidence of her working status now I m going for appeal meanwhile they file this MP petition filed under 20(6) rws 128 section of Code of criminal can you help how to counter act or challenge the same till I get a order from my appeal

SIR, MY DIVORCE JUDGEMENT WAS GIVEN ON 28/01/2014 AND 3 LAKHS I HAD GIVEN AS PERMANENT ALIMONY AS DIRECTED TO ME BY FAMILY COURT. MY WIFE HAD DRAWN MONEY AND FILED FOR HIGHER ALIMONY IN HIGH COURT OF ODISHA & HIGH COURT HAD GIVEN JUDGEMENT ON 28/07/2016 TO ME TO PAY 25 LAKHS AS PERMANENT ALIMONY TO MY WIFE, WHICH AM UNABLE TO PAY & I HAD FILED REVIEW PETITION IN HIGH COURT ON 29/08/2016 BUT ITS IN PENDING STAGE. MY DIVORCED WIFE HAS FILED EXECUTION PETITION IN FAMILY COURT FOR 25 LAKHS TO GET FROM ME & THE JUDGE IS SAYING TO GIVE ORDER ON 26/09/2017. IN THE MEANTIME I HAD FILED SLP IN SUPREME COURT ON 22/09/2017 & GOT THE DIARY NUMBER. I HAD GIVEN AFFIDAVIT IN FAMILY COURT ON 23/09/2017 WITH ENCLOSING THE COPY OF DIARY NUMBER OF SUPREME COURT. NOW PLEASE HELP ME CAN THE FAMILY COURT JUDGE WILL LOOK THE MATTER IS FILED IN SUPREME COURT & GIVE ME RELIEF & WILL NOT GIVE ANY ORDER PASSED TO ME TO DEPOSIT MONEY AS THE CASE IS FILED IN SUPREME COURT OR I HAVE TO TAKE STAY ORDER FROM SUPREME COURT. Respected sirs,
I am not able to categorized exactly my query comes under which category. it is related to Family matter, Property issue and Civil related.
My query as follows.
My uncle(my wife's father)had so many agricultural lands(more than 70 Acres) and got a notice on 05-05-2010 from Revenue Divisional Office for seeking explanation regarding lands he owned as per Andhra Pradesh Land Ceiling Act 1973. Then on 07-05-2010 he executed a will(fourth and final will) and registered it on his third wife's(first and second wives passed away) children (two sons)and first wife's son. After this process he appointed an advocate and submitted his property details to the said RDO on 15-05-2010.
In that declaration My Uncle mentioned as a family unit and included all the children of three wives total 7(2(D&S)+3(D,D&S)+2(Sons)) and his third wife names by stating that "the said property is not comes under AP land ceiling Act 1973, where all family members are with him and no excess land"
On 11-09-2010 My uncle passed away and later the RDO tribunal inquiries continuing till date.
Recently after 7 years, the first two wives children received notices from RDO and came to know (first time) that the complete case study which i mentioned above.
Now my questions and doubts are as follows:
1. The Will executed and registered is valid or not.?
2.Can we have a right on the said property where our names included and declared as a family member and Family Unit?
3. The third wife selling properties which are in my Uncle's name and pending a Case at RDO Tribunal by showing the registered Will. Is SHE and her sons(one Major & One Minor) have right to dispose those properties.?
4. What is our right and Stand in this Case?
Kindly suggest me to proceed with a proper right.

My brother and his wife are seperated now.
Legally divorced is not yet filed.
they have 3 yrs daughter, my sister in law was a house wife and on certain character issue they got seperated.
Can you guide me regarding the custody of the child in this case?

It is matter of matrimonial dispute and since 2 years domestic violence and dowry case is running in ghaziabad court. I have a son age 2 years and i am myself lookng after him. My husband and his family showed no interest and want to treat as slave to me. Their behavior grew violent wen i was pregnant and forced me to run out of house. In between two yeras, we have tried to settle matter out f court and do mutual settlmnt bt they always step back frm their words. Neither they want to resettle for sake of son, nor they want to give compensation money properly.
Now, my husband has filed mediation in allahabad high court by giving false excuses and got stay order for 3 months for cases hearing. I am doing job and however looking after my son, now my husband is creating problem as he is himself free from responsibilties and creating problem for me to go allahabad.
Please suggest me is it compulsory for me go attend high court mediation? If i dont go, what can happen against me?
How can i get rid of it as my husband is knowingly creating problem.

I have been always a unwanted child for my parents. Emotional abusive situations, Physical Abusive situations were happening with me before marriage. Only younger brother used to get all the attentions. I was under depression and managed somehow my life to survive in this family.
Strong Points:
a. I had a fight with mother after 3 months of marriage and Due to some arguments I ended up shouting on mother. My younger brother slapped on my face due to heated arguments in the family. He shouldn't have done like this because parents are there to take action.
b. I left my home as I was told to separate my kitchen on my dedicated separated floor. I thought these family issues will happen again and again I thought this is not the right place to live.
c. Parents has legally disown me from the property under younger brother influence.
d.. He (My Brother) abused me and slapped me that’s why I left home as I wanted to stay my wife safe. Now I have been blessed with daughter and it would be difficult for me to survive on Rent when I have my parent home available.
e. He calls me and threatens me and abuse my wife and daughter (Newly Born: 27th August, 2017) and say don’t try to come at home as he has done everything to keep me out legally.
f. I am living on Rent with my Wife and Daughter and I want my right. I want to stay in that home.
g. Grand Father already lodged complaints many times in the Police Station for Domestic Violence with him.
h. He (Younger Brother) influences mother to do everything and she does it. Dad doesn’t rule; Mom Rules.
i. All relatives are on my Mother side.
Please show me the way.
Now I have been facing difficult issues living outside home as my Job is also not safe. No financial support

Hi,
I have filed case of maintenance and other family cases against my husband. When I was living at my husband's house he has open my mobile phone without my consent and sent some messages to his mail or phone and now he is using those mails and communication against me in the court. Can the experts guide me that whether he can done this thing lawfully. I mean without my consent he has taken my phone and sent messages to his phone and now he is using those mails communication against me in the court. Is this come under cyber crime, If yes then where i have to lodge the complaint for that and whether any case could be filed against him for cyber privacy

I got married on 12 dec 2016, when i also turned 21 . The guy i married is an indian navel officer and very average looking...completely arranged marriage. His parents dint gave us permission to talk over phn between the period engagement to wedding as they felt we might ended up arguing someday. So even my family considered their point. We belong to typical Rajasthani rajput family.. where meetings or talking with your husband to be is �taboo� . So basically we dint able know each other ... and that was the biggest mistake of my life . We met once for 10 mins with pressence of her other so couldn�t ask him much about him .. he said he like simple life and simple women. His mother mentioned that his son is very lazy, less talkative, conservative (kanjoos). But I accept i felt everyone has different nature and accept him as he is ... thinking that with time we both will accept each other quality and nature.
Eventually i got married in between my final year of college. Because they said this is only date and we cant wait more. So my family had to accept. After wedding their was little hasitation between us as we were complete strangers to each other. And we head to port blair for trip their is felt lil homesickness i am became little annoyed and irritated. Because of tiredness of wedding anf traveling. He is very boring person as he is less talkative whenever he talks it is about something related to science or academics . Then slowly I realised we are very different person as i am kind of girl who more of practical, lively social,adventurous, risk taking, love sport like cricket hockey and like watching Bollywood movies and old songs ... where is he completely contrasting very anti social, just out of tv world.
But I accepted as he is .. but he want me stop socialising, complaining for not to watch sport or any movie. To use phone . If i say something he starts with you have lot of ego attitude and you are very aggressive and every point when i say something. In that trip i became a friends with a couple they were very nice ... so he even fought with me for this reason ... at last day of my trip apologised him for all ... we just need to accept each other they way we are ... not by changing each other .after coming home Bhe told his family and my family about everything happened in his perspective. They blamed me for everything.
So basically he want me change my nature my interest my hobbies my likes dislikes... in fractions of time... and for any human being it is impossible. Although i never had any bad habits like smoking drinking partying. I was so simple . Just happy go lucky types girl .
He went back where he posted in channai base i was with my family as i need to complete my graduation ... he never use to call me or msg me .. but i used to we used tohsd hust max 3 min conversation.
Here his family keep om interfering between us keep telling my family � aap apni beti ko smjhaao� and all . My family also supported him and said do whatever he says . Change yourself .
I tried not to say anything which affects them ...when he used to come bombay for holiday we always has arguments on small small matter ... they dint allow me to study further as I always wanted to do something in my life i was so talented in all fields.
He taunt me for money he gave me one ..after that i have stopped asking him for Money.
He says non relevant thing like � you have terrorist mentality � . You are not kind of girl i wanted . I asked what kind of you wanted he say a villege girl who dont demand and listens to me everytime. I said u would have marry a girl like her.
He fights me for phone in dark , watching tv form near . Caring to different things but he literally fights with me such reasons. When he asks me why u have this if I explain him he is you always have explanations . So basically he want any answers or explanation the kind of he wanted to hear.
This happens everytim whenever we interact . We dont any attachment any affection for each other . And i guess I would never be able to grow any feelings or any soft corner for him .
I have compromised everything because of thIs man my studies my career my hobbies and my passion everything still he is like change your mentality ,look at your ego .
If he takes me somewhere if i say this is long cut yarr that was short cut. Then he is like look how aggressive you are you need to come and go wherever i go or wherever I takes you by keeping your mouth shut.
And this is like a everyday mental torture for me .
When he intracts with he ...he shares that whenever i get late for 5 min i got scolded so i replied � what we can do job hi aisi hai� he like what do you mean by job hi aisi hai and starts arguing. He want me say please for everything.
Before wedding I thought he is an navel officer he would be very broad minded and with good heart . Hence i am completely shattered now. It been 8 month to wedding since then i am crying only he never gave his shoulder to me .
He is multi faced person in front of our family he us like the perfect man intelligent everything. But i am the one who is suffering.
Honestly this torture is more painful then physical one.
I am completely helpless when i shared with my parents they are like these are such a small issue there are some girls who are beaten everyday . There is no one for you accept your husband . So just handle yourself .
I am just 21 year old whereas he is 28 . And they accept me to behave matured. I honestly dont know what to do for him i am still trying to change myself ... he just don�t care about what makes me happy.
Each day is going difficult for me . They are many more things. I am with him just because of my parents. We dont have any compatibility , love , understanding at all .
I domt know what future is gonna be... i am damn scared already.
Please suggest 🙏

How to take stay for interim when wife salaried
From Rti reply I came to know wifes salary.
in crpc 125 main case wife already said she
is government employee.I filed 127(2) to stop maintenance. but as it's just sr/ad stage I get no result till date.wife avoiding main case (crpc125) to get maintenance in execution case.in such circumstances How to take immediate stay for interim when wife salaried to save my hard earn money.May I stop giving interim maintenance? is it possible to exhibit her salary slip in 125(3) execution case to stop interim maintenance.
