Marriage took place in Ontario,canada and register there itself in march 2011. The groom was hindu and lady was christian but the marriage ceremony took place in hindu temple. After one month of marriage groom came back to india and never went back and no contacts with his wife since october 2011.
Please advise under what act a divorce can be file in India.
Whether indian court would consider a marriage between hindu n christian , which took place in canada. If yes, than under what ACT
Moreover, marriage certificate issued in canada doesnot show any act under which marriage is register. How we can find that?
Please advise on above queries

i and my spouse living together in goa for last 6 years. she has extra marital affairs with someone. on 5 august 2017 finally she told that she wants divorce. i have two children (daughter- 6 years and son-3 years). due to this i took her to patna to settle the problem in front of her family. we reached patna on 8 august 2017 and on 9 august 2017 she went to roadside with her mother and abscond. till date there is no any information about her. children are residing with me.
now i request you give me suggestion about jurisdiction of divorce and procedure.

Usually when a divorce petition is dismissed, one has to approach appellate court seeking divorce, in divorce matters appellate court is the high court of the state.
Can a husband file for divorce again in family court on new grounds because his previous petition was dismissed without approaching the high court with same old story?
If yes, how many times can a husband keep filing for divorce in district family court ?
If yes, and once alimony petition of wife is dismissed, can she also file new alimony petition in same family court again and again? or once it is proved in case 1, which got dismissed that wife is capable of working and has source of income, she cant apply for alimony again?
Need suggestion on this matter.

I have divorce case going on for past 10 years. Each time judge gives date for pretitioner cross examination, my advocate tells, lets take another date, opposite lawyer also does some excuse and judge kept on giving dates after dates like this past 6 years gone. Either opposite party senior is not in town, or has fallen ill or has some other case on same day. Sometimes my advocate does not appear.
Finally my cross needs to be done. But my advocate telling, this judge is not good, always in favor of women, let us wait till she gets transferred as vacation is coming for courts.
Now I begin to sense foul play all along.
This is my 5th advocate.
Advocates may give their opinion. How to tackle this problem.

District Court on 05th Oct 2017 allowed our application of interim visitation rights to my third son (Ani) of 6 years old residing with his mother. The other two elder sons 14 years & 10 years are residing with me. Third son was taken from my custody when he was 4 years old by CJM court.
Visitation rights include keeping the third son from Saturday after school hours to Monday morning drop at school.
(1) On first Saturday after the orders i,e on 7th Oct 2017 we went to school to pick up Ani but realized that he was not sent to school that day and there was a sick leave for three days (7th to 9th Oct, the timing which was allowed to be with us).
(2) Then we went to her (wife's) parental home where she has been residing for the last three years. There we found that he was not sick but playing with the kids in play ground.
(3) They (Wife, her brother, her father & her mother) refused to handover Ani to us stating that he is not willing to come with us.
(4) They said that you can take him only if the Child has a "will" to go otherwise they will not allow.
(5) When my two other sons tried to touch Ani, they were intimidated & aggressively threatened by wife's brother
(6) I approached the nearest police station & sought their help giving an application & and a copy of orders from the district court..
(7) Police came & tried to counsel the matter but wife's father & brother reiterated their stand that they will not allow the child to go with us as it is not his will.
(8) when kids were playing kabaddi in the ground, Ani wanted to come home with his brothers but wife was standing nearby & as she heard this, she picked up Ani & went inside the bedroom.
(9) Police has given this report mentioning clearly that they were not allowing the child to come with us as it is not child's will.
(10) Today (on 9th Oct), I came to know that they had taken Ani away from jurisdiction to another state for some of their own function (meaning that Ani was taken away from jurisdiction during the time which was alloted to be with us).
Now my questions are:
(a) what are my options now, how can the orders be reinforced. (My advocate today filed for police protection in the DJ Court).
(b) what can I do for aggressive & intimidating behavior of wife's brother & her father. My advocate advises to approach High Court & initiate the proceeding under "order 39 rule 2a cpc" against these two. (But these two are not a party in the case, the orders are for wife to give child to me during these times. Her brother & father are not mentioned anywhere in the orders.
Kindly help. Please advise

Hello,
My wife recently attempted suicide (at her mother's house) by consuming harpic. She was immediately hospitalized. Since this was a MLC case, the area police took my wife's statement. My wife was in ICU then. She hasnt blamed anyone and has mentioned depression (from her father's death) as the reason. Her father passed away ten years back and since then she has been in depression. She had probably attempted suicide in the past too.
My query is: How can i obtain a copy of the statement. I dont want me or my family to get into trouble if my wife tries something similar in future (though she is very happy with me, she gets depressed every time she visits her mother). if not me, can my wife request a copy of the statment from the police, either through RTI or any other method?

Maintenance/ Alimony
I have 7.5 years of marriage and two daughters aged 5.5 and 4 yrs. Its DV case running now and I didn't found guilty yet.
Is wife entitled for maintenance/ alimony, if:
* I prove via call recording that she tried to make me mentally unstable by giving Vobhooti in meal and conspired with her sister against me.
* I prove that she has an extra marital affair now after leaving my home.
* My income is 50k but after all expenses and litigation charges, I am left with Rs 3800 only per month. How much she can be given as maintenance? My expenses doesn't include child school fee yet.
* Is it valid to transfer the amount online or only cheque and DD is valid?
Pls help.
