Dear Sir
6 months back all 3 cases filed by my Wife
1) day 1 we got Bail from court to all of us
2) in DV case nothing is happening, only dates are postponing
3) CRPC 125, immediately court ordered interim maintenance on me to pay as wife demanded my account statement, Salary slip etc
4) we applied in high court for quash of 498a but we got stay orders from high court so in lower court nothing is happening
Now whatever movement is happening in 125
1) as per order from court, wife asked for details & i provided the same & based on it, interim started & i'm paying from last 3 months
2) i too demanded my wife account statement, ITR & property details on her name, but till date court is not ordering to give & everytime her lawyer is misguiding
As i am aware that my wife has done lot of illegal transactions from her account & in court she told that she has closed her account but from some sources we came to know that before closing itself wife has transferred almost 10 lacs & closed the account & in court she is telling that she has no income & not even sharing property & ITR, my wife was staying with me & not working anywhere still from last 6 years she was filing ITR, from where the income came
Please suggest what action should i take
1) can we apply in high court for same
2) is it right time to apply for divorce
3) as i'm paying maintenance, can i apply for child custody or visitation rights ( child age : 5 years)
any other steps to be taken please guide

Hi everyone mere shadi ko 2 year Complete ho jayge January me meri wife yaha ache se rehti hai aur happily jab mann hota h vo apne mayke bhi jati hai lekin jaise hi jati hai vo mujhse bilkul bat nahi karti ignore karna start kar deti hai aur vo seventh month pregnant bhi hai aur 3 month ho rahe hai vo mayke me hi hai 4 bar mai gaya b use lene to kehti hai nahi aungi delivery ke one month bad aungi reason pucho to kehti hai tabyat nahi thik hai maine kaha b k mai checkup kraunga tab mana karti hai ane se call karo to recv nahi karti msgs ka jldi reply nahi aur khud b msg nahi karti mere family members ne b use bht manaya koi response nahi mila family ke choti choti bato ko leke gussa karti hai jab b mayke jati hai aur har bar ane ke bat karo to gussa karti hai please btaiye mai kya karu mujhe apni wife ke is time me sath rehna hai lkin vo nahi man rahi kya mujhe koi case krna chahiye?

Dear Experts, My wife filed MC against me in Local Court.,concern court given judgement as i have pay @5000 PM., I would like to go to appeal this judgement in Higher Court.,where shall i go.,whether it is District Court or High Court of Andra Pradesh.,
Judgement Copy As follows:- In the result, this petition is partly allowed directing the Respondent to pay a sum of Rs.3,000/per month to the 1st petitioner and Rs.2,000/per month to the 2nd petitioner towards their monthly maintenance. The Respondent is further directed to pay the said maintenance amount to the petitioners on or before 5th day of every succeeding month. No costs. This order shall come into effect from the date of filing of the petition. Plz suggest me this case.,

Hi, in one of the contested divorce cases, the wife has falsely accused her husband of cruelty and demands divorce. The Husband wishes to contest on the grounds that he was not cruel and infact spend lacs of rupees for the wife’s comfort and the wife is falsely accusing him. The husband has all the bills and bank statements in this regard. Now the husband wishes to file a suit for recovery of the amount. What legal recourse is available to him? Can he firsts end a simple legal notice demanding recovery of the said amount?? Or directly file a suit in a Civil Court? Also if the husband wants to counter file a suit for defamation and wrongly accusing him of cruelty, can he do so?

Dear Legal Advisor Kindly see the below case matter and provide the suggestions accordingly. Case History : Wife has filed 498A after 1month filed Maintaince 125 case then filed after 3month DV case. In DV Case without any notice x party order has been passed @ 3000 for wife and 1000 for minor daughter. Once we know the matter we had proactivley attend court and try to collect the records and orders where it was found that wife has mentioned so many false statements as A) I am a corporate employee whose montly salry is Rs 40000/- B) I have 5 car those using for rental service in different office. C) I have a import export business and monthly earnings from this business is Rs 50000/- Then we had aubmitted written objection as 1) rectify or modify the order after seen the originality and all mentioned statement proved by wife. 2) Remove the other accused as they are not domostic relation with me.(other accused are living separate accomodation and their distance is 120km. As per residention certificate , voterlist, and taxation for munisipality report ) Questions :- 1) in 498 case wife has made statement as am jobless since 2month. And in DV and maintainance she has decleared am doing a job and earning salary 40000/- pm. Is it justfy or court can see the originality also wife has to bound to prove her statement?? 2) 498 is still pending for trail and till the tourcher has not been proved , she can eligible for maintance?? 3) in different cases she had made different statement is it good for me or support to wife. Need maximum reply from all advisor to save from greedy women those are misusing the law.

we had applied for 498 a against my bro in law and their parents due to cruelty and mistreatment towards my sister.
During police counselling - He agreed all the valid conditions and promised to treat my sister good. later when case has been moved to lokadalath judgement, he started creating same issues again.
His demands were meaning less and still irresponsible such as my sister should stop talking to her family members, he will not have to do the same with his parents, he will reach late - no one should object. - where my sisters only demand is treat her like at least human being.
we went to Ladies court and applied domestic violence case as well. both cases were in progress. As their response seems to be not good even after these many cases, we want to move further.
now, confused - few people are asking us to apply for Maintenance case and proceed so that they will pay attention and conclude their opinion. other people are asking us not to apply for maintenance, since it is kind of my sisters disinterest and letting know court that she need divorce - which we don't want.
other party is just seeking for divorce without any justice to my sister and we are getting threatening calls from them. Problem is they are going by lawyers advice and we are still fighting alone.
is it recommended to go with lawyer and maintenance case?
is maintenance case means we are interested in divorce?
we want either her husband should agree and treat her as his wife (or) they should get punish and she should get compensated as she is having a 1 year kid.

Hi I am Australian citizen I got married in 2015 November we stay together 15 days after that I came to Australia my wife came to Australia june 2016 after 5 months I catch her with another man in car back seat I made a video this another boy was from Pakistan so my wife and he gave me something in my food but they said it was something black magica my health same day I send her india and cancel her visa after that they starting harassment my family in india they asked me come to india and u will get divorce when I went to india they said u have 2 options 1 is make her permanent residence Australia or 20 lakh RS so I got married in dera Sacha Sauda sirsa no dowry otherwise u can�t go to Australia so they put divorce papers in mutual consent and I said I will pay Money and come back to Australia pls any suggestions what can I do I have to go back 18 October in india for last hearing tnx in advance

I was in Gujarat and after 12 years of marriage I came back to Delhi...I mean my parents bought me back as I was beaten by my husband.i was also admitted in ICU because of stress.I have also records that from last three years I was visiting hospital and none of my in-law side as well as my husband was not at all taking care of me.Now the problem is my neighbours know all this but since I have shifted is it can be possible to take there witness.i have filed case in delhi court as now I am staying with my parents.my husband has claimed that I am mentally not fit and they should get custody of my 8 years old son.I was physically and emotionally exploited my by inlawas and by my husband.Can it be possible that Gujarat police can help me and collect the witness from my neighbours.
