Dear Solicitor, My Brother is an engineer and working in Muscat and he is living with his wife and having a 4 years old son. They are married in the year 2011 in Andhra Pradesh, India.My Brother is from Chennai, Tamilnadu, India & His wife is from Hyderabad, Andhra Pradesh.
Now his wife would like to divorce him to due to financial reason. He lost his job and the income has been stopped due to company business condition. So, she want to divorce my brother due to financial instability through Indian Embassy, Muscat, Oman. She has found an Indian man who is financially strong & business man and ready to marry her. Please advise us how to proceed further to apply for the mutual consent divorce. She would like to marry the other Indian man from Indian Embassy, Muscat, Oman.

I have read the highcourt's copy of Hindu marriage act 1950, available as 4.pdf
The section 5 of the act consists of this line two times;
".....unless the custom or usage governing each of them permits of a marriage between the two"
What does it means

I have to file divorce by mutual consent and he has one son father want to take custody mother agrees for the same. Now question is can I ask divorce and child custody in one application or need to file two different applications.

Hi... i have a query,m mother has a property which was earned by my father .And after my fathers death my mom she doesnt wish to share it equally among all. She just want to gve it to her son.so can i fight for this.

We have a house in our ancestral village which is not being registered in the name of any of the family members. The house was built by my Grand Parents. My grandfather died 4 years back without leaving any will for the same. The surviving legal heirs include an ailing widow wife, two sons and one daughter. There is a lot of tussle and issues existing amongst my grandma & uncle as because of the wicked behaviour of my uncle. What are all the legal remedies available for the same and how come this ancestral property can be distributed amongst the legal heirs?

Respected lawyers, my age is 53 years , central govt servant , and my wife state govt servant , daughter post graduate and working , son in 12 std and learning , i am under depression treatment since 7 years due to my arrogant and , selfish wife , i feel strongly that in my older age she will not accompany me . i feel jointly we should go for divorce however she is not ready . in india divorce take lot of time and i am 53 years old therefore can i live just as friend with unmarried women .

When i can file for Annulment? My wife is not mentally stable and i got to know about it after 7 months of marriage. I was married in Jan 2016. She is with her parent now since Dec 2016, the day when i got to know about her mental illness. There was no physical relation between us.
Can i file annulment now? What is procedure and is maintaince is applicable in case of annulment?
I readsomewhere that one can fill annulment within 1 year of day when we got to know about such fraud.

Sale deed
Dear experts! happy new year , sir one of my friends is having dispute with the in law, his father- in -law has purchased one flat by paying from his saving account, but the flat he transferred on his daughter name i.e sale deed was made in his daughter name i.e is my friends wife name. his in laws has also given ornaments in the marriage to his daughter. now after my friends is having child so, due to his study from paly school to till 2nd class they were changing their place of residence, they use to choose residence close to the school. therefore the original sale deed and ornaments my friend gave to his father in law for safety reasons.now from last few days some dispute is going on with the fahter in law therefore father in law is not giving back the original sale deed and the ornaments which my friend has given to him for safe custody. and saying do what ever you want to do i will not give you back the sale deed and ornaments of his wife. now please advise me what to do in the matter.
