Hello,
My family resides in Bikaner Rajasthan. My brother died about 2 years ago and left behind his widow and two children. They are living in the house owned by my mother. The wife of my brother has started harassing my parents and started to force them to give her the house that they are living in. She has also done some construction work in the house without their permission. After my brother's death, everything that was in his name (two plots, his business, insurance, investments) were transferred in his wife's name. This house that she is living in now is made from the earnings of my mother (retired government teacher) and my mother does not want to give it to her because of her bad behavior. We consulted a local advocate who said the case in court will take decades, so it is better to resolve this matter out of court. The biggest problem is that the local MLA is in favor of my brother's wife and because of this, police is also not taking any action. What should we do? My mother paid EMIs on the loan of this house for 25 years and almost invested all her life's earnings into this house and now she is almost losing it to someone she does not like. Does law in India support people who do not have any contacts with influential people like MLAs? Please help.

My sister in law falsely implicated my family members including me in 498a presently I am in Saudi Arabia and I was not there at time of dispute and FIR moreover my brother and his family was not with my parents and were separately I want to comeback to India and to quash names of all my family members including me
Kindly elaborate the procedure

Hi.. I am married for 4 years and fall into an Extramarital affair from last 9 months.. 3 months back my wife came to know by hacking my WhatsApp.. she has read all the chat we had about the enjoyment of our physical relationship ( me and my Girlfriend)..
Now she want a divorce but my Extramarital affair has got over last 2 months back, and I am not in a relationship with her anymore..
Now she is harrassing me a lot, want to send me the legal notice by staying with me only, threating to commit suicide, threating to harm the girl with whom I had an affair, threating to make a police complaints for domestic violence..
I am fed up with her threating on daily basis and cannot concentrate on anything..
Pls advise and suggest a good lawyer as I am totally mentally disturbed..

i was married in december 2015, since then the relation between me and my husband started to become bad with time. he started misbehaving, doesnt talk, use to lock me in home while he was out for work, insulted my parents, keep forcing me to leave (by saying that you are not living according to me); i reported this at nearest police station in maharashtra (where we lived and also his work place) and then i come back to my parents in chhattisgarh, from then he never came to take me. after some time he Filed RCR SECTION 9 in madhya pradesh, (where his parents lives), i m attending every hearings, for which i have filed petition for SECTION 24, and SECTION 125; but he is refusing it by saying that his mother has cancer(in reality it is cured) and his all salary is expanded there. His father is in govt job and his mother has a business running well. i cant manage to go in every hearings, since it is costly and i feel insecure. Therefore, i want the transfer of RCR SECTION 9 which he has filed in MP, to CG. Please Experts, tell me the procedure to transfer and what should i do for SECTION 24, and SECTION 125 as he is refusing for it.

In my family my Bhabhi wants divorce after 30 years of Marriage
No reason is being given - Her allegation is her husbands drinks a lot and beats her regularly - which is not true as we live in Joint Family
Also the children are grown up and stay in USA - All the expenses of their studies were done by her husband only
The children are having independent lives in USA
My brother has does not want to divorce at this stage of life
My Bhabhi is now asking for divorce by Mutal consent and large amount of alimony which her husband cannot pay - Now what are leagal options avalible to prevent the marriage

I applied for divorce & my husband filed restitution of conjugal rights thereafter i.e. after receiving the divorce notice under same court. Will it b rejected u/s 10 CPC? Kindly suggest.

Messages OPPILAMANI G 04/01/2018 16:12:41 Sir, My brother out of our family from 1980 was living with 3 ladies at Chennai Vandalur,one after another and came to his native place at the fag end of his life and died at Ariyalur on 10-4-2017. Death certificate obtained at Ariyalur. First two ladies left him in 2003 itself after executing Marriage cancellation deed duly registered in the Sub-registrar's office. The third lady living at Vandalur applied for legal heirship crtificate from the Tahsildar, Vandalur where the deceased lived in his own house. The Tasildar rejected her request for legal heirship on the ground that the deceased was living with three ladies from 1980 to 2017 and the present lady(third) has no right to call her as legally wedded wife as the second lady has left the deceased in 2003 after executing marriage cancellation deed but legal separation order obtained by the third lady before marrying the deceased in 2003..The Tasildar has directed her to approach the Civil court for certificate in Aug,2017. Till today she is not approaching the Civil Court. At the native place of the deceased there are ancestral landed properties, patta records are standing jointly on my name and the deceased even though he never turned to Ariyalur, native place for nearly 37 years. We both never earned any properties and myself looked after the affairs of ancestral properties. The third lady is not prepared to approach the civil court for legal heir ship certificate as she is not having any divorce orders from the court permitting the deceased to marry.a third lady. What is the remedy available to me being the only male brother of the deceased to delete the name of the deceased from the Joint patta.and can I apply for II class legal heir ship ceretificate. As the landed properties are at Ariyalur Where I have to apply for as such for deletion of name in the records or for legal heir certificate.either At Vandalur or at ariyalur. kindly guide me

Hello sir,meri friend ki shadi 2014 m hue thi uska husband bhot jyada shak karta Agr wo kisi ki taraf dekhti h toh bolta h Tum usko dekh rhi thi.agr open wifi connect ho jata h toh usme b shak krta n wo kahi ja pati na kisi se bat kr pati or divorce k Naam pe dhamki deta or Marne ki b dhamki deta h.wo usse divorce n dena chahti Bs uske Mann se shak Nikalna chahti h.how it will be possible plz suggest me.

False d/v case- how to present recorded mobile conversation
I (Respondent-3) had filed a petition in H/Court for quashing of false time-barred d/v case filed after more than one and half years; myself quoting Supreme Court judgements. It is now listed for January 2018.
Following 2 things were submitted to H/C: (1) PCR report that she was kept in captivity and was not allowed to go to sasural (2) asylum report for having kept for 25 days.
After a son was born to them , she was brain washed and indoctrinated to file a lucrative d/v business by her father.
There is recorded conversation (mobile) between my son and his wife intertalia stating that she was in captivity and was given some injection and being kept in asylum; and her parents are up-to-do anything. A police officer living in neighbourhood compelled to withdraw the complaint on the plea that she is made. Obviously she was brain-washed and indoctrinated to file the lucrative d/v business and withdrew complaint.
Now the question is how can I present the recorded conversation which can be accepted by the court in view of Sec-65B Evidence Act. I think there are exceptions from producing certificate. Considered opinion shall be highly appreciated.
