1. Got Married in Mumbai
2. Last staying together in India was in Calcutta.
3. Went to USA for few years and there difference cropped up and both got separated and both came back to India. Girl stays in Nagpur and Boy now in Chennai.
4. No contact since last 5 years and efforts for mutual consent divorce last year did not work hence went for divorce petition filing .

Now question is where should the case be filed ? Any reference case laws would certainly help here. Thanks for reading .

Objection after chief-examination given by p.o.a. holder

A petition for divorce under section 13 (1)(i a) H.M.Act, Cruelty is filed by the power of attorney holder of a petitioner wife without obtain court permission and court admitted the petition. Petitioner sife has not signed the plaint and does not given her affidavit on plaint. In mediation centre the power of attorney holder is appeared behalf of the petitioner wife. When respondent husband raise objection about this, the court has denied his objection application. Also, the chief-examination on oath (affidavit) and documentary evidences is given by power of attorney holder of the petitioner wife. The petitioner wife is never come in court during proceedings and never examines the petition on oath/affidavit. Unfortunately, the respondent could not raise his objection for exhibiting documentary evidences and chief-examination given by the power of attorney holder in court at that time, and the court has exhibited documentary evidences and chief-examination given by the power of attorney holder of the petitioner wife. Now, the respondent husband wants to object after the chief-examination and documents evidence given by the power of attorney holder of the petitioner and after exhibited those by the court. The next stage is cross-examination of the petitioner side.
1. Can respondent raise objection after chief-examination and documentary evidences given by the power of attorney holder but not by the petitioner?
2. Can respondent raise objection though the chief-examination and documentary evidences are exhibited by the court?
3. Can respondent file to an application to discard the chief-examination given by the power of attorney holder?

Court case

Dear experts.... With reference to my earlier query I want to further update that I have filed a case for Dv in delhi court, summons hav already been sent to my husband and next date to of hearing is 28th April. However summons have been sent to my husband only not to my in laws because I and they dont have domestic relationship. I also have given complaint to CAW cell for which they have sent notice to my husband thrice but my husband not coming there, although iam going on every date. What can I do regarding this?? Can I insist them to file FIR...any other tip u want to share?? Although i have appointed a lawyer and iam having full faith on him but even then i want to have a second opinion as this case is very imp for me. I have tried ma best to avoid this legal battle and sort out amicably but my husband and his family took this gesture of mine for granted. They thought me weak coz again n again i was requesting them to not to ruin my life. I hav gone to court with clean hands. Its a simple case of cheating where my husband asked me to leave my job and parents and come to his city and get married to him. And then after 3 months of marriage he started asking me to cancell the marriage.he dint ask me even divorce he simply asked me to get married to somebody else and never reveal this thing to anyonr that u were married brfore. He even tried to burn our marriage certificate also but somehow i managed to get it safe. His family also gave lot of threat to me. His brother being a law graduate starting giving threat to me that he will file lot of blah blah case on me and make me suffer alot.. for 6 months they kept on screaming that they doing some case against me ...but as they dont have anything against me so no case as per now. Kindly enlighten me with your usefull advice
