my wife is kept captive by her parents

i married in arya samaj but parents of the girl had kept her captive and lodged a case against me by her daughter thao i forcefully married her. the counsilor of the court tried her level best to make her negetive. my wife told the female counsilor that this case was forcefully done but five times the counsilor of the court didnt accepted her wordings.at the same time the girls mother tried to commit suicide and her father terrorised her to "go against the boy or i will also die" then she said to the judge that she dont want to continue the marriage. the girl is still with her relatives. iam not getting any support from the family coutr of bhopal. many of the court persons are under the influence of money given by her father.kyaa abhi bhi kannoon ko khareeda ja raha hai please help ne ansh joby mathew

Private notice

Ld counsels

In a family court case I have received a private notice, is it possible to take time in family court to replyto the private notice.

Should the reply be in terms of a counter to be filed in court. The notice is numbers with a IA number.

Please clarify.

Respondent Copy of the Petition

Que.1.Why is that Courts are not sending Respondents Copy Along with Summons?

Que.2.What is the Process of Collecting the Respondent Copy (without any Lawyer)once the Petition goes to Court room ?

Que.3.Does the Respondent Get Time to file the Response after collecting the Petition on First hearing from the courtroom?

Summon

Actually my wife has filed 13(1) case for divorce HMA.
It was as per my and my wife's predecided settlement in lieu of lumpsum alumni.
But i have not received summons in this regard.
The date to file W.S.A. is given to us privately by girlside only by phone and a copy of the filed petition also given by herside privately.
If without summon ,I file W.S.A. the will further proceedings will be valid or not?
Is there any chance of cheating with me?

DIVORCE

Dear Sir,
my cousin got married 5 yrs ago and soon after her marriage her in-laws started torturing her both mentally & physically, along with harassment for dowry.after a period of 2 years her husband deserted her and has been untraceable since then.subsequently we filed cases of dowry,domestic violence & maintenance against her in-laws.we now want our cousin to get married and as such we seek divorce.
in this circumstances we want to know if we can file a divorce case and get the divorce even when we have already filed other cases ( as said above )?

Please differentiate between Petition, Affidavit and Memo

340 crpc with 191 ..

My wife has filed a transfer CMP... in that affidavit she has blatanly lied that my 498A is Still pending, and also has given a wrong address.... I have solid proof to show that 498A has been closed based on her Withdrawal letter. Further Action dropped has been endorsed by the Judicial Magistrate also.

Regarding the address also she is lying in the High court. she has given an different address in a different town in the family court. I have obtained CA for that.

Now when the transfer CMP comes for hearing can I press the judge to take action aginst my wife for filing false affidavit under IPC 191 with Crpc 340 Suo moto.

sir\madam
i married to vibhawri on 6\7\2008.before that vibhawri married to milind on 1\1\2005.But milind expired on 17\11\2007.on 3\7\2008 vibhawri father took the rights(haq) from their ancestral property forcefully .will she get back her rights? can she file a case against her father?in which category it comes?

one divorced women have two major sons she married other man he accepted those sons also now he want to keep these sons as leagal heirs for his property my question is two sons legally father don't have any objection their mother's second husband can adopt those sons what is the procedure how they become legal heirs any solution for that in this matter i want to ask another question is at the time of divorce in divorce decree one para is mentioned that is those sons are not father responsibility from that onwards those responsibilities are taking mother now who will give adoption mather or father
