I want to know what should I do as my sister's in laws are not taking her inside house and his husband is always drunk and they are asking her to take her two children and go away.My sister was married six years ago and since then they are harassing her by some or other points and even they have beaten her as well. My sister is in different state and I don't know how to help her .....kindly advise me how to tackle them as they have taken dowry also and know they are removed her from house and she is all alone.what should we do? Kindly advise

Hello All,
IS IT TRUE that before passing any order on a DV (Domestic Violence) application, the Magistrate shall take into consideration any domestic incident report received by him from the Protection Officer or the service provider.
BECAUSE in my ongoing suite in Mumbai, the Protection Officer has NOT submitted any such report to the Magistrate.
SO in my next hearing date, can I take an objection regarding non-availability of any such report??
Please let me know your inputs.

I got married in late 2017 (through hindu marriage act) and soon after wife started behaving strangely raising imaginary issues with me and family members. She left within 3 months of marriage.
Then I found out through detective that she had a past marriage and it is dissolved. I and my parents came to know about her past marriage only now. This was my first marriage. I feel like cheated and now she has filed maintenance 125 Crpc
I think she married just to make money out of this marriage.
I want to fight such that she dont get a penny for maintainence/alimony.
Please advice:
• Is my marriage legal?
• What all laws/tools I can use to defend me and my family.
• How to make sure she don’t get any maintainence

Hello,
My in laws are threatening me with very abusive language and are saying they will file dv and 498a.
This is my 2nd marriage and I have already fought 498a up to supreme Court at the time of 1st marriage.
My wife had went to her mother's house and now they are not sending her back. She wants to return but she is scared of her mother.
I do not want divorce as I have a 20 month very cute son.
What are my options to protect my self and also not go for divorce?
I don't want to go with RCR as the moment I will file a civil case they will file criminal cases on me.

Do we have any section number as per Indian law applying which the divorce happened as ex-party cannot be challenged in the higher court?

Sir, I had filed the reply to thePetition filed by husband for custody of my child...The child is with me from last 7 yrs since his birth.. do I need to file a counterclaim also?
My father's home is without any will, in this case this land should be divided with we all the child (2 sons & 2 daughters) and mother equally, but my sister is applied 2 home in Pradhan Mantri awaas yojna on same land, (one of the application is in name of her elder son, who is not even a claimant of the land) and both are sanctioned. now she doesn't listening to anyone and starting to build 2 home on that land.
How can we stop her to build this homes?

I have moved a petition for divorce on grounds of cruelty. It proceeded Ex-parte and order was reserved for today. Today judge pointed out that I had by mistake in the title written "petition u/s 13(1)(A)" instead of 13(1)(1A). what options do I have? It's a typographical error. I have given all the evidence, pleadings about cruelty only. Please help me with a judgement if any. It took 4 years for the case to reach at this stage. Dismissing it will cause grave injustice to Petitioner.
Please Please Help me with anything.

Divorce
Hello All,
I and my husband have been parted since 1 year(living separately).We have applied for a mutual divorce. My lawyers says after 1.5 months of filing petition we can again file another petition to get divorce early like by 3 months. Can the 6 months waiting period be waivered off as he suggests?
And he has charged me 10,000 to file the petition the 1st time to court - does it cost so much?
Total amount charged for the divorce is 25,000 and asks me to pay the entire amount at one go - can I go ahead any pay him?
