Cheated by wife...

Sir,
(Am asking for my friend)

His wife, married an another man, without divorcing her legal husband (ie; my friend)??. She married th second man in the registrar office hiding the fact from the registrar, tht she is already married.
Sir, in this case can my friend file a case against her for bigamy? And sue against her second husband & witnesses?

In such cases whether the court will punish th man who married her second time? (even after knowing tht she is married & not legally divorced). In this case can th court will punish th witnesses (who signed in th registrar office as witness. They also know tht she is already married).
Can the Registrar can sue against her & th parties? (Because, They deliberately mis guided the Registrar).

Can she file a domestic violence case against her legal husband?
In India what is th punishment for bigamy? Is bigamy is treated under civil or criminal procedure, in India & how long it will take for the final judgment?

FALSE 498A CASE TRANSFER

DEAR SIR,
MY WIFE HAS PUT FALSE 498A CASE ON ME & GIVEN THE TRANSFER REQUEST TO SUPREME COURT TO TRANSFER THE CASE FROMCHHATTISGARH TO HER PLACE MP ONLY BECAUSE OF HER CONVINENT.

IN THE 1ST BENCH I LOST THE CASE BECAUSE MY LAWYER HAS NOT SUBMITTED SOLID DRAFT & SC ORDERS TO TRANSFER THE CASE TO MP.

I REOPENED THE CASE & UNLUCKLY I LOST THE CASE AGAIN BECAUSE MY LAWYER HAS NOT SUBMITTED THE DRAFT IN TIME.

NOW, PLEASE ADVICE WHETHER IT IS RIGHT TO REOPEN IT AGAIN, & WHAT IS THE CHANCES OF WINNING OR I CAN CONCENTRATE ON MY CASE TO FIGHT FROM MP.

PLEASE ADVICE.

Dismissal of Sec. 9

Dear All,

Myself had submit a case against my wife under sec 9 in Nasik court. She is leaving saperate since 21st June'2008 in Nasik with her parants & alongwith our son. She is having well earning. but The Hon. Nasik court has dismissed my application & kept the matter as is. Now I am in confussion about next step. I am ready to call back my wife honestly but her parants insist her for not to go husband house. her father is retired from a Bank & they have only two daughters.

I will be thankfull if you suggest me better solution

Live In Relationship

Hello,
I am having 2 sons and am having a live in relationship at the same premises belonging to me.
What are the consequenses of the lady having a live in relationship with me in case there is a break up or not.
Properties are all on my name and mothers name.
Whether there is a breakup or not, could she claim on the properties, bank balances or ask for maintainance in the future.
What time period has she to be staying with me to prove anything between us and what type of proof would be required.
I have also got a registered document of another flay showing her on leave and license basis, but she is staying at my residence with us.

impotency allegations

Ld counsels,

Wife complained about non-cohabitation in the ciminal case and also in her deposition before the magistrate she maintained non-cohabitaiton and non-consummation and demanded dowry for re-union.

However in her marriage annulment petition she has taken a stand that marriage has not been consummated owing to the impotency of the husband. There was no whisper of impotency of husband in the criminal proceedings.

Is this an act of vexation to scandlize the husband. On this ground can the annulment petitioner be dismissed.

very urgent help needed

It is quite better to put every thing on paper and present a private complaint in the concerned jurisdiction court seeking relief under the provisions of IPC. Later better to file a petition before the Pre Litigation Cell of your jurisdiction Court before she does or approaches any legal measures.
There are mediation centres to solve the problem. With their assistance better to have psychology counselling which will show better way of understanding.

Perent Rights !

Hi,
I wanted to know what are the parents rights on women while divorce has been file in court.

Here are some conditions.

a) She has put a FIR for leaving alone to earn and do job.

b) divorce has been filed

c) she is not leaving with either husband or her parents.


In this case is there any rule/policy/act to keep the she in her home.

Some one has told me that their is no parents rights after marriage.

Please guide...

Divorce and Remarriage

I got divorce order on 1 Dec 2010,I applied for certified copy on 7 Dec 2010,and i got the same on 24 Jan 2011,I had been fighting for this divorce since 2005.As informed by my lawyer the appeal period commenced from 7 Dec 2010 and ended on 10 Mar 2011, accordingly,my second marriage is fixed for 29 May 2011, now in the meanwhile, my ex husband has made an application of stay order in the high court on the judgement on 9 April 2011, and in the application it states that it is within the appeal period!!I appeared in high court,no where in the application there is a dispute about the divorce part of the judgement,since there is a joint property issue involved we agreed for the settlement,Now the problem is the next date given to us is on 16 June 2011 for settlement and file the minutes of consent terms as high court will be closed for one month vacation,I have following questions
1)Does my divorce decree holds true,since there is no order passed on the stay order.
2)Can i get married on 29 May 2011
3)Can i later fight for my rights on property
Please help, I am in great dilemma and do not wish to do anything out of the legal frame.
