This boy is staying in a district & the girl & the mahila sangam is at city.
Kindly advise me where to lodge F.I.R.
In city or the district where the boy is staying.

Dear sir,my freiend's son is 27 years old & he is a doctor. He was in love with a girl for the last 4 years,inclusive of physical relationship with the girl with mutual conscent with necessary precautions. before 4 months girl refuse to marry him & last month she called him again & he was taken to a local mahila sangam. There in presence of 10 onknown people,he was forced to sign on a 10/rs non-judicary paper that he will give assurance to marry her. My queries are as follows. 1.Since both of them belong to differant communities boys parents are not willing for this wedding. 2.In case they force him to get married i think this would be a troubled marriage. 3.After marriage can the boy seek for divorce with out performing the consummation ceremony officially. 4.in case he files a for a divorce,can he get a divorce.What would be the time frame. 5.With out performing the marriage,can he escape paying her some compensation. His whole family is in distress. Please advise me what can be done. Intimate relationship of both of them was with mutual consent. Please send your valuble advise. Dear Sir,
My Name is Md Ibrahim, working as AM in a reputed bank. Recently I got transferred to Hyderabad Dec 10. I used to work at Adilabad, as my father expired recently Nov 2010; there is nobody else to look after my mother & sisters, so I got transferred to Hyderabad in December 20.
My parents solemnized my marriage on Nov 2009, with a girl residing at Adilabad. After marriage she too used to stay along with me at Adilabad. My parents used to stay at Hyderabad due to my sisters education. My in laws deceived me & my parents by providing wrong age of girl, which I came to know on marriage night. I did not disclose this matter in front of my parents. She did not establish physical relation with me. after my repeated counseling to her; she pleaded & said not to reveal anything to my or to their parents. Though I did not got any satisfaction with her in married life still I adjusted & compromised with her &wanted to maintain good relation as this marriage was solemnized by my parents.
One late night in November 2010 I received a call from my mother, that my father`s health is serious & I rushed to Hyderabad along with her in a car. After a week my father passed away. I & my mother used to stay in hospital along with my father. Before commencement of my father`s funeral rituals she left my home on 8 Jan 11 saying she would like to visit their parents for couple of days without seeking me / my mother`s permission and staying till date. She has been called on several occasions by me & my mother, still she did not turned up. I have sent a letter stating to come back by Register post also, and also stated that if any complaints regarding my behavior can keep in front counsel. After 1 month I started receiving calls from my In laws stating that I & my mother tortured her, never offered food and started threatening to me saying that they will lodge false complaint at Police station against me & my mother and even said they will kill me.
On day I called up my wife & their parents to meet at my residence for reunion. They called up my grandfather to their residence & said that I am impotent & they wanted me to stay away from my mother with my wife & also started threatening him that they will kill him & lodge complaint at WPS Begumpet.
I never had any intention to leave her, but now at this situation what shall I do, kindly guide me. I can`t leave my mother & sisters in this position. There is nobody else except me to look after them. It is my responsibility to take care of my mother & sisters & I have to do their marriages also.
I am scared if I call her where she will lodge false complaints against me & my mother at Police station.
Kindly guide me.

If this bill passes India will not even have budget for MP salaries.
Some highlights (well, every line in this bill is a highlight)
43. A married woman shall have the following rights, namely:
(a) she shall have the right to live in the house of her husband whether owned
by him or by his joint family or owned by him, solely or jointly, as a lessee or
licensee:
Provided that such right shall not be void in the event of judicial separation,
divorce or death of the husband:
(d) she shall have the right to claim an equal share in the gains of the
business of her husband or in the family business of her husband or in any other business in which her husband is a partner.
Widow shall have the first claim and absolute right to the property of her
deceased husband;
16. The appropriate Government shall appoint a Special Officer, who shall be a
woman, for every district to deal with cases arising out of this Act within the
territorial jurisdiction of that district.
Provision of pension to destitute women.
(e) destitute woman means a woman who has been separated, divorced or a
widow or an unmarried woman who has no source of income;)
Govt shall
(a)provide free and compulsory education upto graduation level to all women;
(b) open adequate number of educational institutions exclusively for women;
(c) reserve fifty per cent. of seats in educational institutions for women till
adequate number of educational institutions exclusive to them have been set up;
and
(d) provide scholarships to women for pursuing higher education.
Explanation.In this section, free education means uniform, books and
stationery, nutritious meals during school hours and transportation free of cost and no fees for admission or for taking any examination shall be charged.
* to ensure cheap, safe and quick transportation facilities for women
employees;
23. The appropriate Government shall provide a pension at the rate of rupees one
thousand and five hundred per mensem, to be revised from time to time, to all
destitutewomen till they are gainfully employed or facilities for self-employment have been extended to them or accommodated in womens homes .

Myself had submit a case against my wife under sec 9 in Nasik court. She is leaving saperate since 21st June'2008 in Nasik with her parants & alongwith our son. She is having well earning. but The Hon. Nasik court has dismissed my application & kept the matter as is. Now I am in confussion about next step. I am ready to call back my wife honestly but her parants insist her for not to go husband house. her father is retired from a Bank & they have only two daughters. She has no any valid reason for not to leave with me & also she is unable to produce a single evidence of any problem. Not only by me but all my family member & height is my 90 years old grand mother tried thousand time to convience her but she is not ready to shift herself to Aurangabad (My residence).
What about Divorce ??

As I came to know through Experts that It is Possible to File for Quashing DVAct 2005, 498A, 406 in HC Parrallelly to On-going above Cases in Metropolitan Majistrate's (MM) Court.
I have few Queries with regards to above:
1. In Jan'11 Cases DVAct 2005, 498A, 406 were Filed against us. but, till date Arguments & Evidences have NOT yet started. We have been getting Dates till now. IS IT STILL POSSIBLE TO FILE FOR QUASHING ABOVE CASES IN HC?
2. Does the MM allow Audio (Mobile) Recordings as Evidences? As the Evidences we have can go against the Wife. All the Allegations made by her can easily fail & proved false.
3. Do we have to take permission from MM or any other Court to allow Recordings AS Evidences?
4. Generally, How long does the MM take to Pass any Judgements in such Cases? Is it that the Wife demands Compensation & MM simply passes it?
5. Does the Wife need to Prove the Allegations She has made Against us in front of MM?
6. The Wife DOES NOT have any Proofs of whatever Allegations she has framed against us? Could the MM still favour her?
7. The Wife has stayed in her matrimonial home practically just for 30-35 days. Does she still have a chance of claiming compensation?

please advice what to do if other party is not appearing in court even after courts notice
I was married 6yrs back. Her mental health was not disclosed at that time and she suffered from acute psychosis. Her behavior was never good with me and my family. We tried to get her treated in the initial stage at hospital but she refused to go to hospital. When i told her parents about her behavior towards me and my family her father threatened me that his younger brother is a lawyer and will put me behind the bar if i think of divorce and one and half year back she left my house and started staying with her parents and we are not in touch since than. Last year mid i filled for divorce in court under sec 13 (1) (ia) and 13 (1) (iii). After which she filled a case under 498a and 406. I could get anticipatory bail for my parents from High court however on returning her articles during interim bail as ordered by High court, my anticipatory bail was rejected. Presently i have got interim bail of 8 weeks from Supreme court and anticipatory bail may be granted after hearing both parties for which notification has been sent to other party. In divorce case first notice was returned to court stating that she is not at home. after which two more dates have gone but nobody from her side is appearing in the court. On 21 May 11 is the fourth hearing date. It is requested to advice what should be done if nobody appears in the court from her side and after how many hearings if other party doesn't turn up, ex-party decision of publication/fixation decision is given . Please advice in regard to ex-party decision/publication/fixation. I and my ailing parents have already suffered due to all this. Please advice
