My Nephew got divorced after 3 years of separation and exparte.. Eevn after the divorce by court three years have been lapsed.. Can he go for remarraige and what precaution he need to take... What is his legal postion in the event that the divorced wife come back once again...?

I have been staying away since 16 yrs along without divorce, my all children are staying with my wife without my consent.
Now I wish to make new marry sothat I can live rest of the life, what should I do ?

My deserted me since 4th Jan 2011 as she do not want to take responsibility of our home and my unhealthy parents who has blood cancer. i tried a lot to get her back home but her father refuse to send her and says they need 6 to 8 months to think. At last i have no option to file RCR. Now my questions are :
1) If court pass decree to me what should i do to execute RCR?
2) If my wife still refuse to cohabit what should i have to do?

Its been 2 years that i am staying separately with my kids, i have filed for divorce but my husband is not ready for it. Can i get ex partee divorce on the basis that we are staying separately from 2 yrs, how long will my divorce take?

Sir,
I filed final decree proceeding in the trial court for partition of the suit. I am getting 2/3rd share in my mother's property who has died intestate. Now my sister is getting 1/2rd share of my mother's property. My sister's husband with malafide intention to grab the whole property filed a manipulated and bogus unregistered relinquishment deed in the court claiming I have relinquished my 2/3rd share in the property. I have denied ever signing such relinquishment deed to my sister and also filed rejoinder.
My sister is bent upon on creating legal hurdles to get justice since from the beginning of partition suit. Now she is trying to prolong the matter. Sir, please suggest me how to stop her harrassing me and to stop prolonging the proceedings. 17 years have elapsed still I am not getting justice.
I would be grateful for your kind suggestions.

Hi friends,
1. Divorce case filed by me.
2. After that my sweet wife filed DV Act & 498a is pending under investigation in CAW Cell delhi.
3. I got stay order for one week & and for other family members courts directs to the IO, to have the permission from ACP/DCP before arrest them.
4. My wife is working before and after marriage.
5. In DV act court sent for mediation, next date for same end of the july.
6. In CAW Cell mediation i refused to live with my wife and she want live me.
7. I sent a RTI application to CAW Cell for asking 07/2007 circular and cirtified stridhan list. no reply recieved..15 days past.
My Questions-----
1. How can i stop to register the case ?
2. what are the counter cases to be filed against my sweet 498a.

My wife complained at UP Police Station that my husband beats me for dowry and I am leaving my matrimonial house going to my maternal house at Delhi. After 4 months, My wife complained to Delhi Police that my husband and 8 other family relatives were beating me regularly for last 13 years for Dowry. Delhi police registered the case. On charge, Judge discharged 8 relatives stating that the F.I.R. to Delhi Police was framed and actual complaint was given to UP Police and charged the husband u/s 498A. Is it justify that a judge of Delhi court charge a person on a complaint to UP Police on which UP Police didn't register any case.
Thanks for the reply given by learned Devajyoti Barman. The marriage was performed at Delhi on 25.01.1991 and after that all so called events were happened at Ghaziabad. Complaint was given to Ghaziabad police which after investigation found the same as fake. Even the complainant moved the police station herself and was required no medical help. Hence, Ghaziabad Police didn't go medical checkup and she left for her maternal house after giving complaint letter. After around 4 months, she framed a different story involving 8 other persons stating that my husband alongwith all other persons collectively beats her. Judge assumed that it is a false story and charged husband on the basis of complaint given to Ghaziabad Police. Copy of order is enclosed. Please clarify. Thanks

Dear Friends,
Please help me in this matter.
My wife tried to hurtself but was unsucessful as I was present there. Then I called Doctor to examine her. But she got angry when doctor arrived and went to police station (This advice was given by her father earlier). There she complaint that my family tortures her & I dont care for her. Police asked her to file complaint in women cell.
Women cell IO heared the case on 1st date and referred the matter for counselling as according to them our marriage can be saved.
AFter attending counselling session I also realised some of my mistakes and ahe also realised her mistakes.
We both want to save our marriage as we both love each other but there are some issues as under:
1. I am under fear that she may again to try to hurt herself as she is quite impatience and lose her temper easily. How do I prove that I or my family members have not done anything.
2.She has got good influence of her parents. Due to their interference siutation has become worse as they hear only her side of story. She has habit of telling only her version not her mistakes.
3. I am only son & my mother is widow, she needs my support. It will be very difficult for her if I stay seperately from my mother. It is very difficuult for me also to leave my mother. My wife dont want that I should leave my mother but muy mother is not willing to stay with her due to consistant abuse and fighting from her and her parents also.
4. I came to know that she has alleged various false accusations like dowry demamd and other things in complaint to women cell. She have overstated everything there. It may be under advise of her relatives or advocate.
5. If I want to make any compromise in women cell what precautions I should take to save myself from future problems in case she again fights.
6. Will an undertaking or affidavit from her and my inlaws have any legal validity in case any future problem.

Property claim during/after divorce
I am going through divorce filed by my wife. I understand that I will have to pay alimony even after divorce. However I want to protect my property (inherited or self acquired) from her.
1. Can she claim my property (inherited or self acquired) during my lifetime either before or after divorce?
2. Can I make a will donating my property to charity so that she does not get anything?
