Tenancy rights

can father transfer his tenancy rights to one child without NOC from his other children.

Do such NOC is required when one has to take the decesion about his own property.

Lawyers bullying

I got my divorce 2 weeks before and I had paid my lawyer as and when he has asked. Now since the case is over by mutual consent after 3 years delay , he is asking for 50000Rs just like that. I will not be able to give such huge sums to him.. What options do I have ? He says unless I give him the money, he wont give me my divorce copy. how to deal with this unethical lawyer who is behind my money..

Mental health issue

My Mom ( Age 60) was under treatment of an psychiatrist from 1996 till 2008 after having mental sickness and brain scans.She suspects my father(age 64) is getting involved with other women and is depriving her and which is not at all correct.
She thinks she is fine and does not listen to any one of us.We ,brothers stay in different cities and tried by all means to convince her.She remains fine under medicine and Psychiatrist says she can do anything when she switches from depression to aggression.Only my father and mom lives in house and my father takes all care of her.They are living married life for last 36 years.
Even though she has filed a case against my father U/S 125 in local court which was
transferred to lower court and the her plead for INTERIM is rejected.We did not knew that she is giving put ups and saying as she will withdraw the case.
We want to resume the treatment and we are confident even treatment for 15 days will bring her back as the similar thing happened eariler too.

Problem is:
1.She is refusing to talk to any and all psychiatrist and even over phone as she thinks she is fine and all we are conspiring against her.
2.We have only a few prescriptions of psychiatrist whom she used to visit earlier.
3.She is becoming violent ( keeping Gas cylinder open,threatening of 498A to my father)

Is there any way to give her treatment?

Dv act 2005

my wife had filed a false d.v. case on entire family. date for my w.s. is next week.i have proofs to prove their allegations false.i wants to...............................(1)when should i ,submit proofs at this date(my w.s.) or during cross exam of her? (2)is intriam maintainance will be passed after w.s. or after her cross? (3)if i prove allegations are false then still she can take maintaince? (4)if she is taking allready maintainance in my rcr(through sec 24),still she is eligible for maintainance?is it will be same or more as compared to sec 24(decided by session court),while dv case is in lower court of another distric ......reply please.thanks

Mother in law

hi experts,
since past 1 yr i have been staying with my parents however inspite of telling my husband that to come n take me home he is not ready to come. all my day to day needs & expenses currently are being provided by my parents.my husband has completely washed off his hands from my responsibilty,he is completely under his mother's control under her thumb whatever she says he does accordingly , she is not fit to be called as a women coz she never wanted marriage limitations n husband in her life so at the age of 60 she has thrown her husband out of her home, now she is after my marriage from the day when i got married since day 1 she has problems with me she bad mouths me,abuses me,humiliates me every time n my husband never ever supports me on the contrary he listens to his mother & torchures me more n says whatever his mother says i vil have to listen now also only coz of his mother he is not taking me back home.my mother in law does not want that i shud come back home she is the sole creator of all the problems in my marriage,i have even said my husband that if she dont want me at my matrimonial home v can rent a home where v can live happily bt he is nt ready for that even.plz suggest me what can i do especially my mother in law she has destroyed my life n still she is not satisfied my life is spoilt due to her what can i do to teach her a lesson of lifetime she thinks that marriages are just for fun n timepass n people like her can make or break it whenever they want,so that next time before destroying some innocent girls life she thinks 1000 times n wont treat relations n marriages as her authority.
plz suggest asap.

Divorce

I was married four years back. After the marriage my in laws were continually interfering in my family. My wife created lot of nuisance while staying with my parents for three months. I brought her with me in Noida and stayed there for three months. In between her parents also arrived and took her along putting false allegations against me.She refused to come back. In between we had a daughter. Her behavior was not normal. After two years she came back with her brother. i found her behaviour erratic and took her to a doctor. She was referred to a psychiatrist who diagnosed her with acute mental illness and was on medication. It was disclosed that she was suffering from this problem since her childhood which my in-laws had hidden. Her behaviour was violent at times and was completely out of her senses. I took care of her for eight months and got the medication done. Dr. was of the view that she will have to continue medication for ever as discontinuing it may bring the problem back. Once she became little better she went back to her parents and refused to come back. In between she had conspired with her brother and called police. Her mother had been also suffering from same problem which is visible from her behaviour. They had been threatening to and very adamant during all this period. Her medical problem was hidden from us and still they are not ready to acknowledge it. However I have got all the medical records. Twice she had misbehaved with the daughter also going to the extent of breaking her head which needed stitches. Kindly advice me so that I can file a divorce as they are again threatening me with legal action. There ultimate aim is to extract money from me.

Will i be punished

Dear Experts.If my wife's side prove that i forced her to get married under special marriage act and I had met her in her home whenever there was nobody .I was fraud .Will i be punished for this.I did nothing wrong but these doubts always make me tensed so pls reply me.section 25 of special marriage act

i have nt recevd the notice yet whereas i have come to know that my husband has filed divorce case n the date is 12th jan.i want to know
1. how long i have to wait for the notice
2. may b he adapts some foul means so that i dont get notice in time .is it possible then that he will automatically get case in his favour.
3.is my sign nt reqrd for reciept of notice?
4.how can i get the info as to from which court he has applied the case??is there any way out ?

Summons

1)I have received summons (domestic voilence) from my wife which is not signed by any court officials is it valid..?
2)I was asked to appear before magistrate the very next day of the summons was issued,which i received after 5 days...is it valid..?

Divorce in goa

its been 2yrs since i have left my husband. It took a lot of courage to do so, as i was very afraid of him physically harming me. i have a 4 yr old child, and have been living with my parents.i left because, he was very controlling psychologically and financialy, he would waste money (to a point we had only 100 rupees to last the fourth week of a month, every month), borrow to an extent that i was afraid of the lenders, he punched me on two occasions and was confident of physically harming me.,there was no more intimacy(would on average have relations once every 2 months after asking for it), physically or emotionally, he sold my inherited gold, refused to take up a job for a long time, borrowed a lot from my family and refused to pay back.i do not trust him. i donot love him. i do not want anything to do with him. i have allowed him to regularly see our child, for the child's sake and because i have been dependent on my parents as secondary caregivers, and 2days a week, they want a holiday from baby sitting. its been a financial struggle,and i am just getting to a point i can afford day-care.
Now, my lawyer says that i do not have strong grounds for divorce. I would need to wait a total of 3 yrs, to show separation as my only ground. I have not filed for separation.
i am catholic, and married in goa. considering goa laws,,,,, whats the best way i have to get a divorce?
