Complaining to intelligence about delay in govt. office

Sorry for the typo: I mean vigilance NOT intelligence.

I've submitted application for building permit in my area corporation office. They are delaying it for bribe saying unnecessary reasons and sending it for unnecessary approvals ie. DTP (Detailed Town Planning schemes) office etc.

The corp. office told me that if I give the bribe he can avoid sending it to DTP for approval. On my refusal to give the bribe, he asked additional copy of already submitted documents, which submitted again, and even after one month it has not been sent to DTP office for approval. So, corp office is deliberately delaying the whole process. I had to use RTI for application status two times.

Now, can I send complaint to corp. secretary and vigilance to look into the whole process and take necessary actions?

If I use RTI, they will say that the 'work load' is the reason for the delay. I think, in case of vigilance, they can compare the progress of other applications filed for same purpose with mine.

So, please suggest the best way to handle this situation.

Statement made on affidavit as admission under evidence act

Although the Indian Evidence Act, 1872 does not apply to affidavits, are statements made on affidavits in a suit or elsewhere accepted as admissions under the Evidence Act?

Is there any case law on this?

In Basant Singh v/s Janki Singh, AIR 1967 SC 341, the Hon'ble Supreme Court held that a statement made in a plaint in one suit can be used as an admission in another suit.

Similarly, if a party made a statement on affidavit in a writ petition, can that statement be used against the party as an admission under the Evidence Act in another writ petition?

Posession of land

Dear Sir,

i have a sale deed which has been made in 1951.But my father & grandfather by that time could not make the ROR .AND the original ROR could not changed , and remain same with the person who sold that land in 1951. We have possessed that that land from 1951 to 2014 that is 64 years. But now the sons of the seller who hold that land claims to withdraw the possession and handed over the land to them. Can it be possible. Can I file a suit against him , and can I make anthor ROR on the basis of the sale deed made on 1951.

Kindly Advise.

Urgent pls guide

Hi Guest

Hope you all are doing good.

As discussed in my earlier query, our ex-employee has filed a case on company for recovery of salary and expense. I want to mention that he went absconding with laptop and other things.we have not terminated him and mention in mails that you are suspeded till the time u return the laptop and report to office.

In court he said and in suit prayer he asked in injunction from court agaist us to get laptop from him which is in his custody.

we filed written statement and next date order 7 rule 11 with sec35 cpc for asking false claim and rejection of suit.

In arguements judge dismissed their injunction application in which employee asking salary for months he was absconding coz nothing particular period was mention in appointment letter. judge also dismissed our application saying just because their prayer is not valid i cant dismissed whole suit.

pls guide is this point valid?

Then judge shifted matter in mediation where he disagreed to amount we were giving him.

now again matter is in court..

case wil run long but is there any remedy we can get laptopb as early as possible.
