Regarding taking as contract,

Dear sir,
I sanjiv kumar living at patna in rented house , there are four renters including me,
My Land Lord is old in age he has three sons but all are out of city ,
finally i care the house as rent collection, mentanance, etc,
Further i wnat to suggestion that if i want to take on contract to this house what legal paper i will have to prepare by an advocate,
what is the process,
pls confirm me,

Ancestral & self-acquired property

Hi All,

I am having the following Queries..

(a)If a person got property from his Father's Ancestral Property through WILL.Then whether the property to that person becomes Ancestral property or Self-Acquired property??

(b) If a person got property from his Father's Ancestral Property through GIFT.Then whether the property to that person becomes Ancestral property or Self-Acquired property??

(c)If a person got property from his Father's Ancestral Property through PARTITION .Then whether the property to that person becomes Ancestral property or Self-Acquired property??

Probative value of entries in bank pass book

Respected Experts,

In a suit for specific performance of agreement of sale, I am appearing for defendant. Plaintiff is trying to prove his case by filing Bank Pass Book containing entry of withdrawal of amount, which was alleged to have been advanced to defendant as advance sale consideration on the date of alleged sale agreement.

Every account holder of a bank possesses a pass book in his custody. There is every possibility to manipulate the entries easily.

My queries are :-

1. Are the entries in Bank Pass Book come under the head of primary evidence?

2. Are they admissible in evidence without examining the person who made those entries in pass book?

3. Can I object to its marking?

Please give your valuable replies.

Hsa 2005 ammendment


my grand father had 260 acre ancestral land in Bhopal (mp)
he died and land comes to my father my father died in 1962 .my mother died in 2010

i was born in 1960 .I have one sister born 1960.she asked for partition and filed a case in 2009 .

she demanded 50% share in 260 acre land on basis of 2005 act
there was no partition between us before this
my name was on record since 1971 with my mother .my sister name came on record in 2009.
so I filed a case in nov 2009

Is she eligible of 50% share?

her advocate says
the case is filed after act 2005 and as there was no partition before it so today's provision will be effective .

are there any cases solved on basis of 2005 act in which daughter got equal share
please tell me where i could find those case decisions .I lives in MP and land is in MP .There is no will of land from father parents

what would be my sister share in land and how?plz suggest

Use of ashoka chakra

I had put in a query earlier but got no reply to the queries of one of the experts
(Shri Dhingra).
Just a few days-ago it was found that the same person has also got letterheads with the National Emblem on the top centre of the page with

No address if in Mumbai or New Delhi or any other place.
Forget about being a Gazetted officer she is just a graduate and for the last 12 years has only been a Guest Relations officer in some of the "starred hotels"- a few months at a time.
We are concerned that she might be even having stamps/ seals of such a Ministry which as has been seen is "Ministry of Social Justice & Empowerment" having its office at Shastri Bhavan New Delhi ( no Mumbai office).
We are worried she might be involved even in anti national activities using the foreign passport holding husband who has been in trouble in multi crore scam with the DEpt of Revenue Intelligence.
What do the neighbors do??

Query on unauthorised construction

Dear Team,

On the basis of the created, bogus, forged General Power Attorney of the Complainant of the plot, the land mafia gang had transferred the land property among themselves and sold it to 3 parties eventually.

One of the sale deed was done during the pendency of the original suit. The complainant has filed various applications before the City corporation commissioner for the illegal construction that was carrying on the owners plot. But due to high handedness of the Land Mafia's with the City Corporation the construction was going on in-spite the commissioner had suspended the building permission to the opponent party.

Later, when the complainant filed case in the writ petition stating the commissioner had not taken any measures to stop the illegal construction on the complainants land , the commissioner was given orders to stop the illegal construction activity untill the final disposal of the suit by the Hon'ble High Court of Karnataka.

The final disposal of the suit in trial court was done in march 2013. The verdict was in the favour of the complainant and it was ordered that all the 4 fraudulent sale deeds should be cancelled and the opponent party was instructed to demolish at their own cost the building and hand over the possession to the owner.

To this opponent party challenged the lower court's verdict and has moved to District Court. Still the arguments have to take place in District court. (pending)

Meanwhile as the case was under the trial court the Corporation Commissioner had issued a final order under his ambit : stating that the building permission stands cancelled in the event the opponent fails in the original suit.

As the opponent party had failed in the original suit in all aspects and the complainant was declared as the suit property owner and ordered the opponent to demolish and give the possession of the land to the owner.

Now, when the court has ordered the verdict in favour of the complainant, Can the Complainant approach again to the city corporation commissioner for the demolition of the building which is Unauthorised and illegal even when the opponent party has preferred to challenge the lower courts decision in the original suit?
