Hi,
I am a law student. One of my friend come to me and ask a Question which are i m posting on front of you for your suggestions.
In or between 1997 or 1999 my friend's father has purchased a MHADA flat in MULUND at that time my friend with his family stay in Nanded. My friend doesn't know the address of the flat and before he get mature his father was dead. The problem is at that time my friends uncle entered in house and theft all documents of the flat. After the age of maturity his uncle is asking him to pay 15 lacks for the document and to give him address of the flat.
Now my Question is how can i know where the flat is ?. From where and from which authority i get such information. Should i do RTI and ask the MHADA to produce the list and also to Registration office to give information of registration done in that year. Or is there is any another way to get the information about the flat and duplicate copy of documents. Experts plz suggest and do the need full. I want to help my friend.

A review was filed against the judgment and decree under 47 the said review petition was dismissed subsequently appeal was filed against the original judgment my query is whether appeal is maintainable. Secondly does the order of dismissal get merged with the original judgment.if appeal is not maintainable can a revision petition be filed against the dismissal of review.

We tenants are asked by the lanlord /developer for NOC to MHADA in his favour.Before that Lanlord/developer 's commitments need to be registered on a stamp paper in a court of law.Please guide us more about this procedure.

We 12 people formed a society in the name of siyaram co op hsg society.
Then we purchased a plot of 35 gunthe.
We form this society in the year 1996. We cant registered it with co op dept.because this plot has a govt.reservation, so it is still a proposed society.
We have a registered sale deed of this 35 gunthe plot in the name of society only and not in the name of chief promoter.
Chief promoter is dead 10 years back. And now his legal heirs are claiming this land saying that chief promoter is the owner of proposed society.
Please guide us.

I thank you for your reply.
Ours is a pagdi System, Cessed property. It is slated for Redevelopment since last 8 years.
We were told that as per the new Govt. ruling, Redevelopment Agreements are valid for a certain period only, they cannot remain valid for many years as in the past.
(our Agreements have remained valid for 8 years).
I just want to know whether what we have heard is true.

Dear Experts of the Forum ,
Please guide me, how to make a person 'X' who occupied and constructed a building in my land in the year 1999( This fact came to my notice only in the year 2010, on seeing the WILL,after the death my father.) Presently 'X' is staying in USA and let out, the above building to tenants, the tenants are depositing the monthly rent in his Bank account. I am not able to get his or any of his relatives addresses. How to proceed with the filling of case against him. The notice served on him been returned with an endorsement of "addressee left".
Please GUIDE me.

my wife is having account with icici so can i get her account statement by filling rti or is there any other way by which i can obtain the information as same is required by me for legal proceedings.Also, how can i get her income tax return statement

Sir,
My opponent (victor) filled a petition for final decree in (land partition civil case) district court. But concern land has given to third party for 10 years lease. May I get your advice for the following query.
1). Can I file a objection petition against FD? 2). Can I file a separate physical possession relief petition? 3). Can third party (taken lease) file a objection petition or get stay order from HC against FD?

I represents electricity company.order u/s 125 has been passed against one of our employee ordering electricity company to deduct Rs 7000/- from the salary of employee and deposit in court.this order comes to the notice of company belatedly.the amounts which needs to be deposit in court comes to Rs 100000/-.Arrears of Rs 49000/- comes from Head office in name of employee.The company immidiately deposited Rs 49000/-in court.Now employee has resigned from the service.There is no amount is in hand of company except Gratuity. can company deduct Balance amount ie Rs 51000/-From Gratuity?in order to follow court order. if not,What are consequences of not following Hon'ble court order.Thanks in Advance
