In the case of illegal encroachment the decree has been executed and illegal encroachment demolished and possession was given and the case.was.dispossessed. off. Do the decree holder has the right to appeal against it. If no or yes under which rule

If regular employee working in Institution services are dismissed/terminated after departmental inquiry where should case be filed. In civil court or Labour court. If after dismissal from services can case be filed in civil court for stay. Please advice.

Dear Experts,
My father made a will in favor of me and my elder sister (jointly) of his house. He got expired 7 years back. My sister is divorced twice( though civil courts) and was staying with me after my father's death. After some time due to her spend thrift behaviour she started demanding more & more money which i couldn't afford as i have to take care of my own chirldren & family with limited income. Lately she started abusing & querraelling with me & my family. To avoid such day to day tensions due to my sister's behaviour, i moved out of my father's house and started living on rent. Now since past few months, she is verbly demanding that i transfer the whole share of mine in father's property on her name. She is also threatening that if i don't follow her demand, she might commit suicide and give my & my faimly's name in writing as responsible for her death.
Since she is living alone from past 3 years, She seems to be either under depression or indulged in some bad company or may be somebody is guiding her all this(apprently under influence of some religious guru unknown to me).
Kindly advice how can i safeguard my and my family interests, especially if she takes a step to harm herself in any way and leaves behind a note against any of my family members including me.

I purchased a flat having 1200 sq.ft out of which 214 sqft. mentioned as common area including passage, balcony etc.
My floor having 3 flats on which I am occupying flat having higher sq.ft. The floor is on 'L' Shape, on which I occupied corner flat ie single(Bottom stretch of L shape) other two are on row.
In front of my door common balcony(ie botton stretch of 'L') . Whether I can use the same for my exclusive right? If yes how much portion. Whether I Can put any grill for that portion in order to avoid people using area in front of my main door(even though it is common.).It is not a common passage.
My adjacent flat owner objected for putting gril stating area in front of my main door also common.
Please advise how to proceed further

Sir,
I have completed SSC in 1998. My father original name is G V Bhadrudu. But in my SSC, it came as G Bhadram. My father has ration, adhaar and all docs on name of original name.But in all my academic (SSC, primary schooling),job related docs, wrong name entered. My father has no identification document on this false name.
Now what should I do to correct my father name in all school and job related documents??

My father donated one acre of land to punjab govt health department with an undertaking that a primary health center with 30 bed hospital will be set up on this land. Total four acres were donated by my father, another member of our family and village panchayat, free of cost in year 1986.
Inspite of our continuous efforts till date the government has done nothing. Can we demand our land back now as govt has not fulfilled its promise which is in writing.

I'm a partner in partnership firm with A & B Partners from 13 yrs. In 2005 I came abroad by giving GPA to my father. Since then the other partners are misleading me and my father about the business and not providing true facts.It is a large scale cotton business and they are not showing any accounts. Though they are showing profits in IT returns but they are not sharing any profits to me. They have started another business(construction)and also bought lands without my consent. Now
they want me to go out of the partnership on the pretext that I'm not a active partner and not involving in day-
day activities. There is no expulsion clause in the partnership deed and it is a registered Firm. What are my legal options? Is there any legal ground for them on me? If I want to continue in the partnership and verify accounts what is the way?

There are two brothers and four sisters in the family.
First brother(A) passed away in June 2001,leaving behind his widow and were issueless, and the widow(C) inherited his house property. One sister(B)among the above passed away subsequently in sept. 2001.The widow (C)refered above, passed away in December 2009 interstate and she was issueless. The surviving members on her husband"s side at the time of her death are one brother, three sisters and children of diseased sister (B).
In a situation like this who are the legal heirs to the widow's property.
Do we take the date of death of the widow or the actual date of death of the late husband for determining the legal heirs of her husband.
Please advise.

Writ petition rejected but written order not finalized
I had filed a Civil Writ Petition under article 227 of the Constitution of India with regards to partial framing of Issues which was rejected by the High Court of Bombay at Goa. However the Order is still not made available either to seek Review or Appeal. The Bombay High Court rules - Rule 296 - Judgment how passed - (ii) A judgment delivered by the Court, when initialed by the Judge pronouncing it, either on the transcript of the Judgment or on the approval sheet attached to it, shall be final Judgment of which copies could be supplied to the parties or their Advocates unless the Judge delivering it desires that he want to have a fair copy of the Judgment for approval. in the later event, the Judgment shall be considered to be final when the fail copy is approved and initialed by the Judge. Its now 30 days still waiting. What can I do to expedite this judgment?
