Respected Experts,
I will be highly obliged if any one can help and enlighten me that Whether the registration of Equitable Mortgage OR the notice of intimation of Equitable Mortgage in Andhra Pradesh is compulsory..?
Which notification / amendments make the registration of Equitable Mortgage compulsory OR the notice of intimation is compulsory and to whom..?

In our building our landlord has occupied the whole terrace and has made room in which he is operating a commercial business from there. He also has made washroom on the terrace which is not in the originl plan. He has put up a very heavy hoarding on the building which in my opinion is very dangerous becoz the building is very old more than 65 years. There has been no structural audit done of thw building. More than this he has put up mobile antennas on the building without the consent of all the tenants. He also does not share any of the earnings from the advertisemnet as well as the mobile towers but if he makes any expense in regard to the building he collects the same from all tenants. Pls advice

Dear Sir
I live in mumbai in a pagdi system. I am renovating my house. We have replacing old Windows wood with new sliding windows. We had extended grill 12 inches from the actual windows. We are facing problem from the landlord for the extension. He is threatening to stop my work and asking for money for the extension. What rights do landlord have..can he stop my work or ask for money in regard to this.

A Power of Attorney document has been executed by the petitioner (principal) before a notary public in India, authorising his father to act on his behalf for family court proceeding of contested divorce matter.
In the document of power of attorney, the notary public has mentioned that,” In witness where of, I the undersigned have set and subscribed my hands on this __ day of __(month) ,__(year).” In the document of power of attorney, the Notary public has signed, affixed the appropriate notary stamp and endorsed that,” SINGED BEFORE ME” on ____ (date/month/year),
The POA document has not been attested by (other) two witnesses.
The POA document has not been authenticated by Registrar or sub-registrar. It has not been authenticated by any magistrate. The POA document has not been presented for any registration.
Que: Does this activity of Notary public on power of attorney document called as 'Authentication'? Does this power of attorney valid according to Section 85 of the Indian Evidence Act? How?

Sir,
We had a Shop in the Joint name of my Father & Mother at Thane Maharashtra, My mother is 1st holder & Father is 2nd Holder of that shop, as my Father is Expired and have no will neither no nomination for the Shop & my mother being 1st holder is alive ..so can You guide me what is the procedure for the transfer of the shop in my mothers name. In case if we need to apply succession certificate for that shop as the cost of shop is more than 40 lacs and the celing amount for succession certificate is 75000/- do we need to pay full court fee of rs 75000/- or we need to pay half the fees.

Person executed will and accordingly probate was obtained in 1985..Court order stating "... the executor to distribute the property as per will and render true account in a year or such extended period... to this Court..." However the executor did not apply for time extention and having failed to do so and has also not distributed the properties... despite lapse of over 28 Years- the beneficiaries filed suit for rendition of accounts.. In same Court.. Which is unduly being delayed... What other remedies do the beneficiaries have?

There is this firm called Samyak Nivas Haqh Sangh. They are running some project for flats. Where in customers need to pay 10% of the price of the flat as a Booking amt and after the construction is done rest of the amt will b converted into EMI. I have booked 1bhk which was for 900000 and paid 90000 as Booking amt. It was promised that the possession will b done in Dec 2015. We always visit the site to check the construction but nothing is yet started other than 1 demo Flat. It seems that this firm has one Owner named Suryavanshi who has several offices in different cities and they all have been closed. I have all the documents like dd on that firm's name and the everything on stamp paper. What will be the procedure to get my money back. I tried calling on numbers they had provided few months back and they said that give us a written application for cancellation and you will get amt credited in your acct. But I also heard that people who requested for cancellation long back also did not receive money yet. Please advise

I was running my bussiness with my partner .we used to provide security cheques to some parties for material later on we used to make payment in cash and take back security cheques .As i used to do my job along with it so my partner used to go to parties and give them security cheques on my behalf and bought material.But recently my partner ditched me and he has filled his name on my cheques amount on cheques has been filled by me but name and date on the cheque has been filled by him.he has presented cheques in bank which has been bounced,now he has filled a case of 138 against me amount in cheques is total of around four lacs. He has shown he has given me friendly loan of four lacs all in cash he is not having any signed document of mine.he is having only cheques filled in by me but name and date is filled by me now can he claim money from me through false court case. Pls.guide

Can I withdraw the power of attorney to previous advocate by giving a simple application to the judge on next date.?
